3.0 Opening of Meeting
The Chairman (Mr. Humphrey Shonga (TBS) opened the
meeting at 12:30 noon. He welcomed each participant from
both parties.

He then welcomed each participant to introduce themselves

He welcomed Mr Makandege (leading counsel for RSA) to

give a brief background of RSA limited (RSA) and Hanspaul
Automech Limited (HAL) saga.

4.0 Deliberations

The meeting noted that RSA was incorporated in 1996 and

since then has been engaging in making of tourist bodies
used in Safari vehicles.

Such bodies are mounted on Toyota Land Cruiser Pickups.

The meeting also took notice that RSA is the sole registered
Patent holder with Brela in Tanzania and African Regional
Intellectual Property Organisation (ARIPO) for its industrial
designs used to make safari vehicles (RSA Models).

Further to above the meeting noted that RSA has undergone

certification with TBS and bears TBS license no. 0514 for
microbus body, issued since 18th September, 2004 and is
renewable

The meeting noted that HAL was registered in 2007 and

since then has been in the business of copying RSA
drawings and reproducing same models as produced by RSA
without approval or under license for RSA or any approval,
license from the government.

It was further noted that HAL has been in such business

without the required approvals, permits, industrial license
and TBS certification.

RSA

inquired from TBS whether HAL has undergone

certification and whether they have been issued with TBS

license to use mark of TBS, the chairman answered that HAL
has never been issued license to use the mark of TBS for its
products.

RSA requested to be issued with official written response in

respect of the same and TBS undertook to respond officially
in writing.

5.0 The way forward

It was resolved that both parties will take necessary actions

and remedial measures to curb the situation between RSA,
TBS and HAL as soon as possible.
