AFFIDAVIT OF WITNESS
I, PO1 ELBERT MAGLINAO, of legal age, married, and a PNP member presently assigned at
Naga City Police Station, Naga City, Bicol, after having been duly sworn to in accordance with law, do
hereby depose and state:
(1) That on or about 5:00 oclock in the afternoon of August 08, 2014, I was instructed by Police
Chief Inspector RODEL CALUPANG, to verify and confirm the veracity of the reports that
he received concerning one, AQUILES LO, alias Big Boy of Barangay Concepcion Grande,
Naga City, Bicol, having in his possession and custody one (1) M16 Assault Rifle and one (1)
.45 caliber Night Hawk pistol and several rounds of ammunitions of said firearms which he
has brought out and fired several times. According to the reports, loud shots coming from the
Lo Compound are often heard, especially on Fridays, and one CHICO MONTALBO,
witnessed firsthand the subject bringing out and using and firing of the aforementioned
firearms.
(2) That on or about 7:00 oclock in the evening of the same day, together with asset Chico
Montalbo, an employee of the subject, we proceeded to the Lo Compound for said purpose
and arrived thereat ten (10) minutes later. The asset introduced me to the subject as his new
supplier. The subject, a 59 tall muscular man of Chinese-Filipino descent, then brought us to
the loft of the two-storey house where he frequently meets his guests for the weekly mahjong
get-togethers he hosts. Among the guests are other prominent figures in Naga City, some of
whom have been previously implicated alongside the subject in cases regarding illegal import
and export of goods.
(3) That after a few bottles of beer, the subject then proceeded to his chambers where he met with
a couple of his guests in order to discuss business and personal matters. The asset at the time
was assigned to work on a project and relayed that little to no progress has been made on said
project. The subject then got angry with the asset, swearing and threatening him. He then
brought out a silver case which he opened, revealing one (1) M16 Assault Rifle and one (1) .
45 caliber Night Hawk pistol with several rounds of ammunitions of the said firearms. The
subject then lifted the Night Hawk pistol and examined it closely while he warned the asset
that the next time the latter gives him bad news, he will show him what bad news looks like.
With that, he shot the pistol a few meters to the right of the asset, breaking a vase.
(4) That after a few minutes of negotiations between the asset and the subject, we were escorted
outside by the subjects bodyguards.
(5) That we then left the place and reported back to Police Chief RODEL CALUPANG and
confirmed to him that Aquiles Lo of Barangay Concepcion Grande, Naga City, is indeed in

possession of the two (2) unlicensed firearms and ammunitions described above inside his
house at the aforesaid place.
IN TRUTH WHEREFORE, I have hereunto affix my signature this 8 th day of August 2014, in
Naga City, Philippines.
