DefendantWolfisaCitizenoftheStateofConnecticut.
DefendantWolfCommitteeisacandidatecommitteepoliticalorganizationorganizedunderIRS
527andregisteredwiththeFederalElectionCommission.
JURISDICTIONANDVENUE
ThisCourthaspersonalandsubjectmatterjurisdictionoverthisactionandthepartiespursuant
toN.C.Gen.Stat.175.4and7A240.
VenueisproperintheCourtpursuanttoN.C.Gen.Stat.182.
FACTS
OnSeptember21,2015,PlaintiffandDefendantsenteredintoacontractforgeneralconsulting
ontheAugustWolf2016senatecampaign(theContract).
TheContracttermwasfromSeptember21,2015throughNovember8,2016andwasterminable
atwilluponthirtydayswrittennotice.
OnNovember6,2015,DefendantWolfpaidPlaintiff$18,500bychargingthatamountbycredit
card(thePayment).
ThePaymentrepresentedNovemberconsultingfeesthatweredue,anadvanceontheDecember
andJanuaryconsultingfees,anadvanceoncommissions,andacreditcardfee.
Inexchangeforpaymentinadvance,Plaintiffdiscounteditsmonthlyservicefees.
TheContractrequiredthatDefendantpaya10%feeonlatepayments.
Uponinformationandbelief,DefendantWolfusedhispersonalcreditcardtomakethePayment.

PlaintiffcontinuedtoprovideconsultingservicesinNovemberinrelianceofthePayment.
OnDecember1,2015,DefendantsinformedPlaintifforallythattheywishedtoterminatethe
Contract.
DefendantsagreedthatPlaintiffwouldbeentitledtothePaymentinexchangeforPlaintiffs
agreementtoterminatetheservicesandnotseekadditionalcommissionsforcertaindonations
obtainedthroughthewebsitethatPlaintiffdesignedandmanaged.
OnJanuary9,2016DefendantWolfcausedthecreditcardprocessingcompanytochargeback
thePayment.
ThecreditcardprocessingcompanynowclaimsthatPlaintiffmustpay$18,500forthecharged
backpayment.
Defendant Wolf has contacted Plaintiffs clients and threated them claiming that Plaintiffs
clientsmisappropriatedDefendantWolfsdonorlists.

PlaintiffincorporatesbyreferenceallpreviousparagraphsofthisComplaintasthoughfullyset

ThepartieshadacontractforPlaintifftoprovidegeneralconsultingservicestoDefendantsas
describedabove.
DefendantsacceptedPlaintiffsservices.
Defendantstimetoperformhaspassed.
TheDefendantshavefailedtoperformcausingachargebackofthePaymentasdescribedabove.
PlaintiffshavebeendamagedbyDefendantsbreachinanamounttobedeterminedattrial.

FRAUD
PlaintiffincorporatesbyreferenceallpreviousparagraphsofthisComplaintasthoughfullyset
forthherein.
Defendant Wolf made the Payment with the intention of charging back the payment after
Plaintiffprovidedservices.
Plaintiffreliedonthepayment,andprovidedservicestohisdetriment.
DefendantWolfkneworshouldhaveknownthatthePlaintiffwouldrelyuponthePayment.
ByvirtueofPlaintiffsrelianceithasbeendamaged.
PlaintiffhasbeendamagedbyDefendantsfraudinanamountexceeding$25,000.
COUNTIII:
UNFAIRANDDECEPTIVETRADEPRACTICES
PlaintiffincorporatesbyreferenceallpreviousparagraphsofthisComplaintasthoughfullyset
forthherein.
Atallrelevanttimes,DefendantswereengagedincommerceintheStateofNorthCarolina.
Defendants' actions and conduct as described herein were in or affecting commerce and
constituteunfairordeceptivetradepractices,whichareproscribedbyN.C.Gen.Stat.751.
Defendant'sunfairanddeceptivetradepracticeshavedamagedPlaintiffsinanamountinexcess
of$25,000.
Plaintiffsareentitledtohavetheirdamagestrebledandtorecoverattorneys'fees.

PlaintiffshavebeendamagedbyDefendantsactionsinanamounttobedeterminedattrial.
PRAYERFORJUDGMENT
WHEREFORE,Plaintiffsrespectfullyrequestthefollowingrelief:
ThattheCourtawardPlaintiffcontractdamagesof$20,350;
ThattheCourtawardPlaintiffdamagesintortforfraud;
ThattheCourttreblePlaintiffstortdamagespursuanttoN.C.Gen.Stat.7516;
ThattheCourtawardcostsincludingattorneysfeesincurredherein;
Foratrialbyjuryonallissuessotriable;and
ThattheCourtgrantPlaintiffsanysuchotherandfurtherreliefasjusticemayrequire.
