Dear Mr. Heru Sriwidodo Sari,

On 30 June 2016, we received a letter from PLN. It stated that the First Year Inspection (FYI)
shall be adjusted as fallows:

According to Clause 4.3A.6.9 of Section 4.3.A General Technical Requirement in Contract

Book II, it stipulated that "At the end of warranty period for each item or equipment, the
Contractor shall perform full inspection of the equipment as a condition for the Owner
issuance of the final acceptance certificate".
Meanwhile, according to Clause 2.1.52 of Part 2 General Conditions of Contract in Contract
Book I :"'Warranty Period' means twelve (12) consecutive calendar months starting from
TOC date". That is to say, the FYI shall commence on 14 July 2016 for Unit 2# and 20
August 2016 for Unit 1#. Base on this condition, herein we would like to reply you as

follows:
1. After the warranty period is over, shall not have any defect liability under the Contract
signed by PLN and us.
2.

Due to the delay of FYI, herein we would like to require PLN to issue the FAC for both
Units after the warranty period is over.

During the warranty period, GPEC supplies the consumable material, such as chemical
goods, grease, gaskets, etc. After the warranty

period is over, it is beyond our

responsibility. PLN shall purchasing the consumable material by himself..

If case that any defect of the power plant occurs after warranty period is over, GPEC
shall not have any liability repairing the said defect.

6.

After the warranty period is over, the power plant shall run till the FYI, therefore, our
personnel, tools, material, equipment, and other facilities can not demobilize completely
until FYI is completed. Which increases our cost. PLN shall compensate us for the
additional cost.

7.

Please arrange a meeting to discuss the compensation

due to the delay of FYI ,

meanwhile, the remaining claim issued shall also be discussed in this meeting.
