Legal Implications

In every country, there are business and commerce laws that every
business owner and entrepreneur should be aware of. In the Philippines, there
are also laws and regulations that govern businesses from registration,
operation, up to termination. Malaya Company must observe and abide the
laws, rules and regulations, and policies that are being implemented by the
Philippine Government. Below are things that must be followed and complied
by Malaya Company:

Licenses, permits and regulatory requirements


Malaya Company must operate business with the correct licenses and
permits in order to avoid penalties and surcharges. It should comply all the
documents required by each Government Agencies.

Pay the correct amount of taxes that is due to the Government


Malaya Company must pay the exact amount of tax that is due to
them. There are corresponding additional fees, penalties and surcharges in
case the company cant pay the total amount on time. Malaya Company
needs to abide this regulation in order to avoid suit that will be filed against
them and for them to continue operating the business.

Republic Act 4164 and Presidential Decree No. 1674


Malaya Company must observe just and equitable price for their
products. Act 4164 penalizes hoarding, profiteering and price manipulation of
prime and essential commodities on the occasion of a public calamity due to
natural causes. Presidential Decree 1674 authorizes measures to check price
manipulation and penalizes any person who violates any order issued
pursuant thereto.
Scarcity is but one of many signals available to consumers as an
encouragement to hoard. In addition to retail availability hoarding is
influenced by signals including price, formal and informal communications
interacting with preconditions including consumer experiences and
expectations. Theories of hoarding lead to marketing implications involving
distributions, pricing, advertising and public relations decisions.

under sanitary conditions. It is important that Malaya Company will keep its
business healthy and safe.
Presidential Decree No. 442 or Labor Code of the Philippines
Malaya Company should keep in mind that as a general rule,
contractualization is allowed under section 106 and 107 of the labor code
for non-core functions like janitorial, security as long as it is not a necessary
and desirable function like the production staff. In the Labor Code
contractual employees should be regularized after six months of being
employed may it be continuous or broken contract.
