RE: Addendum to Lease Agreement dated March 7, 2011 between Roger & Nancy
Farrell-Lessee and Anthony Aguilar, Owner- Tri-Eagle 48 Ventures LLC.- Lessor for
the single family home/-property located at 220 Oceanview Dr. Vista, Ca. 92084
LEASE PAYMENT ADJUSTMENT/INCREASE: Parties acknowledge that their 3/7/11
lease agreement for the property included a monthly lease payment of $1995 and that
Lessees occupancy of the property has since continued under an automatic month to
month-rental agreement per the terms provided for in the 3/7/11 lease agreement.
Parties also acknowledge that in 2013 Lessor had offered to provide Lessee a temporary
lease payment adjustment of $100 for one year -due to a family/medical hardship
Lessee had been experiencing- however Lessor had chosen to continue this adjustment.
On July 14th, 2016 Lessor/Lessee discussed and agreed that, due to rental market
changes over the past 5 years, a nominal lease payment increase of $150 (.075%) of
the actual lease payment amount will be required and the temporary payment
adjustment would also cease. Parties also agreed that the total new/full rent payment of
$2145 would begin on September 15th, 2016. **Parties also agreed to increased Lessee
responsibilities for upkeep/maintenance of the exterior premises/yard.
Parties also acknowledge that $2500 (deposited by Lessee with the original-March
7th,2011 lease agreement) continues to be held by Lessor as a refundable security
($1800) and pet ($700) deposits against any damages to premises during the rental
extension/term of Lessees occupancy
.
Continuing/additional lease terms and acknowledgments
1) Parties agree that, in addition to all other terms contained in the lease document,
Lessee continues to be generally and primarily responsible for active, preventative
upkeep, and maintenance of the appurtenances and household appliances and of the
premises (**including weeding of side/back yards, trimming/watering shrubs directly
below patio areas, and sweeping/keeping leaves cleared from front driveway drain, etc.).
2) Parties agree that all appliances, including washer/dryer, refrigerator and all other
kitchen appliances, continue to be in good operating condition. Lessee shall continue to
be responsible for the costs of maintenance/repair and/or replacement of appliances
should they become inoperable or damaged during their tenancy except for any needed
repairs the central heating unit and water heater (not due to Lessee misuse or neglect)
which will be paid or reimbursed by Lessor.
3) Parties agree that Lessee continues to keep the wood floors in the premises in good
condition and that the required special/regular care is being consistently provided to
maintain and prevent damage of the wood floor surfaces. Lessee continues to insure
that their dogs nails are kept cut/rounded and will also use/keep carpet runners in high
traffic areas and under furniture.
