SPANISH CONSTITUTION

Don Juan Carlos I, King of Spain, to all who see and hear,
known: That the Parliament has passed and the Spanish people ratify the following
Constitution:

PREAMBLE
The Spanish Nation, desiring to establish justice, freedom and security and
promote the good of all its members, in exercise of its sovereignty, proclaims its will to:
Guarantee democratic coexistence within the Constitution and laws
according to a just economic and social order.
Consolidate a State of Law which ensures the rule of law as an expression
of the popular will.
Protect all Spaniards and peoples of Spain in the exercise of rights
humans, their cultures and traditions, languages and institutions.
Promote the progress of culture and the economy to ensure a dignified
quality of life.
Establish an advanced democratic society, and
Collaborate in the strengthening of peaceful relations and effective cooperation
among all peoples of the Earth.
Consequently, the Cortes pass and the Spanish people ratify the following

CONSTITUTION
PRELIMINARY TITLE
Article 1
1. Spain becomes a social and democratic state of law,
advocates freedom justice highest values of its legal system, the
equality and political pluralism.
2. National sovereignty resides in the Spanish people, from whom emanate the powers

State.
3. The political form of the Spanish State is a parliamentary monarchy.
Article 2
The Constitution is based on the indissoluble unity of the Spanish Nation,
common and indivisible part of all Spaniards, and recognizes and guarantees the right to homeland
autonomy of the nationalities and regions which comprise and solidarity among all
they.
Article 3
1. Castilian Spanish is the official state language. All Spaniards have
the duty to know and the right to use it.
2. The other Spanish languages shall also be official in the respective
Autonomous Communities in accordance with its Statutes.
3. The richness of the different linguistic modalities of Spain is a heritage
culture that will receive special respect and protection.
Article 4
1. The flag of Spain consists of three horizontal stripes: red, yellow and
red, the yellow of double width that each of the red.
2. The Statutes may recognize flags and ensigns of the Communities own
Autonomous. These will be used together with the flag of Spain on their public buildings and in
their official acts.
Article 5
The state capital is the city of Madrid.
Article 6
Political parties express political pluralism, they contribute to the formation and
manifestation of the popular will and are a fundamental instrument for participation
politics. Their creation and the exercise of their activities are free in respect for
Constitution and the law. Their internal structure and operation must be democratic.
Article 7
Labor unions and business associations contribute to the

defense and promotion of economic and social interests which they represent. his
creation and exercise of their activities are free while respecting the Constitution and the
law. Their internal structure and operation must be democratic.
Article 8
1. The Armed Forces, comprising the Army, the Navy and the
Air Force, is to guarantee the sovereignty and independence of Spain,
defend its territorial integrity and constitutional order.
2. An organic law will regulate the bases of the military organization under the
principles of this Constitution.
Article 9
1. Citizens and public authorities are subject to the Constitution and the rest
the legal system.
2. It is up to public authorities to promote conditions for freedom
and equality of individuals and groups to which they belong are real and effective;
remove the obstacles that prevent or hinder their full and facilitate the participation of
all citizens in political, economic, cultural and social life.
3. The Constitution guarantees the principle of legality, the hierarchy of norms, the
advertising rules, the non-retroactivity of punitive provisions not
favorable or restrictive of individual rights, legal certainty, accountability
and the prohibition of arbitrary action of public authorities.

TITLE I
Of fundamental rights and duties
Article 10
1. The dignity of the person, the inviolable rights which are inherent, the free
personality development, respect for the law and the rights of others are
foundation of political order and social peace.
2. The rules relating to fundamental rights and freedoms to the
Constitution shall be construed in accordance with the Universal Declaration of

Human rights and international treaties and agreements on those matters


ratified by Spain.
