FEDERAL REGULATION

Federal Regulation require an expansion in the scope of health programs, particularly


in the area of medical examinations and environmental health tests, to protect the health of
the worker.
The goal of an occupationalhealth program is the maintenance and promootion of
employee health and well-being by protecting employees from undesirable health effects that
can result from inadequately controlled equipment, processes, materials, products, and
wastes.
Occupational Safety and Health Act
An overview of the occupational safety and health Act (OSHACAct) is presented in
this section, for more details.
The declared congressional purpose of the OSHACac of 1970 is to assure so far as
possible every working man and woman in the nation safe and healthful working condition
and to preserve our human resource the federal government is authorized to develop and set
mandatory occupational safety and health standards applicable to any business affecting
interstate commerce. The responsibility for promulgating and enforcing occupational safety
and health standards rests with the departement of labor.
The OSHAct of 1970 has brought a restructuring of programs and activities relating to
safeguarding the health of the worker. Uniform occupational health and regulations now
apply to all business engaged in commerce, regardless of their location within the
jurisdiction. Tresshold limit values for the year 1986 have been incorporated into the
regulations and have the effect of law.
The 1970 OSHAct has clearly defined procedures for promulgating
regulations,conducting investigations for compliance, and handling availability of exposure
data on workers, keeping of records, and other problems.
Nearly every employer is required to implement some elements of industrial hygiene
or occupational health or hazard communication program, to be responsive to OSHA and the
OSHAct and its health regulations or those of another regulatory agency. For example, the
main safety and health administration (MSHA) is charged with enforcing MSHA health
regulations in all underground or surface mines.
NATIONAL INSTITUTE FOR OCCUPATIONAL SAFETY AND HEALTH
The OSHAct estabilished a national institute for occupational safety and health
(NIOSH) to conduct research on the health effects of exposures in the work environment,to
develop criteria for dealingwith toxic materials and harmful agents,including safe levels of
exposure, to train an adequate supply of professional personnel to meet the purposes of the
OSHAct, and, in general, to conduct research and assistance programs for improving
protection and maintenance of worker health.
Also authorized by the OSHAct are Niosh Programs for medical examinations and
tests in the workplace as may be necessary to determine, for the purpose of research, the
incidence of occupational illness and the susceptibility of employees to such illnesses. These
examinations may also be at governmentexpense. Another NIOSH function is annual

publication of a list of all known toxic substances and the concentration at which toxicity is
known to occur.
The NIOSH publishes industrywide studies on chronic or low-level exposure to a
variety of industrial materials, processes, and stresses, which can affect the potential for
illness and disease or loss of functional capacity in aging adults. The Niosh is also
responsible for conducting research on which new satndards can be based.
