Dear Mr. Zernik:

This letter is to confirm we have received your letter of rebuttal filed with the Office of the
Comptroller of the Currency received on, February 1, 2010. I am responding to you on
behalf of the Office of the President. We appreciate your patience as you have waited for
our response whiie investigating your comments.

In your response you request an explanation as to why Union Bank proceeded to close
your loan mortgage account without providing you with notification. Additionally you
request banking records of the respective account to support our response, dated
November 12, 2009.

In response to your concern the Office of the President searched Union Bank's records
and determined the following:
• On December 17, 2007, Union Bank received an incoming wire in the amount of
$769,961.99 from Comerica Bank, and United Title Company. The instructions
provided in the wire indicated funds were to be applied to loan number
001249128, under the name of Joseph Zernik. A payoff notification letter was
generated and mailed to the address on record: 320 S. Peck Dr., Beverly Hills,
CA 90212. The Full Reconveyance was subsequently prepared and mailed to the
Los Angeles County Recorder's office for recording with the above referenced
address used as the "return address" once recorded.
• Enclosed you will find a copy of the wire instructions received from Comerica
Bank, copy of Union Bank's payoff notification letter, and copy of the recorded
Full Reconveyance.

company to determine what bills were paid through closing or
contact our office at the number below. If you are due to
receive a refund, do not wait for these funds to pay your
