Thefollowingwords,termsandphrases,whenusedinthisarticle,shallhavethemeaningsascribedto
theminthissection,exceptwherethecontextclearlyindicatesadifferentmeaning:

EconomicImpactRequirementmeansthatatargetbusinessshallgeneratesufficientgovernmental
revenuestomeetorexceedthenetpresentvalueofincentives.

Sec.2171.Significantprojects.

Furthermore,authoritygrantedunderthissectionandtheprovisionsofsubsections2169(1)and(2)of
thisarticleshallexpireMarch1,2017,atwhichtimethisarticleshallreverttotheprovisionsinexistence
atthetimeoftheiramendment,absentotheractionbytheCobbCountyBoardofCommissionersto
repealoramendthereferencedsection(s)oftheOfficialCodeofCobbCounty.

CHAPTER6ALCOHOLICBEVERAGES
ARTICLEI.INGENERAL
Section61.Definitions

Bottlehousemeansanyplaceofbusinessopentothepublicoranyprivateclubwhichallows
guests,patronsormemberstobringinandtoconsumetheguest's,patron'sormember'salcoholic
beveragesonthepremisesunlessotherwiseprovidedinthisChapter.Thisdefinitionincludes
restaurantswithalcoholpouringlicensesthatallowalcoholtobebroughtonthepremisesandmay
chargeacorkagefee.RestaurantsthatarebottlehousesshallpayalicensefeeasprovidedinscheduleF
onfilewiththecountyclerkandthebusinesslicensedivision.

Establishmentmeansabusinesslocationthathasreceivedtheapplicablepouringlicensewithin
certainmixedusedevelopmentsidentifiedinChapter6133.

Eventvenuemeansthelocationofatemporaryeventorgatheringusingpublicpropertythat
hasthecapacitytodraw20,000participantsonthedayoftheevent.

Freestandingvendormeansanypersonorentitythatispermittedtosellalcoholicbeverages
fromacart,kiosk,ortemporarystructureforretailsaleswithincertainmixedusedevelopments
identifiedinChapter6133.

Maltbeveragemeansanyalcoholicbeverageobtainedbythefermentationofanyinfusionor
decoctionofbarley,malt,hops,oranyothersimilarproduct,oranycombinationofsuchproductsin

Majorshareholdermeansanindividualorentitythatownsorcontrolsatwentypercent(20%)
ormoreinterestinabusinessestablishment.

Tailgatingmeansasocialgatheringofpeopleinadesignatedarea,foraspecified,limitedtime
period,whenandwherefoodandalcoholicbeveragesmaybeconsumedimmediatelyprecedingor
followinganeventataneventvenue.Alcoholmaynotbesold,butattendees21andoldercanbringand
consumealcoholicbeveragesincompliancewithapprovalsrequiredinChapter6134.

ARTICLEIII.LICENSES
DIVISION1.Generally

Sec.690.Licensereviewboard.

(b) Thelicensereviewboardestablishedbythissectionshallhavethefollowingduties:

(3) Tohearmattersinvolvinganyrevocation,suspensionorotherdisciplinaryactionagainstthe
holderofanyworkpermitoralcoholicbeveragelicense.

(f)
Adecisionofthelicensereviewboardrelatedtoworkpermitsshallbefinalandmaybe
appealedinaccordancewith6207(i).Otherdecisionsofthelicensereviewboardshallbefinalunless
appealedtotheboardofcommissionerswithintendaysofthedateofdecisionbythelicensereview
board.Theboardofcommissionersshallreviewasummaryofthehearingbeforethelicensereview
boardwithin30daysofthedateofthelicensereviewboard'srecommendationtowaivethedistance
requirementsofsection6124or6125ordirectthebusinesslicensedivisionmanagertoplacethe
matterdownforahearingandtakeanyauthorizedactionconcerningtheapplicant'srequestedlicense.
Iftheboardofcommissionersopttoreviewasummaryofthehearingbeforethelicensereviewboardit
may,aftersuchreview,placethematterdownforahearingandtakeanyauthorizedactionconcerning
theapplicant'srequestedlicenseorlicenses.Nolicenseshallbeissueduntiltheboardofcommissioners
hasreviewedthesummaryandmadeadecisiononwhethertoplacethematterdownforhearing.In
theeventtheboardofcommissionersaffirmsthedecisionofthelicensereviewboardtoissuealicense,
theappropriatelicenseorlicensesshallbeissued.

DIVISION2.ISSUANCESTANDARDS

Sec.6117.Circumstancesprohibitingissuance.

Thattheapplicanthasviolatedanylaw,regulationorordinancerelatingtosuchbusinesswithin
afiveyearperiodimmediatelyprecedingthedateofapplication.

(a) Theprovisionsofthissectionareintendedtosetforthcertainexceptionsandprovisionsapplicable
onlytolicenseeswhoseestablishmentsarelocatedwithincertainlargemixedusedevelopment
districts,ashereinafterdefined,holdinglicensestosellalcoholicbeveragesforconsumptiononthe
premises.Exceptasspecificallysetforthinthissection,allsuchlicenseesremainsubjecttoallother
provisionsofthecountysalcoholicbeverageordinance.
(b) Forthepurposesofthissectiononly,amixedusedevelopmentdistrictisdefinedasadevelopment
thatiszonedRRCwithapubliceventvenuewithpermanentseatinginexcessof20,000seats(and
toincludeattendantparkingfacilities)andmayincludeamixtureofretail,restaurants,
entertainment,officespace,andhotelunits.
(c) Thecountyminimumdistancerequirementsforonpremisesconsumptionestablishmentsina
mixedusedistrictarewaived.Allstateminimumdistancerequirementstopropertiesoutsideofthe
boundariesofsuchcertainmixedusedevelopmentdistrictsshallremainineffect.
(d) Outsideconsumptionofalcoholicbeveragespermittedasfollows:
(1) Theareasdesignatedfortheoutsideconsumptionofalcoholicbeveragesshallbedepictedona
plan,presentedbytheapplicant,thatshallbeapprovedbyboththemixedusedevelopment
districtmanagementandtheboardofcommissionersandincludelocationswherefreestanding
vendors(asdistinguishedfromalicensedpremises)maysellalcoholicbeverageswithinthe
designatedarea.Areasdesignatedfortheoutsideconsumptionofalcoholicbeveragesmust
includemethodsforverifyingidentification,determiningeligibilityforadultstopurchaseand
consumealcoholicbeverages,andensuringminorswillnotbeservedalcoholbeverages.
(2) Drinkingfromglassbottleorotherglasscontainerprohibited.Itshallbeunlawfulforanyperson
todrinkorattempttoconsumeanyalcoholicbeveragefromaglassbottleorotherglass
container,ortopossessinanopenbottleorglassanyalcoholicbeverageintheareadesignated
foroutsideconsumptionofalcoholicbeverages.
(3) Purchasefromlicensedpremiseswithinmixedusedevelopmentdistricts.Alcoholicbeverages
consumed,withintheareadesignatedforoutsideconsumption,pursuanttotheseprovisions
mustbepurchasedfromalicensedpremiseorapprovedfreestandingvendorwithinthemixed
usedevelopmentdistrict.
(4) Consumptionlimitedtolawfulhoursofoperation.Noalcoholicbeveragepurchasedpursuantto
thisprovisionshallbeconsumedexceptwithintheauthorizedhoursofsale.
(5) Twodrinkonstreetlimit.Anyestablishmentorfreestandingvendorlicensedtosellalcoholic
beveragesbythedrinkforconsumptionisauthorizedtodispensealcoholicbeverage(s)ina
paperorplasticcup,orothercontainerotherthanaglassbottleorotherglasscontainer,for
consumptioninthedesignatedareaasdepictedintheapprovedplanasdescribedin6
133(d)(1).However,noestablishmentshalldispensetoanypersonmorethantwosuch
alcoholicbeveragesatatime.Noalcoholicbeveragecontainershallbemorethantwentyfour
(24)fluidouncesinsize.Noindividualshallhavemorethantwoopencontainersofalcoholic
beveragesintheirpossession.
(e) Section6133containsspecificregulationspertainingtothesaleandconsumptionofalcoholic
beverages.AreasthatarepermittedtooperateinconformitywithSection6133arenotconsidered
abottlehouseasdefinedinthisChapter.
(f) Violationof6133isamisdemeanor.
AnypersonwhoviolatesSections6133isguiltyofamisdemeanor.
(1) Firstconviction.Afineofnotlessthan$100.00normorethan$1,000.00andcostsand/or
imprisonmentinthecountyjailfornotmorethan60daysorboth.
(2) Secondconviction.Afineofnotlessthan$200.00normorethan$1,000.00andcostsand/or
imprisonmentinthecountyjailfornotmorethan60daysorboth.

andaggravatednature.

6134.Tailgating.
(a) TheprovisionsofChapter6134areintendedtosetforthcertainexceptionsandprovisions
applicableonlytoareasthathavebeenestablishedasalocationapprovedfortailgating.
(b) Definitions forthepurposesofChapter6134only:
(1) MixedusedevelopmentdistrictmeansadevelopmentthatiszonedRRCandmayincludea
mixtureofretail,restaurants,entertainment,officespace,hotelunits,andapubliceventvenue
withpermanentseatinginexcessof20,000seats(andtoincludeattendantparkingfacilities).
(2) Universitymeansaneducationalinstitutiondesignedforinstruction,examination,orboth,of
studentsinmanybranchesofadvancedlearning,andauthorizedtoconfervariousdegrees.
(c) Tailgatingispermittedasfollows:
(1) Theareasdesignatedfortailgatingshallbedepictedonaplan,presentedbytheapplicant,that
shallbeapprovedbyboththemixedusedevelopmentdistrictmanagementortheuniversity
andtheboardofcommissioners.
(2) Tailgatingareaplansshallinclude:
a. Area(s)wheretheoutsideconsumptionofalcoholicbeverageshallbeallowed;
b. Locationsofpermanentortemporarypublicrestroomfacilities;
c. Locationsofareasdesignatedforoutdoorcooking;
d. Locationsoftrashreceptaclesandrecyclingcontainers;and
e. Prohibitiononlittering.
(d) Prohibitionofthesaleofalcoholicbeverages,foodproductsorotheritemsrelatedtotheevent
activities.Theoutsideconsumptionofalcoholicbeveragesshallbeallowedwhentheyare
transportedtothedesignatedareasforpersonalconsumption.Nobeverage,alcoholicorotherwise,
orfoodproductshallbesoldorpurchasedwithinthearea(s)designatedfortailgating;
(e) Drinkingfromglassbottleorotherglasscontainerprohibited.Itshallbeunlawfulforanypersonto
drinkorattempttodrinkanyalcoholicbeveragefromaglassbottleorotherglasscontainer,orto
possessinanopenbottleorglassanyalcoholicbeverageintheareadesignatedforoutside
consumptionofalcoholicbeverages.
(f) Section6134containsspecificregulationspertainingtotheconsumptionofalcoholicbeverages.
AreasthatarepermittedtooperateinconformitywithSection6134arenotconsideredabottle
houseasdefinedinthisChapter.
(g) Violationof6134isamisdemeanor.
AnypersonwhoviolatesSections6134isguiltyofamisdemeanor.
(1) Firstconviction.Afineofnotlessthan$100.00normorethan$1,000.00andcostsand/or
imprisonmentinthecountyjailfornotmorethan60daysorboth.
(2) Secondconviction.Afineofnotlessthan$200.00normorethan$1,000.00andcostsand/or
imprisonmentinthecountyjailfornotmorethan60daysorboth.
(3) Thirdconviction.Afineofnotlessthan$500.00normorethan$1,000.00andcostsand/or

DIVISION3.FEE,SUSPENSION,REVOCATIONORTRANSFER

Sec.6147.Procedureforfee,suspensionandrevocation.
(a) Itisdeterminedthatthefollowingareviolations:
(1) Whenalicenseeoranyoneintheemployofalicenseeischargedwith,arrestedfor,or
convictedofsellingalcoholicbeveragestoanunderagepersonorpersonsoronSundaywithout
necessarySundaysaleslicense;
(2) Whenalicenseeoranyoneintheemployofalicenseeischargedwith,arrestedfor,or
convictedofsellingalcoholicbeveragestoanintoxicatedpersonpursuanttoO.C.G.A.3322
duringthecurrentlicenseyear;or
(3) Whenalicenseeoranyoneintheemployofalicenseeischargedwith,arrestedfor,or
convictedofsellingalcoholicbeveragestoanintoxicatedpersonpursuanttoO.C.G.A.3322
duringtheprevious24months.
(b) ThepolicedepartmentshallnotifythebusinesslicensedivisionmanagerifanyviolationofSection
6147(a)occurs.
(c) FeesforfirstoffenseofanyviolationinSection6147(a)
(1) Thebusinesslicensemanagershallcollectafeeof$750.00fromthelicenseeinlieuofplacing
thematterforhearingbythelicensereviewboardforanyfirstoffenceoftheviolationssetforth
inSection6147(a),unlesslicenseehasanycriminalhistorywithinthepastfive(5)years.The
licenseeshallhaveten(10)daysfromthedateofnotificationbythebusinesslicensemanager
topaythefee.Failuretopaythefeewithintherequiredtimeframewillresultsinanautomatic
three(3)daysuspensionoftheirlicense.
(2) ThelicenseholderthathasbeenchargedwithaviolationofSection6147(a)mayappealthefee
andrequestahearingbythelicensereviewboardasfurtherdefinedinthesection.
(d)
Noalcoholicbeveragelicensewhichhasbeenissuedorwhichmayhereafterbeissuedshallbe
suspendedorrevokedexceptforduecauseasdefinedinthissectionSection,afterahearingandupon
writtennoticetotheholderofsuchlicenseofthetime,placeandpurposeofsuchhearinganda
statementofthechargeorchargesuponwhichsuchhearingshallbeheld.
(1) Oncethebusinesslicensemanagerbecomesawareofanyreasonforapossiblesuspensionor
revocation,he/sheshallplacethematterforhearingbythelicensereviewboard.Aminimum
ofthreedays'noticeofthehearingdateshallbeprovidedtothelicensee.
(2) Duecauseforthesuspensionorrevocationofsuchlicenseshallconsistofoneormoreofthe
following:
a. Theviolationofanylawsorordinancesregulatingsuchbusinessorfortheviolationofany
stateorfederallaw;
b. Anychangeintheareawheresuchbusinessislocated,whichchangeisdeemedbythe
boardofcommissionerstocausesuchbusinessinsuchareatobeundesirable;
c. Anyreasonwhichwouldauthorizetheboardofcommissionerstorefusetheissuanceofa
license;
d. Anyviolationofthischapter;or
e. AsecondoffenseofanyviolationofSection6147(a).
(3)Duecausehearing.Thelicensereviewboardatsuchhearingshallhearevidenceofthe
circumstancesofthepossibleduecauseandaftersaidhearingmayrecommendthatthelicense
tosellalcoholicbeveragesbesuspendedforamaximumof12monthsorrevoked.Thelicense
reviewboard,andtheboardofcommissioners,ifapplicable,mayconsidermitigatingand

aggravatingcircumstancesinconsideringsanctions,includingbutnotlimitedto,attendanceofa
responsiblealcoholsalesandservice(RASS)workshop,implementationandcomponentsof
writtenpolicies,thatemployeeshaveordonothavealcoholicbeverageworkpermits,
implementationandresultsofmysteryshopperprogram,implementationandcomponentsofa
trainingprogram,numberofviolationsofbusiness,numberofviolationsoflicensee,numberof
stores,lengthoftimeinbusiness,compliancecheckwasduetoacomplaint,identificationwas
notchecked,andanyotherfactsdeemedrelativebythefactfinder.
(4) AffirmationbyBoardofCommissioners. Ifthelicensereviewboardrecommendssuspensionor
revocationandtheownerofthealcoholicbeveragelicense,thelicenseeorbothshouldfailto
appealsuchsuspensionorrevocationrecommendation,thenthesuspensionorrevocationshall
becomeeffectiveuponaffirmationbytheboardofcommissionersofsuchsuspensionor
revocationrecommendationandtheownerofthealcoholicbeveragelicenseandthelicensee
shallbedeemedtohaveacquiescedtosuchsuspensionorrevocation.Theboardof
commissionersshall,within60daysofthelicensereviewboardaction,reviewasummaryofthe
hearingbeforethelicensereviewboardwhereinthealcoholicbeveragelicensewasconsidered
forsuspensionorrevocation(thesummaryshallbepreparedbythebusinesslicensedivision
manager)andtheboardofcommissionersaftersuchreviewmayplacethematterdownfora
hearingoraffirmoralterthedecisionofthelicensereviewboard.Shouldtheboardof
commissionersplacethematterdownforhearing,theboardofcommissionerssuspend,fora
maximumoftwelve(12)months,orrevokethealcoholicbeveragelicense.
(5) Appeal.
a. Intheeventthelicensereviewboardrecommendsthatthealcoholicbeveragelicensebe
suspendedorrevoked,theownerofthealcoholicbeveragelicense,thelicenseeorboth
mayfileanappealwiththebusinesslicensedivisionmanagerofsuchrecommendation
withintendaystotheboardofcommissioners.Theboardofcommissionersshallconducta
denovoreviewandanyadditionalevidencemaybepresentedattheappealhearing.
b. Ifahearingoccurredbeforetheboardofcommissioners,suchdecisionisfinalunlessappeal
ismadetothesuperiorcourtofthecounty.Anyaggrievedpartymayappealadecisionof
theboardofcommissionersbyfilingapetitionforwritofcertioraritothesuperiorcourt
within30daysofthedecisionoftheboardofcommissioners.
(e) Inallhearingsheldpursuanttothissection,theproceedingsshallbeasinformalascompatiblewith
justice,thehearingshallbeexpeditedandnormallyshallnotexceed30minutesinlength,andthe
followingproceduresshallprevail:
(1) Thechargesandspecificationsagainstthelicenseeandtheresponseasfiledbythelicensee
shallberead.
(2) Thecountyrepresentativeshallpresentevidence,andthenthelicenseeshallpresenthis
evidence,withopportunityforeachpartytopresentrebuttalevidence,examinationandcross
examinationofwitnesses,andinterrogationbytheboardofcommissioners.Noevidenceshall
bepresentedwhichisnotrelevanttothecharges.
(f) Intheeventalicensetosellalcoholicbeveragesissuspendedasignissuedbythebusinesslicense
officeshallbeplacedateachentrancetothefacilitywhereinalcoholicbeveragesweresoldwiththe
signproviding,"THELICENSETOSELLALCOHOLICBEVERAGESISSUEDTOTHEOWNERANDLICENSEE
OFTHISBUSINESSHASBEENSUSPENDEDFROM____________TO____________ASARESULTOF
SELLINGALCOHOLICBEVERAGESTOANUNDERAGEPERSON,ANINTOXICATEDPERSONORAN
UNAUTHORIZEDSUNDAYSALE."Intheeventalicensetosellalcoholicbeveragesisrevokedasign
issuedbythebusinesslicenseofficeshallbeplacedateachentrancetothefacilitywhereinalcoholic
beveragesweresoldwiththesignproviding,"THELICENSETOSELLALCOHOLICBEVERAGESISSUED
TOTHEOWNERANDLICENSEEOFTHISBUSINESSHASBEENREVOKEDASARESULTOFSELLING

Sec.6183.TemporaryAlcoholicBeverageLicensesforTradeShows.
Atradeshoworganizationorentitythatdesirestoservealcoholicbeveragestemporarily(nomorethan
three(3)days)fortastingand/orsamplingshallobtainatemporaryalcoholicbeveragelicensetoserve
alcoholicbeveragesforconsumptiononthepremisesoftheevent.Atastingand/orsamplesizeshallnot
exceedtwo(2)ounces.

DIVISION3.EMPLOYEES
Sec.6206.Employmentofpersonswithpriorconvictions.
Nolicenseeshallemploy,forcompensationorotherwise,inanypremisesforthesaleofalcoholic
beveragesortheoperationofabottlehouseunderthischapteranypersoninacapacityrequiringa
workpermitundersection6207whoisnotacitizenoftheUnitedStatesoranalienadmittedfor
permanentresidenceorapersonwhohasotherwisebeengrantedemploymentauthorizationbythe
UnitedStatesCitizenshipandImmigrationServicesorwhohasbeenconvictedwithinthreeyears
immediatelypriortotheapplicationforemploymentofsolicitingforprostitution,pandering,letting
premisesforprostitution,keepingadisorderlyplace,oneormoreUnder21DUIsoranyconviction
relatingtothesaleorfurnishingofalcoholicbeverages,orwhohasbeenconvictedwithinfiveyears
immediatelypriortotheapplicationforemploymentofanyfelonydrugconviction,felonysexoffense,
oranyothercrimeinvolvingmoralturpitude,oftwoormoreconvictionsofdrivingundertheinfluence,
oftwoormoreconvictionsofpossession,consumption,orattempttopurchasealcoholbyanunderage
person;orofanyconvictionrelatingtotheunlawfulpossession,useormanufacturingofanauthenticor
fraudulentdriver'slicenseorID,providedthatthissectionshallnotapplytoprivateclubsasdefinedin
thischapter.Theomissionorfalsificationofanymaterialinformationinanapplicationforanalcoholic
beveragepermitshallbeaviolationofthischapterandgroundsforthedenial,suspensionorrevocation
ofanysuchpermit;however,anyemployeesexcludedfromemploymentunderthetermsofthissection
shallhavetherighttoappealsuchexclusiontothelicensereviewboard.

Sec.6207.Workpermits.
(a) Forwhomrequired.ItistheresponsibilityofthelicenseeanddesigneeasstatedinSection692(g)
toensurethattheemployeesrequiredunderthiscodesectionobtainandpossesstherequired
workpermitissuedbythecountypolicedepartmentpriortoworking.Employeesforthepurposes
ofthissectionshallincludeindependentcontractors.Failureofanemployeetopossessawork
permitwhilesellingorservingalcoholicbeverages,asrequiredbythissection,shallbeunlawfuland
willsubjecttheemployeeandlicenseetoprosecutionasprovidedinthischapterandshallbe
groundsforsuspensionorrevocationofthelicense.Apermittoworkinanyofthefollowing
establishmentsshallberequiredofthefollowing:
(1) Allemployeesofpackagestores.
(2) Allemployeesofconveniencestores.

(3) Allemployeesofbusinesseswithapouringlicensewhoserveorsellalcohol,whichshallinclude

appealedinaccordancewith6207(i).Inaddition,afterthehearing,thelicensereviewboardmay
approveorrecommendtotheboardofcommissionersapprovalofaworkpermittoanemployee
whoseapplicationwasoriginallydeniedbaseduponanyconditionsdeemedappropriatebythe
licensereviewboard,pursuanttoSection6207(i).Deniedapplicantswhofailtofileatimelyappeal

(d)Trainingofpermitholders.

(3) Detailedrecordsofsuchtraining,includingthecontent,date,time,personsattendingandcopy
ofanypre/posttest,shallbemaintainedforaminimumof36monthsafterthetraining.
Evidenceofsuchtrainingrecordsshallbemadeavailableuponrequestforinspectionbythe
county.

(e) Permitterm.Anyworkpermitissuedunderthissectionshallexpire12monthsfromthedateof
issuanceunlessearliersuspendedorrevokedasprovidedinthissection.
(f) Possessionofpermitsbyemployees.Employeesholdingpermitsissuedpursuanttothissectionshall
atalltimesduringtheirworkinghourshavethepermitsavailableforinspection.
(g) Exclusion.Thissectionshallnotapplytoprivateclubs.
(h) Workpermitrequirement.Atalltimesthatthebusinessisopenthelicenseeshallhaveatleastone
persononthepremiseswhohasavalidworkpermit.
(i) Groundsforsuspension,revocation.Nopermitwhichhasbeenissuedorwhichmayhereafterbe
issuedunderthissectionshallbesuspendedorrevokedexceptforduecauseasdefinedinthis
subsection,andafterahearinganduponwrittennoticetotheholderofsuchpermitofthetime,

federalorlocalordinancessetoutinSection6206;orfortheomissionorfalsificationofany
materialinanyapplication;orforanyreasonwhichwouldauthorizetherefusaloftheissuanceofa
permit;oranyviolationofthischapter.Allhearingsshallbebeforethelicensereviewboardand
shallbeconductedinthemannerprovidedinSection6147.

Afterthehearing,ifthelicensereviewboardmaydecideto:
(1) Approvetheworkpermitbyanaffirmativevotebyasupermajorityofthelicensereviewboard.
Insuchcases,theapprovalshallbefinal;
(2) Approvetheworkpermitbyanaffirmativevoteoflessthanasupermajorityofthelicense
reviewboard.Insuchcasestheboardofcommissionersshall,within60daysofthelicense
reviewboardsdecision,reviewasummaryoftheoftheappealorshowcausehearingbefore
thelicensereviewboardwhereintheworkpermitwasconsideredforissuanceandtheboardof
commissionersaftersuchreviewwilleitherconcurwithrecommendationsofthelicensereview
boardorchoosetoplacethematterdownforahearing;or
(3) Deny,suspend,orrevoketheworkpermit,whenitisdeterminedthatduecauseexists.The
employeewhoseworkpermitwasdenied,suspended,orrevokedmayappealthelicensereview
boarddecisiontotheboardofcommissioners.Theboardofcommissionersshall,within60
daysofthelicensereviewboard'sdecision,reviewasummaryoftheappealorshowcause
hearingbeforethelicensereviewboardwhereintheworkpermitwasconsideredforissuance,
suspensionorrevocation(thesummaryshallbepreparedbythebusinesslicensedivision
manager)andtheboardofcommissionersaftersuchreviewwilleitherconcurwith
recommendationsofthelicensereviewboardorchoosetoplacethematterdownforahearing.

Shouldtheboardofcommissionersplacethematterdownforhearingtheboardof
commissioners,aftersuchhearing,mayissueordenytheworkpermit,orsuspendorrevokethe
workpermit.Afterthefinaldeterminationbythelicensereviewboardorboardof
commissioners,arepresentativeofthebusinesslicenseofficewillnotifytheCobbCountyPolice
DepartmentPermitsUnitofthedecision.Ifthepermitwasapprovedforissuance,theCobb
CountyPoliceDepartmentPermitsUnitwillnotifytheapplicantthatthepermithasbeen
approved.Theemployeewhoseworkpermitwasnotissuedorwhoseworkpermitwasdenied,
probated,suspendedorrevokedmayappealtheboardofcommissionersdecisionpursuant
toSection6147hereof.Thedecisionoftheboardofcommissionersmaybeappealedbyfilinga
petitionforwritofcertioraritotheSuperiorCourtofCobbCountywithin30daysofthedecision

Publicpropertyvendingmeansvendingactivityauthorizedbycountypermitonpubliclyowned
propertyunderthejurisdictionofthecountyforaspecialevent.

Chapter78,ArticleIII,Division2SubdivisionI(Peddlers).
(c) Privatepropertyalcoholicbeveragesvendingisnotsubjecttotheregulationscontainedinthis
Chapter,butisregulatedbyChapter6.
(d) FoodtrucksarenotsubjecttotheregulationscontainedinthisSubdivision,butareregulatedby
Sections7895to78100and6233.
(e) SpecialprovisionsandexemptionswithinmixedusedevelopmentdistrictsaregovernedbySection
78121.

Sec.78120.Violationofthisarticleisamisdemeanor.
(a) AnypersonwhoviolatesSections78117to78121isguiltyofamisdemeanor.
(1) Firstconviction.Afineofnotlessthan$100.00normorethan$1,000.00andcostsand/or
imprisonmentinthecountyjailfornotmorethan60daysorboth.
(2) Secondconviction.Afineofnotlessthan$200.00normorethan$1,000.00andcostsand/or
imprisonmentinthecountyjailfornotmorethan60daysorboth.
(3) Thirdconviction.Afineofnotlessthan$500.00normorethan$1,000.00andcostsand/or
imprisonmentinthecountyjailfornotmorethan60daysorboth.
(4) Fourthconviction.Anypersonconvictedoffourormoreviolationsofthisarticleshallbesubject
toafineofnotlessthan$1,000.00andcostsand/orimprisonmentinthecountyjailfornot
morethan60daysorboth.Afourthconvictionshallbeconsideredamisdemeanorofahighand
aggravatednature.
(b) SuspensionorRevocation.InadditiontothepenaltiesforviolationsestablishedunderSec.78120,
violationsoftheprovisionsinthissubdivisionpertainingtovendorsshallsubjectthelicenseto
suspensionorrevocation.Violationsofthisdivisionshallbeconsideredduecauseasdefined
insection78371forsuspensionorrevocationofanylicenseissuedunderthisdivision.

Sec.78121.Specialprovisionsandexemptionswithinmixedusedevelopmentdistricts.
(a) Forthepurposesofthisarticleonly,amixedusedevelopmentdistrictisdefinedasadevelopment
thatiszonedRRCwithapubliceventvenuewithpermanentseatinginexcessof20,000seats(and
toincludeattendantparkingfacilities)andmayincludeamixtureofretail,restaurants,
entertainment,officespace,andhotelunits.
(b) Vendingactivitywithinmixedusedevelopmentdistrictsispermittedinareasdesignatedfor
vendingactivityasdepictedonaplanthatshallbeapprovedbyboththemixedusedevelopment

DIVISION10.ACCESSORYSPECIALEVENTPARKING
Sec78.406.Accessoryspecialeventparking.
Thefollowingdivisionsetsforthprovisionsforthelicensingofaccessoryspecialeventparking.

Sec.78.406.1.Definitions.
Thefollowingwords,termsandphrases,whenusedinthischapter,shallhavethemeaningsascribedto
theminthissection,exceptwherethecontextclearlyindicatesadifferentmeaning:
Accessoryspecialeventparkingmeanstheprovisionofspecialeventparkingtothepublicfora
feeinaparkingareathatnormallyprovidesrequiredorexcessparkingforaparticularnonresidential
establishment.

Accessoryspecialeventparkingareameansthedesignatedarea(s)tobeusedforaccessory
specialeventparkingasshownontheparkingplansubmittedbyanapplicant.

Limitedaccesszonemeansthestreetsdescribedinthisdivisionwhereaccessoryspecialevent
parkinglicensesshallnotbeissued.

Majortouristattractionmeansasiteof12acresormoredevotedtoasingleuseasan
amusementthemeattraction,park,conventioncenter,performingartscenter,amphitheatre,or
stadiumwhichpromotesthetourisminterestsofthecounty.

Specialeventmeansaeventorgatheringusingprivateorpublicproperty,thatdrawsan
estimatednumberofparticipantsandspectatorsfororhastheseatingcapacitytoaccommodateat
leasttwothousand(2,000)peoplepresentonanydayoftheeventandthatinvolvesoneormoreofthe
followingactivities:
(1) Closingofapublicstreet;
(2) Blockingorrestrictingstreets,sidewalks,alleys,orotherpublicplaces,inwholeorinpart;
(3) Saleordistributionoffoodorbeveragesonstreets,sidewalks,alleys,orotherpublicplaces
orpublicproperty,oronprivatepropertypursuanttoSection6133or78117to78121
whereotherwiseprohibitedbyordinance;
(4) Erectionorplacementofatent,utilitypole,orothertemporarystructureonastreet,
sidewalk,alley,orotherpublicplace;
(5) Erectionorplacementofastage,bandshell,trailer,van,portablebuilding,grandstand,
bleachers,orotherapparatususedforentertainmentpurposesonpublicproperty,oron
privatepropertywhereotherwiseprohibitedbyordinance;or
(6) Erectionorplacementoftemporarysignage,banners,ordisplaysofanykindinorovera
publicrightofway,oronprivatepropertywhereotherwiseprohibitedbyordinance.

Thepurposeofthisdivisionistopromotethehealth,safety,andwelfareofCobbCountycitizens
andvisitorsandpromoteneighborhoodintegritybyaddressingissuesthatoccurwhenpropertyisused
fortheparkingofmotorvehiclesbypersonsattendingspecialevents.Theestablishmentofalimited
accesszoneandappropriatesignsandbarricadesonpublicrightofwayduringspecialeventsis
intendedtoreduceneighborhoodimpact,improvetrafficconditions,increasepedestriansafetyinthe
areaofthehighestpedestrianvolumes,andincreasetheabilityofresidentsandpublicsafetyofficialsto
obtainneighborhoodaccessandadequateparking.Theestablishmentofaccessoryspecialeventparking
licenseforaccessoryspecialeventparkingaddressesprivatepropertyuseforparkinginareasthatwere
notoriginallydesignedorlicensedforspecialeventparking,trafficproblemscreatedbypaymentfor
parking,motorizedandnonmotorizedvehicleandpedestriantrafficmanagement,emergencyvehicle
andpublicsafetyaccess,and/orlittercreatedbyalotoperatorsfailuretoproperlyadministerthelot
andadjacentareaafterthespecialevent.Theseprovisionsareintendedtopromotethesafetyofarea
visitors,residents,andbusinesses,andtoprovideasystematicapproachtoparkingandtraffic
managementforspecialevents.

Sec.78406.3.Applicabilityandrequirements.
(a) Anaccessoryspecialeventparkinglicensewillbeissuedonlytopropertywithanactive
nonresidentialuseastheprimaryuseoftheproperty.Anaccessoryspecialeventparkinglicense
willnotbeissuedifprimaryaccesstotheaccessoryspecialeventparkingareaisfrompublicright
ofwaywithinthelimitedaccesszone.
(b) Thelimitedaccesszone(s)shallbewithin1/2mile(2,640feet)fromthespecialevent.
(c) Nopersonshallprovidespecialeventparkingforafee,includingwithinthefourhourperiodbefore
thescheduledstarttimeofthespecialevent,andthetwohourperiodafterthecompletionofthe
specialevent,withoutanaccessoryspecialeventparkinglicense.
(d) Governmentalentitiesandparkingthatsatisfieszoningrequirementsformajortouristattractions
arenotrequiredtoobtainanadditionalaccessoryspecialeventparkinglicense.
(e) Allapplicantsforanaccessoryspecialeventparkinglicenseshallsubmitanapplicationtothe
BusinessLicenseDivisionoftheCommunityDevelopmentAgencyatleastthirty(30)dayspriorto
thespecialevent.Onlycompletedapplicationswillbeconsidered.Theapplicationmustcontainthe
following:
(1) Theapplicantsname,address,phonenumber,emailaddress,andproofofidentity;
(2) Adescriptionoftheprimaryuseoftheproperty,copiesofvalidoccupationaltaxcertificatesfor
allbusinesseslocatedontheproperty,andanaffidavitthattheprimaryuse,assetforthinthe
certificateofoccupancyandoccupationaltaxcertificatesfortheproperty,isanactiveuseatthe
property;
(3) Thenameofthepropertyowner,address,phonenumber,email,andevidenceofpaymentof
propertytaxes;
(4) Written,notarizedstatementofconsentfrompropertyownerforuseofthepropertyfor
accessoryeventparkingiftheapplicantisnottheowner;
(5) Thename,address,phonenumber,email,andproofofidentityofthepersonresponsiblefor
theoperationofthespecialeventparkingarea,ifnottheownerortheapplicant.
(6) AparkingplanincompliancewiththeCobbCountyCodeandDevelopmentStandards
indicatingtheaddressandnameoftheprimaryuseontheproperty,asshownonthesignage
fortheprimaryuse,boundariesoftheparkingarea,preservationofparkingfortheprimaryuse,
ingressandegresslocations,theparkinglayout(nostackingispermitted,parkingmustbein

(7) Anapplicationfeeintheamountasapprovedbytheboardofcommissionersforallaccessory
specialeventparkinglicense;and
(8) Evidenceofanysharedparkingarrangementsorparkingagreementswithanyotherproperty
ownerorbusiness.
(f) Ifapproved,alicenseexpiresoneyearfromthedateofissuanceandmayberenewedby
subsequentapplication.
(g) AlicensemaybedeniedbasedontheCommunityDevelopmentAgencysdeterminationthatthe
proposedaccessoryspecialeventparkingwouldadverselyimpacttrafficmanagementorpublic
safetyIftheapplicationforalicenseisdenied,theapplicantmayappealthatdecisionasprovidedin
thisdivision.
(h) Licensesunderthisdivisiondonotauthorizetheuseofthelotsforpaidparkingotherthanfor
specialevents.
(i) Onthedayofaspecialevent,atemporarysandwichboardsignmustbedisplayedintheaccessory
specialeventparkingareaneareachentrancetotheparkingareainthelocation(s)shownonthe
parkingsiteplan.Thesigncopyareamustbeatleast18incheshighand24incheswide(butno
largerthan24inchesby36inches)withamaximumheightfromgradetothetopofthesignoffour
feet,includingaparkingsymbol,atleast10inchesinheightdesignatedbythecounty,andinclude
thefollowingwordingwiththeblanksfilledinappropriately:SpecialEventParkingLot,License#
___,ParkingFee$___,Operatorphone#__________.Theparkingfeemustbeinafontthatisat
least6inchesinheight.Whenthelotisfull,thesignmustbeturnedaroundtodisplaywording
visiblefromthestreetthattheparkinglotisfull.Thesignisatrafficmanagementdeviceanda
displayoflicense,sonootherwordingispermittedonthefrontofthesign.Thesignmustbeofa
durablematerial,suchasplastic,metal,wood,orlikematerial,andmustbeprofessionally
fabricatedandmaintainedingoodrepair.Asignpermitisnotrequiredforthissign,whichmaybe
displayedfourhourspriortotheeventandremovedtwohoursaftercompletionofthespecial
event.Theparkingsymbol,thewording,andthefeemustbevisiblefromtheadjacentstreet.The
parkingfeemustremainthesamethroughoutthedayofthespecialeventunlessdecreased,and
theamountchargedforparkingmustnotexceedtheamountstatedonthesign.Thesignmustbe
visibleonthespecialeventparkingareafromthetimecarsareadmittedforthespecialevent
parkinguntilthepropertyhasbeencleanedoflitterattheendofthespecialevent.
(j) Theaccessoryspecialeventparkinglicenseandparkingplanmustbeavailableforimmediateonsite
inspectionbycountystafforpublicsafetyofficials.
(k) Theaccessoryspecialeventparkingareamustbepaved,striped,andlitincompliancewith
standardsprescribedbycountyordinancesforparkingareas.Vehiclesmustbeparkedonapproved
surfacesandincompliancewiththeparkingplan.
(l) Theaccessoryspecialeventparkingareamustbestaffedbyatleasttwoattendantswhomustbe
presentontheaccessoryspecialeventparkingareafromthetimetheoperatorstartsaccepting
paymentonthelotforparkinguntilthelotisfullorthestartofthespecialevent,whicheveroccurs
first.Aminimumofoneattendantmustremainonthelotuntilonehouraftertheendofthespecial
event.Theoperatormustprovidecleanupserviceonparkways,parkingspaces,andsidewalksto
removelitter,trash,junk,orotherdebrisfoundthroughouttheaccessoryspecialeventparking
area.Theattendantsmustbeeasilyidentifiablebyuniformclothingindicatingthattheyare
employedtoprovideaccessoryspecialeventparking.Cleanupserviceshallbecompletedtwohours
aftertheendofthespecialevent.
(m) Theaccessoryspecialeventparkingmustbeoperatedincompliancewithanyconditionssetforth
ontheaccessoryspecialeventparkinglicense.

commencingwiththedateofrevocationnoticeisprovidedtotheapplicant.

Sec.78406.5.Proceduresforappealofdenialorrevocationofanaccessoryspecialeventparking
license.
(a) ReviewbyAdministrator
(1) Anyapplicantwhoisdeniedanaccessoryspecialeventparkinglicense,orpersonwhose
licenseisrevoked(anappellant)may,withinten(10)daysoftheserviceofnoticeofsuch
determination,fileawrittenappealfromsuchdeterminationwiththeCommunity
DevelopmentAgencyDirector.
(2) TheCommunityDevelopmentAgencyDirectorshallhaveten(10)daysfromthedateon
whichtheappealwasreceivedinwhichtoprovideappellantawrittennoticethatthe
decisionwasaffirmed,modified,orreversed.Thenoticetotheappellantshallbedeemed
servedupontheappellantwhenitispersonallydeliveredorwhenitissentbyregularmail
andcertifiedmailbytheUnitedStatesPostalService,tothenameandaddresssetforon
theapplicationforpermit.
(3) AdecisionbytheCommunityDevelopmentAgencyDirectoradversetotheapplicantcanbe
appealedbytheapplicantforashowcausehearingwiththeboardofcommissioners.The
applicantwillneedtofileawrittenappealwithinten(10)daysoftheserviceofnoticeof
suchdeterminationwiththeCountyClerkorwithinten(10)daysplusthree(3)daysfor
mailingfromwhenthenoticeissenttotheapplicantbyregularandcertifiedmail.
(4) Inallhearingsheldpursuanttothissection,theproceedingsshallbeasinformalas
compatiblewithjustice,thehearingshallbeexpeditedandnormallyshallnotexceed30
minutesinlength,andthefollowingproceduresshallprevail:
a. Thechargesandspecificationsagainstthelicenseeandtheresponseasfiledbythe
licenseeshallberead.
b. Thecountyrepresentativeshallpresentevidence,andthenthelicenseeshallpresent
hisevidence,withopportunityforeachpartytopresentrebuttalevidence,examination
andcrossexaminationofwitnesses,andinterrogationbytheboardofcommissioners.
Noevidenceshallbepresentedwhichisnotrelevanttothecharges.
c. Afterthehearingunderthissectiontheboardofcommissionersshalluphold,modify,or
reversethedecisionoftheCommunityDevelopmentAgencyDirector.
(5) Anyappealsfiledpursuanttothisdivisionshallstatesuccinctlythegroundsuponwhichitis
assertedthatthedeterminationshouldbemodifiedorreversedandshallbeaccompanied
bycopiesofthepermitapplication,thewrittennoticeofthedeterminationofthecounty,
andanyotherpapersormaterialtothedetermination.
(b) Anyfurtherjudicialreviewshallbeinaccordancewithlaw.

Sec.78406.6.Offenses.
(a) Itshallbeunlawfulto:
(1) Submitfalsedocuments,orotherwisemakesfalsestatementsofamaterialfactonan
applicationforanylicensesubmittedunderthisdivision;

(2) Providespecialeventparkingforanyvehicleduringaspecialeventinviolationofthisdivision;
(3) Eachvehiclechargedafeeforparkingonaparkingareaduringaspecialeventinviolationofthis
divisionconstitutedaseparateoffense;and/or
(4) Violateanyotherprovisionofthisdivision.
(b) Intheprosecutionofanoffenseunderthisdivision,itispresumedthat:
(1) Thepropertyowner,applicantfortheaccessoryspecialeventparkinglicense,andthe
responsiblepersonnamedontheapplicationfortheoperationofthespecialeventparking
area,arejointlyandseverallyresponsibleforparkingviolationsunderthisdivisionandfor
compliancewiththisdivisionintheoperationoftheaccessoryspecialeventparkingarea;and
(2) Allvehiclesparkedonpropertyduringaspecialeventhavebeenchargedafeeforparking
duringthespecialevent.

Sec.78406.7.Violation.
(a) Anypersonwhoviolatesthisdivisionisguiltyofamisdemeanor.
(b) Penaltiesforviolationsofthisdivisionshallbeasfollows:
(1) Firstconviction.Afineofnotlessthan$100.00normorethan$1,000.00andcostsand/or

Sec.78551.Prohibitionsontheresaleorrepurchaseoftickets.
(a) Itshallbeunlawfultoresell,repurchase,orofferforresaleoneormoreticketsbyaticketbrokeror
byapersonwhoistheoriginalpurchaserforpersonaluseofoneormoreticketswithin2,700feet
ofavenuewhichseatsoradmitsmorethan15,000personstoanysingleathleticcontestor
entertainmentevent.
(b) Itshallbeunlawfultoresell,repurchase,orofferforresaleoneormoreticketsbyaticketbrokeror
byapersonwhoistheoriginalpurchaserforpersonaluseofoneormoreticketswithin1,500feet
ofavenuewhichseatsoradmitslessthan15,000personstoanysingleathleticcontestor
entertainmentevent.
(c) Outsideofthe2,700footor1,500footdistancefromaneventvenue,asapplicable,alicenseshall
notberequiredforapersonresellingorrepurchasingticketsatfacevalueifsuchpersonwasthe
originalpurchaserforpersonaluse.
(d) Outsideofthe2,700footor1,500footdistancefromaneventvenue,asapplicable,theresaleor
repurchaseofticketsshallonlyoccurbylicensedticketbrokersinapermanentofficestructureor
placeofbusinessthathasbeenissuedaCertificateofOccupancybythecounty,

Sec.78552.Application.
Licenseapplicationsshallcontainthefollowinginformation:
(1) Applicantsevidenceofappropriatestateticketbrokerlicense;
(2) Applicant'sresidentialstreetaddress;and
(3) Applicant'sdateofbirth,race,sex,height,weight,eyecolor,andhaircolor.

Sec.78553.Attachmentstotheapplication.
Eachapplicationshallbeaccompaniedbythefollowing:

Sec.8660.Intent.

county;toassurethefree,orderly,undisruptedmovementofmotorizedvehiclesonpublicarterialand
collectorroadswithintheunincorporatedcounty;andtoprovideforsafetyintheinterestofpedestrians
andoccupantsofmotorizedvehicleslocatedonsuchroads.Thisarticleisintendedtoapplytoall
personswhoengageintheactivitiesproscribedherein,regardlessoftheirmessage.Thisarticleis
intendedtobenarrowlytailoredtoservethegovernmentinterestofpublicsafety,andtoleaveopen
amplealternativechannelsofdisplayingadvertising,distributinggoodsandmaterials,andsoliciting
business,charitablecontributionsandpanhandling.

Sec.8661.Definitions.
Thefollowingwords,termsandphrases,whenusedinthisarticle,shallhavethemeaningsascribedto
theminthissection,exceptwherethecontextclearlyindicatesadifferentmeaning:
Panhandlingmeanstheactofobtainingmoney,foodorotheritemsbyapproachingand
beggingfromastranger.
Roadsincludespublicarterialandcollectorroadsorstreets,shoulders,roadbeds,medians,and
allotherwaysopentotravelbyoperatorsofmotorizedvehiclesorareasofpedestrianactivitywithin
theunincorporatedcounty.Thedefinitionexcludesprivateroadsandroadsthatarenotopentomotor
vehicletravel.ArterialandcollectorroadsareidentifiedontheOfficialThoroughfaremapofthecounty.

Sec.8662.Findingsanddeterminations.
(a) Theboardofcountycommissionersherebyfindsanddeterminesthatphysicalinteractionbetween
pedestriansandmotorvehiclesthataretemporarilystoppedfortrafficcontroldevices,onarterial
andcollectorroadsinthesamespaceatthesametimeisinherentlydangerous,andthatthe
combinationofthehighvolumeofmotorizedvehiclesandcongestedroadsinthecountywith
personswhoaresittingorstandingnexttoorinthetravellanes,sittingorstandingonroad
medians,orsittingorstandingincloseproximitytotheedgeofthetraveledroadwayinsituations
wheresuchpersonsareengaginginanykindofphysicalexchangeofobjectswithoperatorsand
passengersofmotorvehicles,includingbutnotlimitedto:distribution,solicitationforcharitableor
commercialpurposes,orindividualpanhandlingthatisdirectedatmotorvehicleoccupantsonthose
roadsishazardoustopublicsafety,bothforoccupantsofmotorizedvehicleslocatedonpublicroads
andforpersonsengaginginsuchadvertising,distribution,solicitationandpanhandling.

locatedonthepublicarterialorcollectorroads,whensuchroadsorstreetsareopentotraffic,in
theunincorporatedcounty.
(b) Thelanguageofthisarticleisintendedtoprohibittheactivitiesdescribedaboveonlywhentheyare
directedbypedestrianstowardoccupantsofmotorvehiclesthatareonthetraveledportionof
publicarterialorcollectorroadsthatareopentotraffic.Theterm"traveledportion"includestravel
lanes,turnlanes,andotherportionsoftheroadthataregenerallyusedformotorvehicletravel.
Thisarticleisnotintendedtoprohibitactivitiessuchasadvertising,distributionofgoodsor
materials,orbusinessorcharitablesolicitationthatisdirectedtowardpedestriansonsidewalks.

Sec.8664.Territoryembraced.
Theprovisionsofthisarticleshallembraceallpublicarterialorcollectorroadsandstreetswhensuch
roadsorstreetsareopentomotorvehicletraffic,withinthelegalboundariesoftheunincorporated
county,includingstateroads,interstaterampsandcountyroads.

Sec.8665.Lawfulpedestrianactivity;motorvehiclemechanicalproblemsandaccidents.
Theprovisionsofthisarticledonotregulateorprohibitthelawfulpedestrianactivityofcrossingpublic
roadsatdesignatedcrossingareas,orsimplywalkingorstandingonsidewalksadjacenttopublicarterial
orcollectorroadways.Theprovisionsofthisarticlearefurthernotviolatedwheremotoristsare
standingneartheroadwayoronmediansorsidewalkswhilewaitingforassistancebecauseoftraffic
accidentsormechanicalproblemswiththeirmotorvehicles.

CHAPTER102SOLIDWASTE
ARTICLEI.INGENERAL

Sec.10214.Violationsandpenalties.
(a) Anypersonwhoviolatesanysectionorprovisionofthischaptershall,aftertrialandconvictionupon
acitationissuedtothemagistratecourtofthecounty,beguiltyofamisdemeanorandshallalsobe
finedinanamountnottoexceed$1,000.00and/orimprisonedforaperiodnottoexceed60days
foreachsuchviolation.Ifanypersonisfoundtobeguiltyofmorethanoneviolationofthischapter
inany12monthperiod,thefollowingfinesareestablished:

suspendedbythedivisionmanagerofsolidwasteorhis/herdesigneeforupto30days.
(b) ForviolationsofSection10271only,asolidwastepermitmaybetemporarilysuspendedbythe
divisionmanagerofsolidwasteorhis/herdesignee,thecommunitydevelopmentagencydirector,
orthedirectorofpublicsafetyforupto30days.
(c) Onlytheboardofcommissionersmaysuspendasolidwastepermitformorethan30daysor
permanentlyrevokeanysolidwastepermitissuedpursuanttothisarticle.

Sec.10271.Hoursofcollection.
(a) Nopersonorentityshallengageinthecollection,transportationordisposalofanysolidwasteor
recyclablesfromdumpsters,containersorreceptaclesofanykindortypebetweenthehoursof
11:00p.m.and7:00a.m.excepttoperformemergencyworkrequiredtosafeguardtheimmediate
health,safetyandwelfareofthepublic.
(b) Everynoisecomplaintreceivedandrecordedbythesolidwastedivision,thecountypolice
department,orthecodeenforcementdivisionofthecommunitydevelopmentagencyataspecific
locationshallconstituteaviolationofthisprovisionandshallresultintheissuanceofareporttothe
countypolicedepartment,thecodeenforcementdivisionofcommunitydevelopmentagencyorthe
divisionmanagerofthesolidwastedivisionorhis/herdesigneesoremployeesforfullenforcement
ofthischapter.
(c) Atsuchtimeasanysecondnoisecomplainthasbeenreceivedorrecordedbythesolidwaste
division,thecountypolicedepartment,orthecodeenforcementdivisionofthecommunity
developmentagencyina45dayperiodataspecificlocationinthecountyanduponinquiryand
investigationthesolidwastedivision,thecountypolicedepartment,orthecodeenforcement
divisionofthecommunitydevelopmentagencyisabletoverifyandsubstantiatethefactualbasis
forsuchcomplaint,thesolidwastepermitholdershallbesubjecttothepenaltiesdetailedinSection
10258inadditiontoSections10214.
(d) Ifapartnership,corporationorotherbusinessentitycontrols,directsand/orownsasolidwaste
collectionbusiness,boththepersondirectingtheoperationofsuchbusiness,andallpartners,
directors,officers,shareholders,agents,representativesoremployeesexercisingsignificant
managerialresponsibilityoveranyemployeeoragentwhoseactsviolatethetermsofthisarticleor

(4) Overflowcharge.Anysewerormanholeoverflowtracedtoaninadequatelyoperating
interceptororlackofaninterceptorwillresultinaservicechargetotheuserorthecustomer
forthepropertyonwhichtheuserislocated.Theservicechargeshallincludethecostof
cleaninguptheoverflowandforcleaninggreaseoutoftheimmediatelyadjacentcontaminated
wastewatersystem.Afineinanamountnottoexceed$1,000.00maybeaddedtotheservice
chargeforeachsuccessiveoverflow.Thesechargesandfinesshallnotimpedeother

The water waste ordinance is to encourage the efficient use of outdoor water and the proper
maintenanceofirrigationandplumbingsystems.waterwasteisdefinedinthissectiontomeanthe
unnecessary loss of water through improper application or failure of a plumbing or irrigation system
resultinginexcessiverunoff.Anypersoninviolationofthewaterwasteordinanceshallbesubjecttoan
appropriate penalty outlined in Sec. 122265 for the outdoor water use restrictions. The following
activitieswillbesubjecttoapenalty:
(a) Abrokenirrigationsystem(missingheads,brokenpipes,etc.)
(b) Excessiverunoffwaterrunningdownthedriveway,street,orsidewalk.

(a) Wheneveranyvehicleisremovedbyawreckerserviceatthedirectionofapoliceofficer,thepolice
officershallmakeathoroughinventoryofallequipment,accessories,personalarticlesandother
itemseitherattachedtoorlocatedwithinthevehicle.Theinventoryshallbecompletedonaform
suppliedorapprovedbythepolicedepartment.Thepolicedepartmentshallprovidethewrecker
servicewithacopy.

Sec.12635.Wreckerservicetoholdvehiclesupondirectionofpolice.
Whenspecificallydirectedtodosobythepolicedepartment,thewreckerserviceshallholdvehiclesfor
investigativepurposes,evidence,condemnation,forfeitureoranyotherpurposespermittedbylaw.
Uponthewrittenandsignedauthorizationofthepolicedepartmentonaformprescribedbythepolice
department,thewreckerserviceshallreleaseanyvehiclesoheldtotheowner,hisauthorized
representativeorotherpersonentitledbylawtopossessionofthevehicle.

Sec.12637.Countyimpoundmentfacility.

DIVISION2.ZONESANDZONEHOLDERS

Sec.12653.Zoneassignments;methodofawardingzones.

(b)Noapplicationshallbeprocessedunderthisarticleunlesstheapplicantshallcertifythatthe
applicantcurrentlyownsorleasestheequipmentwhichisdescribedintheMES.Ownershipand
leaseholdinterestsshallbeconsideredascriteriainthehighestrankedselectionprocesshereinafter
provided.IftheapplicantdoesnotcurrentlyownorleasethetowequipmentdescribedintheMES,
theapplicantmustcertifythattheapplicantshall,uponthecommencementdateofthezoneaward,
ownorleasethetowequipmentdescribedintheMES.Iftheapplicantdoesnotcurrentlyownor
leasetowtheequipment,theapplicantshalldeliver,atthetimeofsubmittingtheapplication,a
$5,000.00bond,intheformofcheck,cashormoneyorder,payabletothecounty,andsuch
$5,000.00shallbeforfeitedbytheapplicantiftheapplicantreceivestheawardofazonebut
thereafterfailstocomplywithanyprovisionofthisarticle.Thebondshallbereturnedtothe
applicantuponeitherofthefollowingconditions:

TheapplicantshallcomplywiththetowequipmentspecificationsoftheMESonorbeforetheeffective
dateoftheawardofthezone.Theeffectivedateoftheawardofthezoneshallbethedateofexecution
ofthepermitbythecounty,unlessthepermitprovidesforsomeothereffectivedate.

(d) Assignmentofazoneforazoneholdershallbeforaminimumpermittermoffouryears

weeks.Thenoticeshallspecifywhenapplicationsmustbesubmittedandthegeneralzonearea.
Wreckerserviceswhichareinterestedinbecomingorremainingzoneholdersmaysubmitan
applicationforassignmentasazoneholderforaparticularzone.Theapplicationshall:

(7) Includeaquoteforanendorsementofacombinedsinglelimitnamingthecountyasan
additionalinsuredorprovideacopyoftheendorsementnamingthecountyasanadditional
insuredshowingcompliancewithsection12660.

(f) Thepolicedepartmentshallinvestigateallapplications,suchinvestigationstoinclude,amongother
things,adeterminationthattheapplicanthascompliedwiththerequirementsofthisarticleand
particularlysection12660,andareviewofthedriveroperatingrecordsandanyrecordsof
adjudicationsofguiltofthepersonneltobeemployedbythewreckerservice.Uponcompletionof
suchinvestigation,thedepartmentofpublicsafetyshallnotifytheboardofcommissionersofthe
qualifiedapplicantstobeconsideredforawreckerzone.
(g) TheapplicationsofallapplicantsandtheirQAF,alongwiththeinvestigativefindingsofthepolice
department,willbeforwardedtotheselectioncommittee,whichshallwithintendaysofthereceipt
ofthesame,rankordertheapplicantsforeachzonebasedonthehighestrankedcriteria,which
rankingshallbewithinthesolediscretionoftheselectioncommittee.Theselectioncommitteeshall
forwardthenameofthehighestrankedapplicantforeachzonetothecountydepartmentofpublic
safety,whichshallthenpreparetheappropriatepermitforthevariouszones.
(h) Ifthereisnoqualifiedapplicantforazone,thepolicedepartmentmay,initssolediscretion,select
fromanyotherwisequalifiedapplicantandofferapermittosuchapplicantforsuchzone.In
consideringapplicantsforthezoneforwhichtheydidnotfirstapply,thepolicedepartmentshall
reconsiderfactorsintheQAFwhichmayrequirereevaluationbasedongeographicalorother
aspectswhenconsideringtheapplicantforthezone.
(i) Priortotheeffectivedateofthezonepermit,theselectedapplicantmustprovide,totheCobb
CountyPolicePermitsUnit,avalidcountybusinessregistrationcertificateandreceivethesigned
permitasprovidedinsection12655.Azonepermitmayberevokedifthewreckerservicesuffers
expirationorrevocationofitscountybusinesslicense.

Sec.12654.Duecausefordenialofapplication.
(a) Thedirectorofpublicsafety,ordesignee,shallhaveduecausetofindanapplicantnotqualifieddue
toanyofthefollowingcircumstances:

theapplicant,employees,principalsassociatedwiththeapplicantoranybusinesschangeinstatus
within72hoursofsuchchange,whichchangeshallaffectanyrequirementcontainedinthisarticle.
Failuretocomplywiththisrequirementmayresultintherevocationorsuspensioninaccordance
withsection12656.

Sec.12655.Writtenpermit,limitationonnumberofzonesheld.
Upontheawardofazone,awritten,signedpermitshallbeissuedbythecountytothezoneholderina
formsuppliedbythedepartmentofpublicsafety.Nozoneholdershallhaveapermitformorethanone
zoneforeachzonetype.Thezonepermitwillincorporatebyreferencethetermsandconditionsofthe
QAFandshallbesubjecttotheprovisionsofthisarticle.

Sec.12659.Requirementsforimpoundfacilities;inventory.

(b) ThezoneholdershallprovidetheCobbCountyPoliceDepartmentwithfivestorageareasineach
impoundlotatnochargeforpoliceconfiscatedvehicleswithinvestigativeholds.Thisonlyappliesto
storagefees.Thetowingfeeistheresponsibilityofthevehicleowner.Eachareatobeminimumsize
ofonepassengercar.Thefivenochargestorageareasshallbewithineachimpoundlotinaspecific
areaeasilyaccessibleandmutuallyagreeduponbyCobbCountyPoliceDepartmentandthewrecker
service.
(c) EachzoneholdershallnotifytheCobbCountyPoliceDepartmentPermitsUnitofanydamageor
thefttoavehiclethatwasimpoundedbytheCobbCountyPoliceDepartmentwhichoccurswhile
thevehicleisinthepossessionofthezoneholder.Additionally,thezoneholderwillprovidethe
policereport/casenumberfromanyjurisdictionwheretheincidentwasreported.

Sec.12660.Insurancerequired.
Zoneholdersshallcarryinsurancepoliciesinthebelowlistedamountsindemnifyingthecountyagainst
lossordamageoccasionedbynegligenceormisfeasanceonthepartofthewreckerservice,andnaming
thecountyasanadditionalinsured.Suchpoliciesshallalsoprovideforfullloss,theftordamagebenefits
payabletoanyvehicleorpropertyownersufferingloss,theftordamagewithrespecttoanyvehicleor

CompensationandEmployersLiabilitypoliciesofinsurance.Thismaybesatisfiedbyhaving

134287.DonationDropboxes

Thepurposeofthischapteristoregulatetheplacementofunattendeddonationdropboxes
withinunincorporatedareasofthecounty.Theproceduresandrequirementsofthischapterare
intendedto:promotethecommunityshealth,safety,andwelfarebyregulatingunattendeddonation
boxesforclothingorothersalvageablepersonalproperty;ensurethatunattendeddonationboxesdo
notposeahazardtopedestrianandvehiculartraffic;ensurethatmaterialisnotallowedtoaccumulate
outsideoftheunattendeddonationboxeswhereitcanbescatteredbyadverseweatherconditions,
animalcontactsandhumanactivities;andestablishcriteriathatavoidattractingvermin,unsightliness,
andpublichealthhazards.Donationdropboxesshallbesubjecttothefollowing:
(1) Registrationrequired.
a. Allexistingdonationdropboxeserectedonlandwithinunincorporatedareasofthecounty
shall,within180daysoftheeffectivedateofthisordinance,beregisteredwiththeCommunity
DevelopmentAgency.NewdonationdropboxeserectedinunincorporatedCobbCounty,or
donationdropboxesexistingpriortoFebruary23,2016,thatisrelocatedonanylotwithin
unincorporatedCobbCounty,shallregisterwiththeCommunityDevelopmentAgency.
Registrationofthedonationdropboxesshallbeaccompaniedby:
i. Writtenapprovalfromthepropertyownerconsentingtotheplacementofthedonation
dropbox(es)ontheirproperty.Thisapprovalmustincludethename,physicaladdressand
phonenumberofthepropertyowner;
ii. Asiteplanordrawingdepictingthesize(height,width,andlength)andlocationofanyand
alldonationdropboxeslocatedontheproperty;and
iii. Informationidentifyingtheorganization(s)responsibleformaintenanceandmonetary
proceedsofthedonationdropbox(es),includingaphysicaladdress,contactname,phone
number,andwebsite(ifapplicable)fortheorganization(s).
b. Donationdropboxesnotregisteredwiththecommunitydevelopmentagencywithinthe
prescribedtimeframeshallberemovedattheexpenseofthepropertyowner,andmaybe
subjecttoenforcementandfinespursuanttoSection134287(5).Forthefirstyearofthis
program,staffwillholdinabeyanceanyremovalofdonationdropboxesuntilMarch1,2017to
provideadditionaltimetoeducatedonationdropboxoperatorsandpropertyownersofthe
requirementsofthiscode.
c. Theregistrationofthedonationdropboxshallbevalidforaperiodoffive(5)yearsafterwhich
theowneroroperatorofthedonationdropboxshallberequiredtoreregisterwiththecounty.
(2) Design,locationsafetyandmaintenancerequirements.
a. Donationdropboxesshallnotbeallowedinanyresidentialzoningdistrict,exceptonproperties
foraplacesofworshipallowedasaspecialexemptioninSec.134271(4).
b. Donationdropboxesarepermittedonlyonpropertieswherethereisanactiveprimaryuse.
c. Donationdropboxesshallnotbepermittedonvacantlotsorabandonedproperty.
d. Donationdropboxesmustbeplacedonapavedsurfaceandbelocatedtothesideorrearofthe
lot.ThelocationoftheDonationdropboxesmustmeettheminimumsetbackrequirementsfor
thelotandtheboxesmaynotbeplacedinanyfirelane,loadingzone,driveaislesorcirculation
area.

e. Thedonationdropboxesarenotpermittedtobelocatedinamannerthatobstructsvisibilityat
intersectionspertheCobbCountyDevelopmentStandardsoratanyotherlocationthatmay
causehazardousconditions,constituteathreattopublicsafety,orcreateacondition
detrimentaltosurroundinglanduses.
f. Themaximumsizeforanydonationdropboxshallbefive(5)feetinwidthbyfive(5)feetin
depthandseven(7)feetinheight.
g. Whenmultipledonationdropboxesarelocatedonanindividualproperty,theymustbe
adjacenttooneanother.Whenitisnotfeasibletoplacedonationdropboxesadjacenttoone
another,thentheymustnotbelocatedwithinthesameviewshed.
h. Thetotalallowablenumberofdonationdropboxesdependonbythesizeoftheparcelon
whichthedonationdropboxislocatedwiththefollowinglimitations:
i. Propertyequaltoorlessthanoneacreshallhaveamaximumofonedonationdropbox.
ii. Propertygreaterthanoneacreshallallowonedonationdropboxperacre.
i. Alldonationdropboxesmustbedesignedsothattheyaresecuredfromunauthorizedaccess.
j. Alldonationdropboxesshallhavethefollowingclearlyidentified,inwritingonthefaceofthe
box:
i. SpecificItemsandmaterialsrequestedfordonation,
ii. Informationidentifyingtheorganization(s)responsibleforthemaintenanceandmonetary
proceedsofthedonationdropboxincludingacontactname,phonenumber,andwebsite
fortheorganization(s).
iii. Statementthatnoitemsormaterialsmaybeleftoutsideofthebox
iv. Statementthattheboxisnotintendedforrefusedisposalandliquidsareprohibited.Do
notuseforgarbage,candyorfoodwrappers,drinkbottlesetc.
v. Inadditiontotherequirementsabove,thecountyissuedregistrationstickershallbeaffixed
tothefrontfaceofthedonationdropbox.
k. Eachdonationdropboxmustberegularlyemptiedofitscontentssothatitdoesnotoverflow.
l. Alldonateditemsmustfitandbecontainedinthedonationdropbox.Donateditemsor
materialsshallnotremainorbeallowedoutsideofdonationdropboxesandtheareasaround
eachbox.
m. Theowneroroperatorofthedonationdropbox,aswellasthepropertyowneroftheparcel,
shallberesponsibleformaintainingtheareaaroundeachdonationdropboxsothatitisfreeof
litter,garbage,andanyotherundesirablematerial.
n. Failuretomaintainthedonationdropboxortheareasurroundingthedonationdropboxmay
resultinremovalofthedonationdropbox,attheexpenseofthepropertyownerand/orowner
oroperatorofthedonationdropbox,andthepropertyownerand/orowneroroperatorofthe
donationdropboxshallbeprohibitedfromfuturedonationdropboxesbeingallowedonthis
siteforaperiodoffive(5)years.
o. Thepropertyownermayremovethedonationdropboxfromtheirpropertyatanytime
regardlessofavalidregistrationbythecounty.
(3) Awaiverofthetotalallowablesizeandnumberofdonationdropboxesmayberequestedby
submittingalettertotheCommunityDevelopmentDirector,orhis/herdesignee,thatdemonstrates
compliancewiththefollowingconditions:
a. Thesiteissolelyoccupiedbyapublic,educational,notforprofit,orreligioususeorfacility
b. Thelocation,design,andmaintenanceofthedonationdropbox(es)isotherwisein
conformancewithsubsections134287(2)and134287(3).

a. IfaviolationofChapter134287isdocumented,thepropertyownerand/oroperatorofthe
donationdropboxshallberesponsibleforensuringcompliancewiththeregulationsofthis
section.
b. WiththefirstviolationofChapter134287,thepropertyownerand/oroperatorofthedonation
dropboxshallberequiredprovideawrittenplantotheCommunityDevelopmentAgency
Director,ofhisorherdesignee,toensurefullcompliancewiththeregulationscontainedinthis
sectionwithin5days.Thepropertyownerand/oroperatorofthedonationdropboxshallbe
subjecttoafineofupto$100.00.
c. WiththesecondviolationofChapter134287,thepropertyownerand/oroperatorofthe
donationdropboxshallberequiredtoshowrecordsandlogsforcompliancewithSection134
287(2)and134287(3)andwillberequiredtohireaprivatecompanytoassisttheminongoing
compliancewiththissection.Thepropertyownerand/oroperatorofthedonationdropbox
shallbesubjecttoafineofupto$500.00.
d. WiththethirdoranyadditionalviolationofChapter134287,thepropertyownerand/or
operatorofthedonationdropboxshallberequiredtoremovethedonationdropboxfromthe
propertyattheexpenseofthepropertyownerand/oroperatorofthedonationdropboxwithin
thirty(30)daysofthenoticeofviolation.Thepropertyownershallbesuspendedfromhavinga
donationdropboxatthislocationforaperiodoffive(5)yearsandshallbesuspendedfrom
operatinganynewdonationdropboxesinunincorporatedCobbCountyforaperiodoffive(5)
years.Thepropertyownerand/oroperatorofthedonationdropboxshallbesubjecttoafineof
upto$1,000.00.

134288Temporaryresidentialdumpsters.
(1) Onlyonetemporaryresidentialdumpsterunitmaybeplacedonaresidentialproperty.
(2) Atemporaryresidentialdumpsterunitshallonlybeplacedonahardenedsurfaceandshallbe
locatedatthefurthestpointawayfromthestreet.
(3) Atemporaryresidentialdumpsterunitorsimilarenclosureislimitedto30daysonapropertyduring
any365dayperiodbeginningonthedateoftheplacementoftheunit.

progressingtothesatisfactionofthebuildingofficial.Onlydebrisfromthepermittedconstruction
activityispermittedinatemporaryresidentialdumpster.Innoeventwillthetemporaryresidential
dumpsterunitbeallowedtoremainonapropertyforover180days.Atthetimeofissuanceofa
certificateofoccupancyorletterofcompletiontheremovalofthetemporaryresidentialdumpster
unitwillberequiredwithinfivedaysaftertheissuancedate.Ifnodrivewaywithahardenedsurface
existsonthepropertywhereanewhomeisbeingconstructed,agravelpadshallbeprovidedfor
placementofthetemporaryresidentialdumpstertopreventerosiononthesite.
(7) Incaseswhereahardshipcanbedemonstrated,thedirectorofcommunitydevelopmentmaygrant
anextensiononapropertyfor30days.Onlythree(3)30dayextensionsmaybegrantedata
specificsitebythedirectorofcommunitydevelopment.Anyadditionalrequestforanextension
maybeconsideredbytheboardofcommissionerszoninghearingasanotherbusinessagenda
item.Ahardshipmaybecausedbyanaccidentalorunintentionalfire,flood,naturaldisasteror
othercircumstancespresentedonacasebycasebasisthatcreatesaneedforadditionaltimefor
