I.

EXECUTIVE SUMMARY
This paper examines whether Ordinance No 411 which is enacting the revised
traffic code of Santa Maria Bulacan are compatible and applicable in solving the problem
being address. The research was based in quantitative and qualitative data on the aspects
and perspectives of knowledge, implementation, effectiveness and recommendation. The
authors had concluded that the policy/ordinance should be change and adjust to properly
solve the problem. We have suggested amending Ordinance no 411 to change the day and
time of the truck and delivery van ban policy and create a safety standards and inspection
regulation. By this we mean to adopt a policy that will be both comfortable and beneficial
to both parties whether you are the affected group or beneficiaries.

II.

INTRODUCTION
Today one of the most common and biggest problems in our country is how to
solve and deal with traffic congestion, which has gradually became a tradition and
custom in our modern society. Traffic congestion is not essentially a problem as a matter
of fact it is the consequence and result of using vehicles as a primary transportation and
the solution to our basic mobility needs. The modern economy and society in our country
requires the people to go to work, school and run errands about the same time so that they
can interact with each other which is why too many people wants to move from one place
to another. Traffic congestion can be defined as a condition on road networks that occurs
when the use of vehicles has become more excessive or out of control and it can be
characterized by a slower movement of vehicles while travelling, longer trip times and
increase vehicular queuing.
Traffic congestion has become a major government concern because of the fact
that it is an inescapable condition in growing metropolitan areas and developing
communities as a matter of fact it is a sign in the economic growth of the country and the
rapid population increased in terms of more people means more vehicles. Finding ways to
solve it poses daunting challenges which has puzzled us over the pass years in terms of
the government laws, policies and remedies are not able to address the problem
effectively and efficiently and those did not achieve their intended objectives and results.
Traffic congestion also comes with consequences and effects that can be harmful for the
people and the country. The most common examples of its effects are the following: the
increase travel time resulting in the inconvenience of the people, destruction of roads and
bridges, accidental fatalities has dramatically increased over the past years, negatively

affects the productivity of the people and the gases being released by the vehicles is
dangerous and harmful to our environment especially the ozone layer in the atmosphere.
Santa Maria is one of the areas here in Bulacan that is beginning to have a name
for itself it is renowned and famous for its chicharon products and unique festivals. This
area has been growing and developing in the past years as a result of that many problems
are arising from the growth and development one of them is traffic congestion. This
problem is very common to all developing and growing areas like Santa Maria as a
matter of fact this problem can be associated with the modernization of our country,
economic growth of the area and the rapid increase of the population. Today the
municipal government of Santa Maria is taking this problem seriously because they
known that using vehicles is essential to our economy and daily needs.
The solution of the municipal government of Santa Maria in the traffic congestion
problem was ordinance No. 441 which is enacting the revised traffic and transportation
code of Santa Maria and amending Ordinance No. 358. The new ordinance is
implementing and enforcing the banning of trucks and delivery vans except in Sunday
from 6:00 am to 9:00 am and 4:00 pm to 6:00 pm vice versa. Exempted from this
provision are government vehicles which participating in relief or emergency operations
and bringing perishable goods. The Ordinance has a penalty and fine to those who will
not followed and violate the law.

III.

ASSEMBLE EVIDENCE

The traffic mess in the Poblacion and adjoining barangays, caused by the
undisciplined drivers, uncooperative pedestrians, limited traffic personnel and unplanned
traffic engineering is not unique of this town but symptomatic of an urbanizing center.
Local officialdom and the Sangguniang Bayan, however, are not helpless in mitigating
this chaos. Options are available. The present administration is mandated to keep the
roads clean and orderly, return to the pedestrians the sidewalks and enforce traffic rules
and regulations with due recognition of genuine efforts and granting of incentives.
Efficient and effective traffic management is anchored on the 3-Es, Education,
Enforcement and engineering. It is, therefore, the policy of the municipal government to
pursue relentlessly these three elements for a livable community and make the roads as
arteries of commerce and prosperity for a grateful citizenry.

There shall be created a Santa Maria Traffic Management Unit under the direct
supervision and control of the Mayor. The Traffic Management Unit is solely vested with
the power to enforce and implement this Ordinance and such traffic management plans
and programs that may hereafter be drawn or prepared.
The SMTMU shall be composed of the following:

as designated by the Mayor

Sangguniang Bayan Chairman, Committee on Peace and Order and Public Safety
Sangguniang Bayan Chairman, Committee on Public Works and Public Utilities

The vice mayor of Santa Maria Bulacan which is Hon. Rico Jude Sto. Domingo
has presented a new revised traffic and transportation code of Santa Maria in the form of
Ordinance No. 441 which is amending the Ordinance No. 358. The new ordinance has
amended to change:
Section 1. Section 3, Definition of Terms is hereby amended to add No. 31 to read
as follows:
31) Trucks and Delivery Vans- cargo trucks or other delivery vehicles
particularly intended for carrying cargo, whether loaded or empty, having a gross
capacity weight of more than 4000 kilos.
Section 2. Section 49. Truck Ban, Chapter 4 is hereby amended to add a third
paragraph to read as follows:
Trucks and Delivery Vans are not allowed in the entire stretch of Santa Maria ByPass Road from Bagbaguin to Santa Maria-Norzagaray Road (Barangay Guyong) and the
entire stretch of Gov. F. F. Halili Avenue from Bagbaguin up to Paso Intersection every
day except Sunday from 6:00 a.m. to 9:00 a.m. and 4:00 p.m. to 6:00 p.m. and vice versa.
Exempted from this provision are government trucks, those participating in relief or
emergency operations and those bringing perishable goods.
Section 3. Repealing Clause. All existing ordinance, rules and regulations or parts
thereof in conflict or inconsistent with any provisions of this Ordinance are hereby
repealed or modified.
Section 4. Reparability Clause. Should any part of this Ordinance be declared
null and void by a Court of competent jurisdiction, the remaining parts not so affected
thereby shall remain in full force and effect.

CONSTRUCT ALTERNATIVE POLICY RESPONSES


Alternative Route
The most realistic option would be is to give the truck and delivery van drivers an
alternative route like in the areas of San Jose Del Monte and Bustos Bulacan. This will
give the area of Santa Maria Bulacan a less population of trucks and delivery vans that
will going and passing through the same route. This solution is great but it can also give
disadvantages to those areas with an alternative route because as the trucks and delivery
vans starts to take the alternative routes they will become another areas problem for
example they will begin to cause traffic in that particular route. Another problem may
arise from this is what if those other areas decided to impose and implement a ban of
those vehicle or what if they already has a policy that bans those vehicles in the area
within their jurisdiction then those routes are not available for the solution.
The most comprehensive step would be is to make a plan and coordinate with
other municipal government in which the alternative route are within the area of their
jurisdiction. They should discuss and devise a strategy on how to control the truck and
delivery vans in terms of what time those vehicles should be allowed on their area. This
will allowed all the municipalities to split and lessen the trucks and delivery vans that
will be going to their area of jurisdiction making traffic congestion less.
Bus Control Policy
Another possible solution to traffic congestion in Santa Maria Bulacan is to create
a mandatory policy that will be able to control all the buses that will be going and inside
the municipal area because we observed that there is not currently any terminal for buses
and there is no policy regulation that will limit the loading and unloading of the buses.

We all known that the municipal Government cannot ban the buses because it is a public
transportation but there is no rule that prevents them to initiate control over it.
The best policy would be is to create and construct bus terminals in the designated
areas where most likely the routes of buses. Additional to that the municipal government
should also apply the regulatory policy of Metro Manila stating that a 30 seconds limit
for the loading and unloading of people along the entire stretch of Santa Maria Bulacan.
Finally they should impose and strictly implement a fine or penalty to discourage all of
the possible violators for not obeying and following the law.
This should give the municipality of Santa Maria the systematic and organized
bus policy control that will be beneficial for the people and the area itself.
A Systematic Truck and Delivery Van Ban Policy
One of probably the best options is to categories and schedule all the trucks and
delivery vans that will be allowed to enter in Santa Maria Bulacan. This policy will be
stating that the trucks and delivery vans would be allowed to enter in the municipality
area in the day of Monday, Wednesday and Friday from the time of 12:00 am to 3:00 am
vice versa. This will include that the truck and delivery van companies and owners shall
be schedule and categories on who shall be allowed to enter the area in that day and time.
A ticket and coupon shall be given to be the pass to enter and it will serve as the proof
that they are the trucks and delivery vans that will be allowed to enter in that day and
time. In addition to that the municipal government should also limit the trucks that will be
allowed to enter for example 20 trucks and delivery vans shall be allowed to enter on
Monday.

This policy should improve the organization and management of trucks and
delivery vans in the municipal area. They can also expect and plan ahead on the number
of trucks and delivery vans that will be going and passing through the area. The most
important of all they can monitor and check the possible problem that may arise in the
middle of the traffic because they can ensure the full control on those vehicles.

V.

LIST SPECIFIC CRITERIA USED IN MAKING EVALUATION


The researchers used quantitative and qualitative data in the form of surveys and
interviews. We have selected three areas that will be used as our subject those are Santa
Maria Norzagaray Road (Barangay Guyong) which has a population of 15,506 and
3,280 households, Paso Intersection and Gov. F.F Halili. In order to determine the true

number of respondents we have used the Solvins formula n= (z) pq /

The z is representing the desired number of confidence which is normally 0.95


(95%) while p is representing the target percent of the population which is 0.20 (20%). To
get the q we have subtracted 100% from 20% and e is the margin of error which is
commonly 0.05.

We have selected 60 persons per area to be our respondents equally to 180. The
researchers have spent a whole two days to cover the three specified areas.
We have interviewed one of the barangay councilor in Guyong in which he
explains to us the effect of the ordinance to the traffic. According to him the truck and
delivery van drivers are taking the alternative route of the By-Pass road instead of going
to the poblacion. He have observed that the policy is being followed properly but the
traffic on the By-Pass road has not been solved in terms of there is traffic in the
intersection before and after passing through the alternative route.
We also interviewed an assistant driver of trucks; he said that the policy is not fair
and equal to them because Sunday is the day that their clients and customers are close
and out of business. As a result they will not to follow the ordinance in terms of when
passing through the area they tend to give suhol to the personnel in charge of that area
because if they turn back it will cause a more problematic traffic.

Conclusion:
According on the evidence that we have gathered in our research there is a higher
percentage of people who has some kind of specific knowledge and insight about the
Ordinance No. 411. The municipal Government has done a good job on making the people
comprehend and understand what is being stated and implemented by the policy. Therefore,
we have concluded that the information is being distributed properly.

Conclusion:
Based on the evidence that we have gathered a higher percentage of the people have
observed and seen that there is not enough personnel to implement the policy it has no
significant effect on the problem and there is not enough personnel to implement the policy
properly. Therefore we have concluded that the Municipal Government should adopt a policy
change and construct a systematic way of deploying there limited personnels.

Conclusion:
Based on the data we have gathered the municipal government is not putting the
require input to produce the noticeable and significant outputs what worst is that there is
some inequality in the affected and beneficial groups. Therefore we have concluded that they
should change what is being stated in the policy to benefit both groups and to produce
noticeable or significant result.

IV. RECOMMENDATION

Conclusion:
According to the evidence that we have gathered there is a higher percentage of
people that believe that the policy is correct in banning trucks and delivery vans as a result
they will agree to imposed a permanent size and weight or to make the penalty higher.
Therefore, we have concluded to add additional provisions and create other policies that will
control other vehicles that might cause traffic beside trucks and delivery vans

VII.

RECOMMENDATION
A New Ordinance That Will Amend Ordinance No. 411
Ordinance No. 411 is hereby amended to add a new paragraph, change the
truck and delivery van ban policy and impose a higher fine or penalty to read as
follows:
The Municipal Government of Santa Maria Bulacan shall impose and
implement a permanent weight and size limitation in all the trucks and delivery vans,
whether loaded or empty that will be going to Santa Maria. In addition to that they
will create a safety regulation and mandatory inspection policy for all the trucks and
delivery vans that will enter the municipal area. The trucks and delivery vans are now
allowed in the entire stretch of Santa Maria everyday from 12:00 am to 3:00 am vice
versa. Any person that will be caught for not following and violating the law shall pay
the higher penalty of fine or penalty of P500.00. Exempted from these provisions are
the government trucks that will be participating in the relief or emergency operations
and those bringing perishable goods.
This option was probably the best answer to the problem that is being
addressed by the policy. The added provision and policy change was base on fairness
and equality to the beneficiaries and affected people. The new rules and policies that
will be added in the original ordinance can give advantages and benefits to both
parties. Most important of all the people of Santa Maria agrees to the stated new
policies and rules that will be implemented and imposed by the new Ordinance.

The criteria we use to develop this policy option was based on fairness and
equality for the people, the availability of resources, personnel and the public opinion.
Ordinance No. 411 is not fair and equal in the delivery van and truck drivers because
some of their clients and customers for delivery are close on Sunday which means
that going to Santa Maria is pointless. According to some of our respondents another
problem comes when the trucks and delivery vans malfunction in the middle of the
road for example if their cargo spills in the road then it will cause a longer traffic
problem so they will agree for the safety regulation and condition inspection on both
vehicles. They also agree to discourage the violators of this policy by imposing a
higher penalty or fine.
