The Decision of Criminal Action Reference

Particularism.
(A Comparative Analysis Study)

Abstract : The decision of criminal

action reference is one of the two
faces of disposal in preliminary
investigation, beside the decision of
keeping the criminal action.
This study was carried out with the
title "The Decision of Criminal
Action Reference Particularism", to
clarify the reality of that decision, if
it has the judicial value, also
objective and formal elements for
judicial work In addition, the study
had the reference of escaped accused
person from justice, according to the
procedure penal law no -3- year
2001, and to which limit it's
considered as a decision of
reference.
Also, the study shed the light on the
legal nature of the indictment. Is the
indictment itself considered a
reference decision or it differs from
criminal action reference.
Through this study, we focus on
some texts of Palestinian procedure
