It is Mandatory not Optional !!! With the changing times, women have come to the workplace in
large numbers. This has led to situations where harassment of women at workplace is increasing.
The Parliament has enacted The Sexual Harassment of Women at Workplace (Prevention,
Prohibition & Redressal) Act, 2013, which is in force.
The constitution of the Internal Complaints Committee (ICC) is mandatory wherever women are
employed. In case of harassment of women at workplace, the harassed women employees would
straightway approach the ICC. The ICC is required to hold an enquiry into the complaint. What is the
scope of such an enquiry, what are the principles of natural justice to be complied with in such cases,
how it is dierent from domestic enquiry on misconducts arising out of Standing Orders other than
harassment of women at workplace are all issues which have to be deliberated at length.
To understand and appreciate the requirements of law in this behalf, NIPM has organized a One-Day
Workshop on the two inter-related subjects. The workshop would be very useful for members of the
Internal Complaints Committee of various establishments, the HR and IR personnel who are
required to monitor these committees, and also the Senior Management Executives of
organizations. The Senior Management Executives have a very important role to play and a huge
responsibility and liability is cast directly on them. With the electronic media going strong, the
publicity given to the instances of sexual harassment of women and to those at the helm of aairs in
those organizations is very huge and could aect the reputation of even Senior Management
Executives and Directors of the Company, apart from the reputation of the organization. Therefore,
the Senior Management Executives would have to fully appreciate and understand the scope of this
legal requirement.
Impact of sexual harassment/sexual abuse : Sexual harassment results in violation of the
fundamental rights of a woman to equality under Articles 14 and 15 of the Constitution of India and
her right to life and to live with dignity under Article 21 of the Constitution and right to practice any
profession or to carry on any occupation, trade or any business which includes a right to a safe
working environment free from sexual harassment.
Protection against sexual harassment and the right to work with dignity are universally recognized
human rights by international conventions. The topic besides being sensitive, is also becoming
critical for organizations/institutions requiring far more focused attention, seriousness in
reinforcing checks and balances (preventive as well as remedial). Further, instances of this nature
attract instant attention of the media Electronic and print. Reported incidents have unhealthy
consequences on the organizations/institutions and on the aggrieved individual/s and the society at
large.
One of the o-shoots is the disrepute that gets associated with the otherwise healthy
traditions/values that the organizations/institutions would have nurtured over a period of time.
More serious impact will be on the aected individual/s. To address these concerns, The Sexual
Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 was enacted
in December, 2013, which has now gained momentum in terms of implementation.

educate the members and provide them with the skill sets to handle conicts/incidents of Sexual
Harassment.

Sri S. N. Murthy is a Senior Advocate and Management Consultant based at Bangalore. He is a Post
Graduate in Industrial Law and practicing for the past 43 years in the area of Industrial Law, in Labour
Courts, Industrial Tribunals, Karnataka High Court and Supreme Court of India. He is an Advisor to several
Corporate & Business Organizations.
Sri S. N. Gopinath, Past Chairman of NIPM KC, a Fellow of NIPM & IR/HR Consultant, is a Post Graduate in
Social Work from Roshni Nilaya, has blend of 40 years of experience in Industry and Consultancy, has
conducted about 1,000 Domestic Enquiries in reputed Organizations throughout Karnataka.
Smt. V. K. Jyothi, Associate Vice President and Head Legal, Aditya Birla Fashion and Retail Limited,
Bengaluru, has experience of over two decades in litigation, real estate and retail business. In her current
role, she is handling legal issues concerning conicts relating to sexual harassment of women at
workplace, real estate, intellectual property rights, legal compliance for factories, warehouses and
oces, commercial contracts, intellectual property rights and litigation etc
Smt. Shachi Idre, is the Executive Director of Catalyst India WRC, a leading not-for-prot organization
with a mission to expand opportunities for women and business. Prior to joining Catalyst, she served as
the Head of Diversity at Infosys, where she helped develop and manage the organization's D&I initiatives
including the rst leadership development program for women and D&I Councils. She also played an
integral role in launching the organization's ground-breaking employee resource group (ERG) for Indiabased LGBT employees. In addition, she conceptualized and delivered successful employee engagement
programs focusing on communication, health and safety.
Smt. S. G. Karuna, a practicing Advocate, B.A., LL.B., with a Post Graduate Diploma in Intellectual
Property Rights Law from National Law School of India University (NLSIU). She has expertise in
Corporate Law, mergers, acquisitions, joint ventures, intellectual property sharing/transfer, trademark
and copyright, conducting due diligence etc. She is also on the ICC of reputed Organizations as an
External Representative, conducting Awareness Programmes and enquiries, drafting Policies pertaining
to POSH and advising many reputed Organizations.

About the NIPM & Karnataka Chapter : National Institute of Personnel Management (NIPM) is the only
all India body of professional managers engaged in the profession of Personnel Management, Industrial
Relations, Labour Welfare, Training and HRD in the country. NIPM came into existence in March 1980 as a
result of merger of two professional institutions, namely the Indian Institute of Personnel Management
(IIPM), established in 1948 and the National Institute of Labor Management (NILM) established in 1950.
