REGULATION ORDINANCE NO. 2013-396
AN ORDINANCE AMENDING ARTICLES 3, 4 AND 7 OF REGULATION
ORDINANCE NO. 2011-307 OTHERWISE KNOWN AS "AN ORDINANCE

REQUIRING ALL BUSINESS AND COMMERCIAL COMPLEXES AND


ESTABLISHMENTS AND OTHER PLACES AND SPACES CONSIDERED
AS HIGH RISK TO INSTALL VIDEO SURVEILLANCE CAMERAS OR
CCTV AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF"

WHEREAS, under Regulation ordinance No. 2011-307, otherwise known as the CCTV
camera ordinance, banks, money changers, pawnshops, credit facilities, financial institutions,
hotels, malls and supermarkets are now required to install CCTV cameras in their premises;

WHEREAS, the primary objective of the aforementioned ordinance 1s to promote


security and safety and/or assist the authorities in solving crimes;
WHEREAS, additional establishments not previously considered as high risk, need to be
brought within the purview of the CCTV Camera ordinance;
WHEREAS, in the course of its implementation, modification of certain provisions of
subject ordinance has become necessary.

NOW, THEREFORE, be it ordained, by the Sangguniang Panlungsod of the City of


Iloilo, that:
Section 1. - The following terms as contained in Article 3 of Regulation Ordinance No.
2011-307 are hereby amended to read as follows:

"Business establishments or commercial complex or common business


area -- refers to any kind of undertaking whether licensed or not, juridical entity
or otherwise doing business within the jurisdiction of Jloilo City.

High Risk Areas - areas where there is a degree of susceptibility to
accidents or criminality because of the numerous financial, social or business
interactions, such as but not limited to:

a. Banks including their satellite offices, branches and automated teller


machines (AIMs), money changers, pawnshops, and other credit,
lending and/or financial institutions;
b. Hotels, malls, supermarkets;
c. Fuel, petrol or gas stations;
Transport terminals
Convenience stores operating 24 hours or which operate during
nighttime;
f Private schools
g. Stores selling liquor including but not limited to disco houses or clubs;
h. Places and spaces where critical assets or properties of the city
government are situated,
i. Other high risk areas subsequently declared as such by the
Sangguniang Panlungsod of Jloi/o City pursuant to Article 7, Section
(h) hereof

Section 2. - Article 4 of Regulation Ordinance No. 2011-307 is hereby amended to read

establishments and places and spaces considered as high risk areas as defined

herein are hereby mandated to install video surveillance cameras and monitors in
the premises of their establishments subject to conditions prescribed herein and
by the l/oilo Cizy CCTV Camera Cauncil created for the purpose.

CCIY surveillance cameras are also hereby required of the City


Government to be installed in identified high risk areas and public spaces or
places of the City for homeland protection, traffic monitoring and crime
prevention and detection, its treasury, storage facilities, and other critical assets
for protection and preservation.
A written notice declaring the presence of a CCIV Camera or cameras in
any business or commercial estab/ishmentls so covered by this Ordinance must be
posted by the owner/._~ in conspicuous place or places within the vicinity of the
establishment. "
Section 4. - Article 7 of Regulation Ordinance No. 2011-307 is hereby amended to read
as follows:
"h) Identify and recommend other high risk establishments to the
Sangguniang Panlungsod ofl/oi/o City. "

Section 5. - This ordinance shall take effect fifteen (15) days after its approval and
publication in the newspaper of local circulation. Provided, that the additional high risk
establishment specified herein are required to comply with the provisions of the CCTV
ordinance upon their application or renewal of their business for the ensuing business year.
