AFFIDAVIT OF ADVERSE CLAIM

I, HDJA. ELENA SAWADI, of legal age, Filipino, single and a


resident of Lot 16 Blk 1, Maharlika Homeowner, Klm 7, Pasonanca,
Zamboanga City, after having been duly sworn to in accordance
with law, depose and state:
1. That on 4 May 2015, I have entered into a Conditional Sale with
Romulo MonLeon De Leon Santiago (hereinafter referred as Mr.
Santiago). I am the VENDEE to the sale and Mr. Satiago is the
VENDOR to the three parcels of land, more particularly described
as follows, to wit:
Lot 1- A parcel of land (Lot 2-B of the subdivision plan, Psd-09002953, being a portion of Lot 2 (LRC) PCS-7699, L.R.C. CAD. REC.
NO. 7880), containing an area of Eighty One (81) Square Meters,
more or less, covered by Transfer Certificate of Title No. T-1292015000406, issued by the Register of deeds of Zamboanga.
Lot 2- A parcel of land (Lot 2-C of the subdivision plan, Psd-09002953, being a portion of Lot 2 (LRC) PCS-7699, L.R.C. CAD. REC.
NO. 7880), containing an area of Eighty One (81) Square Meters,
more or less, covered by Transfer Certificate of Title No. T-1292015000407, issued by the Register of deeds of Zamboanga.
Lot 3- A parcel of land (Lot 2-E of the subdivision plan, Psd-09002953, being a portion of Lot 2 (LRC) PCS-7699, L.R.C. CAD. REC.
NO. 7880), containing an area of Eighty One (81) Square Meters,
more or less, covered by Transfer Certificate of Title No. T-1292015000408, issued by the Register of deeds of Zamboanga.

That I paid the amount of Twenty Five Thousand Pesos


(php25,000.00) as partial payment/earnest money to the sale of the
properties. An acknowledgment receipt was executed by Rhea Amor
R. Falcasantos, the secretary of Atty. Juan Climaco Elago II. Rhea
Amor falcasantos was authorized to receive payments as she is the

Secretarty of Atty. Elago who is the lawyer of Mr. Santiago. A copy


of the Acknowledgment Receipt is hereto attached as ANNEX
A and made an integral part of this Affidavit;
3. That it was agreed upon that full payment of the selling price shall
be delivered to Mr. Santiago only after the occupants shall vacate
the property.
4. That on 15 May 2015, I was surprised to know that Mr. Santiago
returned my money in the amount of Twenty Five Thousand Pesos
(P25,000) and sold the three (3) parcels of land to a third person.
5. That unless an adverse claim is annotated on the aforedescribed
Transfer Certificate of Title, I am in danger of being defrauded and
deprived of my just and valid right over the aforedescribed parcels
of land and, as such, I am executing this Affidavit in support of my
request for the annotation of an adverse claim over the parcels of
land described herein.
