FOX communication equipment


UCST License Certificate
The Universal Configuration Software Tool UCST,
used to configure FOX-U, FOX-U/M and FOX 515
comprise a set of configuration and monitoring
applications.
UCST is developed on behalf of ABB Switzerland Ltd.
and runs on PCs with Windows 98/ME or Windows
NT 4.0/2000/XP. UCST uses a proprietary
communication protocol. System Integrator, OEM
customer or end user is hereafter referred to as
Customer.

LICENSE AGREEMENT
The licensing agreement is a port of ABB Switzerland
Ltd. general business conditions. An award of a
contract or an order for FOX-U, FOX-U/M or FOX
515 equipment of a customer implies that the
customer enters and agrees upon the conditions of
this license agreement.
In return for payment of the applicable fee, the
Customer is automatically grated a non-exclusive
user license in the UCST application software
(hereafter referred to as Software), until terminated,
subject to the following:
USE
Customer may use the Software together with
FOX-U, FOX-U/M or FOX 515 products on any
Windows 98/ME or Windows NT 4.0/2000
platform (workstation, desktop, PC, laptop or
notebook) recommended by ABB Switzerland
Ltd.
Customer may not reverse assemble or
decompile the Software.
COPIES
The Customer is entitled to make copies for any
given number for the application with FOX-U,
FOX-U/M or FOX 515 (test, training, installation,
commissioning, maintenance, off-line
configuration, etc.) under the condition of the
payment of a license fee per FOX-U or any other
mutual written agreement.
OWNERSHIP
Software is copyrighted and protected under the
applicable copyright laws.
Customer has not any title of ownership of the
Software, other than ownership of the physical
media.
Any right to access the UCST software source
code is explicitly excluded.
TRANSFER OF RIGHTS IN SOFTWARE
Customer may transfer rights in the Software to a
third party as part of the transfer of all their

agreement of the third party to be bound by the


terms of this License.
Upon such a transfer, Customer agrees that their
rights in the Software are terminated and that
they will either destroy their copies and
adaptations or deliver them to the third party.

SUBLICENSING
Customer may not sublicense the Software or
distribute copies or adaptations of the Software to
the public in physical media or by
telecommunication without the prior written
consent of ABB Switzerland Ltd.
TERMINATION
ABB Switzerland Ltd. will have the right to
terminate this Software License for any Customer
failure to comply with the License terms.
UPDATES AND UPGRADES
This License Agreement does not include
updates and upgrades.
EXPORT CLAUSE
Customer agrees not to export or re-export the
Software or any copy or adaptation of the
Software without the prior written consent of ABB
Switzerland Ltd..

WARRANTY AND LIMITED LIABILITY


SOFTWARE
ABB Switzerland Ltd. warrants that the Software
product will execute its programming instructions
when properly installed on the computer. ABB
Switzerland Ltd. does not warranty that the
operation of the Software will be uninterrupted or
error free.
LIMITATION OF WARRANTY
ABB Switzerland Ltd. makes no other express
warranty, whether written or oral, with respect to
this product.
LEGAL LIABILITIES
In no event shall ABB Switzerland Ltd. be liable
for any direct, indirect, special, incidental or
consequential damages (including lost profit)
whether based on warranty, contract tort or any
other legal theory. Some countries or states do
not allow the exclusion or limitation of incidental
or consequential damages, so the above
limitation or exclusion may not apply to you.
