SCHEDULES

THE SIAYA COUNTY FINANCE BILL, 2016 A BILL FOR

An Act of the Siaya County Assembly to provide for revenue raising measures,
imposition of fees and charges for the County Government of Siaya; and for matters
incidental thereto.
ENACTED by the County Assembly of Siaya as follows:PART I- PRELIMINARY
1. This Act may be cited as the Siaya County Finance Act, 2016 and
Short Title and
shall come into operation on such date as the County Executive
Commencement
Member responsible for Finance, with the concurrence of the
Governor, may appoint and different dates may be appointed for
different provisions.
2. This Act seeks to prescribe the rates of taxes and charges for the Definitions
assessment year 2016-17, the rates at which taxes and other charges
will be payable during the financial year 2016-2017 from properties
which include land and buildings, businesses, markets, agricultural
produce, outdoor advertisement, health services, vehicle parking,
heritage sites, County parks, entertainment and extraction activities.
In this Act, unless the context otherwise requires 3. The revenue raising measures of the county government relating to
property rates are set out in First Schedule.
4. The revenue raising measures in the county government relating to
trade licenses are set out in Second Schedule.

1. The revenue raising measures in the County government relating
to fees and charges for services are set out in the Third Schedule.
2. This section does not apply to fees payable under the Siaya
County Trade License Act, 2015.
6. The revenue raising measures of the County Government provided
for in this Act do not in any way prejudice National Economic
Policies, economic activities across county boundaries or the
National mobility of goods, services, capital or labour.
7. If any National Act mentioned in Schedule 3 has not been amended
to provide for the imposition of fees or charges for services by the
county government, then item 7 of the Sixth schedule of the
Constitution, applies in relation to that Act.

8. To avoid doubt, nothing in this Act is taken to prevent the county


government from entering into a contract or agreement or other
arrangement to provide a service upon payment of a fee or charge.
PART II RATES APPLICABLE, TAXES, FEES AND CHARGES PAYABLE
9.

Charges
1. The Rates, Taxes, Fees and Charges set out in the NewCharges
column of the schedule shall apply for the respective items listed
in the Item Descriptioncolumn at the rate set out therein.
2. For greater certainty, the rates, taxes, fees and charges applicable
are payable to the County Government of Siaya at the
commencement of this Act, but which are not included in the
schedule to this Act, shall continue to apply under the existing
by-laws of the defunct Siaya Municipal Council, Siaya County
Council, Bondo Town Council, Yala Town Council, Ugunja
Town Council and Ukwala Town Council until such by-laws are
specifically repealed or replaced by County Government of Siaya
Legislation.

Licenses / permit

10.

1. All directions, resolutions, orders, authorizations and provisions And Permit Fees.
that are contained in the Siaya County Revenue Administration
Act, 2014 ,Siaya County Rating Act, 2014, Siaya County Trade
Licence Act, 2014 and Public Financial Management Act, 2012
and other related laws and subsidiary legislations that are
concerned with the revenue administration in the county shall be
deemed to be part of this Act.
2. Subsection (1) does not apply to the specific respective amounts
payable in respect of the rates, taxes, fees, charges or other levies
and, in that regard, the amount provided shall be applicable as
provided for in the New Charges columns in the Schedule.
3. All directions, resolutions, orders, authorizations and provisions
that are contained in County Revenue Administration Act 2014,
County Rating Act 2014, County Trade License Act 2014, Single
Business Permits Regulations, Public Financial Management Act
2012 and other related laws and subsidiary legislations that are
concerned with revenue administration in the county shall be
deemed to be part of this Bill.
General Fees

11.
1. A person shall not carry out any business or service within the
County without a valid license or permit issued by the relevant
County Office.
2. A person who intends to carry out any of the businesses listed in

the or under the schedule or the single business permit regulation


shall apply for a licence or permit from any of the County offices
or such other designated agents as shall be prescribed by the
County Government from time to time.
3. A person who applies for licence under subsection (2) shall be
issued with a licence on the payment of the applicable fee,
depending on the location and size of the business as specified in
the schedule or the single business permit regulation.
4. Licences and permits issued under subsection (3) must be visibly
displayed at the business premise at all times.
5. A person who contravenes any of the provisions of this section
commits an offence.
12.

Plot and House


1. A person occupying any plot, stall or house leased or rented out Rent
by the County Government shall pay rent or rates, whichever is
applicable, at the rate specified in the Schedule.
2. A penalty of three percent per month shall be charged for any
amount of rent or rates for a plot that remains unpaid for after the
31st day of March, 2014.
3. A person who contravenes the provisions of subsection (1) may
be evicted and shall be evicted if he or she fails to pay house rent
for three consecutive months.
4. The County Government shall repossess the house if a person
fails to pay the rent for more than one year.
Cess and Market

13.

1. A cess or market fee shall be charged on the goods specified in Fees.


the Schedule.
2. A person who fails or hinders other person to pay the cess or
market fee set under schedule commits an offence.
14.

General
1. All persons operating single business permits shall be required
to pay the relevant licences, fees and charges or licences set
under Schedule 2 and the single business permit.
2. Any person operating a business who fails to pay the said fees,
charges or licences set under Schedule 2 and the single
business permit regulations commits an offence.

15.

Tax Waivers and


1. The County Executive Committee Member for Finance may Variations
by order published in the gazette amend any additional fees,
tax, licence, cess and fees schedules to supplement the
current schedule.

2. Any order made under subsection (1) shall be laid before the
County Assembly without unreasonable delay, and unless a
resolution approving the order is passed by the County
Assembly within twenty one days when the Assembly next
sits after the order is so laid, the order shall lapse, but
without prejudice to anything previously done there under.
PART III - PAYMENT
16.

Payments to the
1. All payments to the County Government

made under this Act shall be paid through
an authorized channel.
2. A County Revenue Collector authorized by the County
Government to collect revenue shall have an identification card
issued by the County Government which shall be worn visibly
by such County Revenue Collector.
3. An official receipt shall be issued for all payments made to the
County Government.
4. Every person who makes a payment through an authorized
channel shall demand an official receipt for each such payment
and every payment made through an authorized channel shall be
evidenced by an official receipt.
5. A person shall not receive or collect any money on behalf of the
County Government unless he or she has been appointed to do
so or has authority as the receiver and collector of County
Government Revenue.
6. A person who contravenes the provisions of this section
commits an offence,

Appointment and

1. The County Executive Committee Member may by written notice Duties of an

Government for the purposes of the collection or recovery
of charges, permit fees, licence fees, rent, cess and such
other fees as may be necessary for carrying out the purpose
of this Act; and
b) Specify the amount of charges, permit fees, licence fees,
rent, cess and such other fees to be collected or recovered
by the agent.
2. An agent appointed under this section shall enforce and ensure
due compliance with the provisions of this Act and shall remit all
revenue collected to the County Government through the County
Receiver of Revenue or as may be otherwise instructed in the
appointment notice.

3. Where an agent claims to be, or to have become unable to comply


with subsection (2), such shall, within seven working days, notify
the County Executive Committee Member in writing, setting out
fully the reasons for his inability to comply, and the County
Executive Committee Member shall accept the notification and
cancel or amend the appointment notice accordingly.
4. Unless and until a notification is given by an agent under
subsection (3), sufficient moneys for the payment of charges,
permit fees, licence fees, rent, cess and such other fees specified
in the agents appointment notice shall be presumed to be held by
him or her and this money shall be and payable to the County
Government.
5. For the purposes of this section, the County Executive Committee
Member may, by notice in writing, at any time, require any person
to furnish him or her, within reasonable time not being less than
seven days from the date of service of the notice, with information
showing any moneys which may be held by the agent for, or due
by him to the County Government.
6. Where an agent fails to pay an amount of money collected under
this section within the time specified in the notice, the provisions
of this Act relating to the collection and recovery of that amount
as if it were tax due and payable by the agent, the due date for the
payment of which was the date upon which that amount should
have been paid to the County Government under this subsection.
7. An agent who makes payment to the County Government under
this section shall for all purposes be deemed to have acted under
the authority of the County Government and shall be indemnified
in respect of that payment against all proceedings, civil or
criminal, and all processes, judicial or extra judicial,
notwithstanding any provisions to the contrary in any written law
contract or agreement.
8. Any person who willfully makes any false or misleading
statement, or willfully conceals any material fact shall be guilty of
an offence.
PART IV OFFENCES AND PENALTIES
18. Any person who commits an offence under this Act for which no General
penalty is provided shall be liable, on conviction, to a fine not exceeding Penalty
two hundred thousand Kenya shillings or to imprisonment for a term not
exceeding one year or both.

19. A member of staff of the County government or any other person Offences by
having a duty to perform under this Act who

by that person, an entry which he or she knows or has reasonable
cause to believe not to be true or to be false;
(b) willfully refuses to do anything which he or she knows or has
reasonable cause to believe not to be true or to be false;
(c) interferes with any other person or process under this Act, so as
to defeat the provisions, requirements or purposes of this Act;
(d) Where required under this Act to do anything to give effect to the
provisions of this Act, fails to do such thing;
(e) Without reasonable cause omits to do something in breach of his
or her duty under this Act;
(f) Willfully contravenes the provisions of this Act to give undue
advantage or favour to another person;
(g) Fails to prevent or report to the County Government or any other
relevant authority, the commission of an offence committed
under this Act;
Commits an offence and is liable on conviction, to a fine not exceeding
two hundred thousand Kenya shillings or to imprisonment for a term
not exceeding one year or both.
PART V MISCELLANEOUS
Savings

20.
1. Any charges, permit fees, licence fees, rent, cess and such other
fees payable to the County Government at the commencement of
this Act by any business operating within the county which are
not included in any of the Schedules to this Act, shall continue to
be chargeable by, and payable to the County Government unless
they are repealed by an Act of the County Government or until an
Act of the County Government on such charges, permit fees,
licence fees, rent cess and such other fees is enacted.
2. All business within the jurisdiction of the County shall be
required to pay licences, charges, fees, cess, rent or other
prescribed fees unless specifically exempted by any relevant
legislation or authority.
3. All levies, charges, tax, cess and licences that were payable under
the repealed Local Government Act shall continue to be paid and
administered under this Act: provided that this sub-section also
apply to such fees and charges levied by various ministries and
departments of the national government in respect of function
devolved to the county governments under part 2 of the Fourth
Schedule of the Constitution of Kenya which fees and charges
shall be levied by the County Government on transfer of the
devolved functions.

4. All references to Councils shall include all Local Authorities as


were defined under the now repealed Local Government Act,
Cap.265 of the laws of Kenya.
21. Unless otherwise provided in this Act, the rates for fees, charges, Cessation
licences, cess or rent, applicable before the commencement of this Act in
respect of any business, activity, goods or services listed in the
schedules, shall cease to apply.
22. The County Executive Committee Member may make regulations for Regulations

SCHEDULE 1 PROPERTY RATES


ITEM 1 AMOUNT OF RATES
For the purposes of Section 6 of the Siaya County Rating Act, 2014, the amount of a rate payable
to the county government in respect of a ratable property for 2016/2017 is 10% of the
unimproved value of the ratable property.
ITEM 2 WAIVER
For the purposes of Section 11 of the Siaya County Rating Act, 2014, a waiver of 2% is payable
on any rate on or before the due date.
ITEM 3 INTEREST
For the purposes of Section 12 of the Siaya County Rating Act, 2014, interest at the rate of 3%
per month is payable to the county government on any rate that remains unpaid after 31st March.

THE SIAYA COUNTY FINANCE BILL, 2016

MEMORANDUM OF OBJECTS AND REASONS


This bill seeks to harmonise the charges for the various taxes, fees and other charges that are
payable to the Siaya County Government. These are set out in the Schedule. The schedule to the
Act sets out the rates in Kenya Shillings (Kshs.), the currently Payable taxes under the defunct
municipal councils, town councils and county councils and the proposed rates under this Act.

The charges are taken into account basing on the principles of taxation and fundamental concepts
that have been considered to ensure the county Government implements a fair taxation system in
the county. These include the need to address the sufficiency of the amount of taxes that can be
used in providing basic services to the People of Siaya County while ensuring that the taxation
regime is fair and equitable and covers all sectors of the society in order to reduce its
concentration in only one sector of the Society.
