JOHNN DOE COMPLAINANT
versus
Driver and Owner of PUJ CVY 843 RESPONDENT/S
C O M PLAI N T
That on or about 6:30 in the morning of June 6, 2016(Monday), in the
jeepney terminal of Concepcion Angeles Transport Service Cooperative in Brgy.
San Nicolas Poblacion, Municipality of Concepcion, the complainant herein,
experienced an ordeal.
The complainant is about to go to his apprenticeship program at the
Regional Trial Court of Angeles City, boarded the above mentioned Public Utility
Jeepney (PUJ) with plate number CVY 843. When the jeepney is about half full,
the complainant, tenders his fare for the amount of P7.00 regular fare in a 20 peso
bill.
The complainant was seated behind the driver and politely started to hand
the fare of other passengers to the driver. 1st to hand by the complainant is an exact
P7.00 fare, next is a 50 peso bill fare for Magalang by other passenger and next
was the complainants 20 peso bill for the fare to Brgy. Santiago in the amount of
P7.00 minimum regular fare.
The sudden swift in the events then followed. The driver then refused to
accept the 20 peso bill of the complainant then the driver said in a loud voice
kuldas ka pa papalit me yang bente mu! , the complainant then politely replied
Bap atin ku pung P6.00 malyari ne pu ba? and then he again replied kuldas
ka pa papalit me yang bente mu! , feeling humiliated and disgraced by the
acts of the driver, the complainant, off boarded the said PUJ.
Events still occurred and the ordeal of the complainant pursues as the
complainant after off board in the said jeepney look for an establishment where he
can replace his 20 peso bill to coins. The complainant proceeded to a bakery which
was infront of the jeepney. The complainant looked at the driver in a smiling face
but the driver replied in an arrogant, discourteous and intimidating face. The

complainant proceeded to the bakery but finds nothing to buy and then the
complainant went to 7/11 store which is about 100 meters away from the jeepney
terminal and bought a small mineral water for his 20 peso bill to be changed into
coins. He boarded another jeepney who is in line at the terminal.
In view of the foregoing acts and omission of the DRIVER constitutes
Unjust Vexation as provided by Art. 387 paragraph 2 of the Revised Penal Code, to
wit;
Any other coercion or unjust vexation shall be punished by arresto
menor or a fine ranging from 5 to 200 pesos, or both.
Similarly in the case of People of the Philippines vs. Orlando Carreon, G.R.
No. L-17920, May 30, 1962
The accused did unjustly vex or annoy the said offended
party. That there was really intention of the accused to vex the
offended party on the night in question.
Therefore, unjust vexation must mean harassing, annoying or causing trouble
without justifiable reasons.
Also as provided in the New Civil Code of the Philippines, Article 19 on
Human Relations, to wit;
Every person must, in the exercise of his rights and in the
performance
of his duties, act with justice, give everyone his due,
and observe
honesty and good faith.
Similarly on Article 21 of the New Civil Code
Any person who wilfully causes loss or injury to another in a
manner
that is contrary to morals, good customs or public policy shall
compensate the latter for the damage.
In the Opinion of LTFRB Board Member Arnel Inton in the complaint of
Mark Buraga vs. El Pueblo Taxi, BM Inton said It is the responsibility of the
driver and operator to readily provide an exchange. At the case at hand, the
complainant is tendering only P20 bill for a P7.00 regular and minimum fare.
Let it be a reminder that a Public Utility Vehicles primordial purpose is to
be OF SERVICE (EMPHASIS SUPPLIED) to the commuting public, secondary
to profit. PUVs thereof and its drivers are expected to be of at most courtesy and

respect at all times REGARDLESS of the socio-economic status or standing in life


of their passengers.
With that it is respectfully prayed to the Concepcion-Angeles Transport
Service Cooperative to WARN the said driver and his operator. With a stern
warning that a repetition of the same would constitue in filing for an
administrative case before the Land Transportation Franchising and Regulatory
Board (LTFRB) with the option and possibility of filing a criminal and civil
complaint against the driver and his operator.
Please be informed that the complainant will closely monitor and observe
such developments. Furthermore, the Concepcion-Angeles Transport Service
Cooperative is reminded that drivers should in the performance of their public
oriented service to the public MUST:
(1) Prepare coins for exchange for its passengers.
(2) OBSERVE THE NO SMOKING POLICY WHILE IN SERVICE.
(3) Drivers should be courtesy and respectful at all times.
(4) As much as possible wear collared shirts for uniform to resemble respect,
authority and uplift the morale and dignity of the drivers.
