COMPROMISE AGREEMENT

This agreement/proposal is executed this ___ day of _____, 2015 at


_______________, ____________________, by and between:
MR. TOM S. CRUZ, Filipino, of legal age, with address at
_______________, Bacolod City, Negros Occidental, represented
herein by his counsel, Atty. __________ (hereinafter referred as
the petitioner);
-andMRS. ANGELINA J.P. CRUZ, Filipino, of legal age, with address
at _______________, Bacolod City, Negros Occidental, represented
herein by her counsel, Atty. __________ (hereinafter referred as
the respondent).
WITNESSETH: ThatWHEREAS, the plaintiff, MR. TOM S. CRUZ, and the respondent, MRS.
ANGELINA J.P. CRUZ, were married in 1976 and are still married, but are no
longer living together since 1998;
WHEREAS, the plaintiff and the respondent have several conjugal properties,
to wit:
a. Three homes covered by Transfer Certificate of Title Numbers
_______________, _______________, and _______________, respectively;
b. A sand and gravel business; and
c. Fifteen (15) trucks, all named under the sand and gravel business.
WHEREAS, the plaintiff and the respondent both rented four farm lots during
the course of their co-habitation.
WHEREAS, the respondent took control over the business, conjugal funds
and properties since the plaintiff got kicked out of the conjugal home in 1998.
NOW, THEREFORE, in consideration of the foregoing premises, the
petitioner, Mr. TOM S. CRUZ hereby stipulate the following terms to wit:
NON-NEGOTIABLES
1. Should Angelina refuse to give the passbook for Tom's BDO Account,
an allowance of at least Thirty Thousand Pesos (P30,000) per
month shall be given to the petitioner subject to annual review if
still enough;

2. Should there be a necessity to dispose of all or any part of the conjugal


property, NO disposition of said property shall be made without
the consent of the petitioner;
3. That both the petitioner and the respondent shall have an annual
equal profit-sharing of all the fruits and net proceeds arising from
their conjugal property and rented farm lots;
4. That the petitioner shall be entitled to have the 1997 Toyota Vios
with plate number ___ ___ as his means of transportation.
NEGOTIABLES
1. That the plaintiff and the respondent shall both become
signatories and shall be granted joint administration of the
sand and gravel business and the Thirty Thousand Peso (P30,000)
Monthly Allowance shall serve as his salary;
2. Should the house inherited by the petitioner from his parents
be vacant, the plaintiff shall be allowed to keep the said house
located at ____________________, covered by Transfer Certificate of Title
Number _______________, with the following description:

Should it be impossible for the petitioner to gain access to the
said house on the basis of an existing lease agreement with a third
party, the petitioner shall, on top of the P30,000 monthly allowance,
be entitled to half of the proceeds from the rental and the other
half can be kept by the respondent for repairs and maintenance of the
said property described in the preceding paragraph.
3. Should it be impossible for the petitioner to have the 1997 Toyota Vios,
he shall be entitled to have the 1998 Ford Everest with plate number
___ ___ in lieu of the former;
4. That the BDO passbook for the petitioners bank account may be kept
by the respondent. HOWEVER, should the petitioner need money, he
shall be entitled access to his passbook for withdrawal without
any question and that the passbook shall be returned to the
respondent after the petitioner makes his bank transactions.
IN WITNESS WEREOF, the parties have hereunto set their hand this ___ day
of ________, 2015 at Bacolod City, Negros Occidental.
