Abstract:
The title of the local law is: A Local Law of the County of Albany, New
York, Amending various provisions of the Albany County Charter and Local
Law No. 8 for 1993 as subsequently amended and for the purpose of
incorporating the Probation Department and the Board of Elections into the
Albany County Charter.
The purpose and effect of this local law are:
(1) Amend the current Albany County Charter, to update language and
provide clarity throughout the Charter.
(2) The amendments to the Albany County Charter would:
a. Create an Article within the Charter regarding the Department of
Probation. The Department of Probation seeks to ensure the
safety of Albany County residents by supervising all juvenile and
adult clients on probation and helping them become responsible,
productive and law-abiding members of the community.
b. Create an Article within the Charter regarding the Albany
County Board of Elections. The Board of Elections provides
support and oversight of election operations for both primary and
general elections, registration of eligible voters and voting
information to the general public.
c. Extend the period in which the County Executive may make an
appointment to fill a vacancy in a Department Head position from
forty five (45) days to ninety (90) days, and extend the period in
which the County Legislature may confirm such appointments
from forty five (45) to sixty (60) days.
d. Mandate the written designation of an order of succession for the
offices of County Executive, County Comptroller and County
Sheriff.
e. Define and mandate that an Administrative Code be adopted by
the County.
f. Mandate that public hearing notices be made available on the
Countys website.
g. Update various sections of the Albany County Charter by defining
previously outdated or ambiguous terms and correcting language
for clarity.
