Maharashtra Devdasi System (Abolition) Rules, 2008


In exercise of the powers conferred by sub-section (1) of section 20 of the
Maharashtra Devdasi System
(Abolition) Act, 2005 (Mah. XXXIII of 2006), and of all other powers enabling it
in that behalf, the Government of
Maharashtra hereby makes the following rules, the same having been previously
published as required by said
sub-section, namely :1. Short title. - These rules may be called the Maharashtra Devdasi System
(Abolition) Rules, 2008.
2. Definitions : - (I) In these rules, unless the context otherwise requires, (a) "Act" means the Maharashtra Devdasi System (Abolition) Act, 2005 (Mah.
XXXIII of 2006);
(b) "Commissioner" means the Commissioner of Women and Child Development,
Maharashtra State;
(c) "Section" mean the section of the Act.
(11) Words and expressions used but not defined herein shall have their
respective meanings as assigned to them
in the Act.
3. Qualification for Nomination of Members of the Control Board. - (1)
Nomination of a person as a
member of the Control Board under clause (b) of sub-section (2) of section 5 of
the Act shall be made from
amongst persons. (a) of ability, integrity and standing having adequate knowledge and experience
of dealing with the problems
relating to the exploitation of women;
(b) who are not less then 35 years but not more then 65 years of age on the date
of his nomination:
Provided that, the person possessing,
(i) a degree from a Statutory University or a Deemed University, in Social Work
or Sociology or Economics or
Education or in the subjects relating to various issues of Womens Rights or
Rural Development; and
(ii) knowledge and experience of not less then five years of work in abolition
of Devdasi system, rehabilitation
and development of Devdasis, and in solving problems relating to exploitation of
women, laws relating to women,
their development and rehabilitation, shall be given preference in nomination.
(2) A person who, in any manner, whether directly or indirectly, involved in
propagating, encouraging, or
supporting Devdasis system or in any other act which is against abolition of

Devdasis system, shall not be


nominated as a member of the Control Board.
(3) No person who has been nominated as a member for two times shall be eligible
for re-nomination.
4. Procedure for Nomination of members on Control Board. - (1) The Commissioner
shall, through an
advertisement in at least one newspaper and in such other manner as he may deem
fit, call for applications for
the nomination as a members on the Control Board.
(2) The Commissioner shall, after scrutinizing such applications received,
prepare a list of eligible persons and
submit the same to State Government for nomination.
(3) The State Government shall then nominate eligible persons from such list as
a member on the Board:
Provided that, where it is proposed to nominate a Woman member, the State
Womens Commission shall be
consulted before such nomination ,
5. Term of office, resignation and filing of casual vacancy of non-official
member of Control Board. (1) The term of office of non-official member of Control Board shall be such,
not exceeding five years, as the
State Government may, by general or special order specify.
(2) A non-official member of the Control Board may resign his office at any time
by giving one months
advance notice in writing to the Government.
(3) Any casual vacancy of non-offocial member may be filled by appointment of
another person, who shall hold

office so long as the member in whose place he is appointed would have held it
if the vacancy would not have
occurred.
6. Allowances to non-official members. - For attending the meetings of the
Control Board, a non-official
member may be paid the travelling , daily and sitting allowances, at the same
rates as are admissible for Group
A Officer of the State Government, from time to time.
7. Qualifications for Nomination of Members of the District Committee.- (1)
Nomination of a person as a
member of the District Committee under clause (b) of sub-section (2) of section
8 of the Act shall be made from
amongst persons (a) of ability, integrity and standing having adequate knowledge and experience
of dealing with the problems
relating to the exploitation of women ;
(b) who are not less then 35 years but not more then 65 years of age on the date
of his nomination :
Provided that, the person possessing.

(i) a degree from a Statutory University or a Deemed University, in Social Work


or Sociology or Economics or
Education or in the subjects relating to various issues of Womens Rights or
Rural Development; and
(ii) knowledge and experience of not less then three years of work in abolition
of Devdasis system, rehabilitation
and development of Devdasis, and in solving problems relating to exploitation of
women, laws relating to women,
their development and rehabilitation, shall be given preference in nominationl;
(2) A person who, in any manner, whether directly or indirectly, involved in
propagating, encouraging, or
supporting Devdasis system or in any other act which is against abolition of
Devdasis system; shall not be
nominated as a member of the District Committee.
(3) No person who has been nominated as a member for two times shall be eligible
for re-nomination.

Women and Child
Development Officer shall, through an advertisement in at least one newspaper
and in such other manner as he
may deem fit, call for applications for the nomination as a member on the
District Committee.
(2) The District Women and Child Development Officer shall, after scrutinizing

a list of eligible persons and submit the same to the State Government for
nomination.
(3) The State Government shall then nominate eligible persons from such list as
a member on the Committee :
Provided that, where it is proposed to nominate a Woman member, the State
Womens Commission shall be
consulted before such nomination.

11. Functions and Duties of the Control Board :- (1) It shall be the duty of the
Control Board to impart

training to the Members of the District Committees, periodically.


(2) The Control Board shall take appropriate actions on the recommendations of
the District Committees.
12. Annual Report and returns of the Board :- (1) The Control Board shall submit
to the State Government
an Annual Report about its work in every financial year not latter then lst July
of the following year.
(2) The Control Board shall furnish to the Government any other returns and
other information relating to its
activities, as the Government may require, from time to time,
