Decision No. : 272/G/2014/PTUN-JKT
PT. Dwitunas Mekarwangi (PT.DM)

sebagai pemenang lelang menggugat Biro

Umum, Pemprov DKI Jakarta atas pembatalan proyek pengadaan meubeler senilai Rp 29
miliar di Biro Umum, Pemprov DKI Jakarta di Pengadilan Tata Uasa Negara (PTUN). Dalam
gugatannya disebutkan, proses tender Pengadaan Meubeler Gedung Blok H Balaikota TA2014 miliki Biro Umum Setda Prov DKI Jakarta dengan nilai pagu +29 milyar itu telah
selesai ditenderkan Pokja 1B ULP DKI Jakarta dan menetapkan PT. Dwitunas Mekarwangi
(PT.DM) dengan nilai penawaran +Rp 25 Milyar sebagai pemenang lelang. Penetapan
pemenang lelang itu ditetapkan melalui penerbitan Surat Penetapan Pemenang No. 1138/IBP/PP-PB/2015 tanggal 5 Nopomber 2014. Setelah penetapan pememang lelang, Unit
Layanan pengadaan (ULP) DKI Jakarta menyerahkan hasil lelang yang dibuat pada tanggal
14 Nopember 2014 dan diserahkan ke Biro Umum tanggal 17 Nopember 2014. Dan
ditindaklanjuti Pejabat Pembuat Komitmen (PPK) dengan mengeluarkan Surat Penunjukkan
Penyedia Barang Jasa (SPPBJ) dengan No. 9250/SPPBJ-PPK-BU/XI/2014 tgl 18 Nop 2014.

Namun PT. DM yang berharap harap akan segera memulai pekerjaan karena merasa
sudah mengantongi SPPBJ, tiba tiba satu hari seterimanya SPPBJ itu Kepala Biro Umum
Setdaprov DKI Jakarta, Agustino Darmawan (tergugat) berkirim surat dengan No. 4640/086.41 tgl 19 Nop 2014 ke PT.DM dan menyatakan batal pelaksanaan pekerjaan atas
pertimbangan sepihak waktu tidak mencukupi lagi. Ttindakan Kepala Biro Umum, Sekda
Provinsi DKI Jakarta, telah membawa akibat hukum bagi PT.DM sebagaimana diatur dalam
pasal 1 angka 5 Undang-Undang Nomor 5 Tahun 1986 tentang PTUN jo Pasal 9 angka 1 UU
Nomor 51 tahun 2009, tentang Perubahan Kedua UU Nomor 5 Tahun 1986 tentang PTUN.
Tindakan Kepala Biro Umum, Sekda Provinsi DKI Jakarta tidak mencerminkan asas-asas
umum pemerintahan yang baik (general principle of goverment), maka oleh karenanya PT.
DM mengajukan gugatan tata usaha Negara ke PTUN Jakarta.
Refer to article 1 (7) Pejabat Pembuat Komitmen or called as PPK is the authority
which is liable over the procurement. Furthermore refer to article 1 (22) the party in the
contract of procurement as mentioned in the article are PPK with the provider of good and
services. Therefore PPK is the party and have the consent over the contract. Because the
SPPBJ have been already issued to the provider,so refer to article 85 (1) Perpres No. 4 year
2015, if by point of view of PPK is there is no more problem as mentioned in the alphabet a
until c, the next step is the ratification of the contract. Is letter No. 4640/-086.41 date 19 Nop
2014 KTUN ?
First this letter is used to annul the contract by the defendant purposed for the
claimant. Second this lettter is issued by the defendant as his capacity/position as the public
authority. Therefore it is KTUN. But this KTUN is issued without proper legal standing. The
capacity of the defendant as PA/KPA is limited by the article 83 (3) Perpres No. 4 year 2015.
PA/KPA have no authority to cancel the auction if the auction have already in the step of
SPPBJ issuance. So, i agree if the judge decision is to annul the KTUN regarding the
cancellation of auction because is not the right of PA/KPA to cancel the auction. SO every
conduct of government should be based on legal basist and reflecting the principle of AUPB
or Good Governence Principle.
