A Bill to amend the Jammu and Kashmir Employees Provident Funds


(and Miscellaneous Provisions)Act, f 96 1 (hereinafter referred to as the
Principal Act).

Be il enacted by the Jatnmu and Kashmir State 1,egisIature in the

Jarnmu atid Kashmir Employees Provident Funds (and Miscellaneous
Provisions) (Amendment) Act, 201 3.

(2) I t shall come into force from the datc of its publication in the
Ciovernmetlt Gazette.
2. Anzendment qfsecriun 7, Act No. XV of 1961.-In sub-section ( 1 )
of section 7 of the Principal Act, for the words "ten and one third
per cent". the words "forteen per cent" shall be substituted.

STATEMENT OF OBJECTS A N D REASONS

The Jammu and Kashrnir E~itployeesProvident Furlds (and


Miscellaneous Provisions) Act, 1 96 1 applies to every establishment in which
ten or more pcrsons areemployed at any timc. While increasing the thresl~old
limit of nutnher of employees in an establishment for coverage under
the EPF Schettle from 5 to 10, the employers' and the employees' contribution
was also increased from 8.33% to 12% by virtue of the Jammu and Kashrnir
En~ployeesProv idcnt Funds (and Miscellaneous I'rov isions) (Anlcra.lment)
Act, 201 2 (Act No. XVI of 20 121. As a corollary to this change. the
discretion of the employees to increase contribution by a maximrim of
2% over and above the mandatory requirement of 12% also nceds to be
specifically provided by anwilding sub-section (1 ) of section 7 of the act so
as to ensure that if any employee so desired and if the scheme makes
provision therefor, hdshe could increase contribution by a maxin~urnof 2%
so as not to exceed 14%.
The Bill seeks to attain this objective.
