AFFIDAVIT COMPLAINT
I, Ralph Bayeng, the undersigned Police Officer, Filipino, of legal age,
bonafide member of the Philippine National Police, presently assigned with the
Regional AntiIllegal Drugs Special Operation Task Group/PRO-COR as operative,
with no specific time of tour of duty but could be extended upon the exigency of
police service and after having been duly sworn to in accordance with law do hereby
depose and state the following to wit:
1. That at around 9:00 AM of February 14, 2015, I, the undersigned SOURAIDSOTG operative was briefed and instructed by Chief RAIDSOTG
POLICE SUPT. RANDY PADILLA to conduct a buy bust entrapment
against the suspect - a certain Mr. JUAN TAMAD who was reported to our
office by our male Confidential Informant (CI) who gained the suspects
confidence and confirmed his engagement in the selling of illegal drug
particularly white crystalline substance suspected to be methamphetamine
hydrochloride or shabu and that suspect is looking for prospective buyer
and can dispense at any time his available stuff once contacted;
2. That about 10:00 AM, after planning, our confidential Informant began
contacting the suspect through cellular call, informing him that he found
an interested buyer of his stuff (shabu) and so an agreement was decided
between them specifically the place and time of transaction and that our
Chief RAIDSOTG instructed me to be the poseur buyer in this operation.
3. That the operation was coordinated to PDEA and at about 3:30 pm, I,
together with the CI and my fellow police officers, boarded to unmarked
issued vehicle (L-300 Van) and directly proceeded to Governor Pack
Road, Baguio City particularly at the Philippine Rabbit Bus terminal where
the agreed place of transaction between me, the poseur buyer, and the
suspect will transpire at 4:00 to 5:30 pm.
4. That at about 5:00 PM a Genesis Bus arrived, and a male person having
the description of the suspect as described by the CI alighted with a
female companion wherein they were hand waved by the CI signaling
them to come over to our place. After which, the suspect handed to me a
package and thereafter, I gave him the marked money. I signaled to my
fellow police officers by immediate grabbing the principal suspect,
indicating that the buy bust was materialized. My fellow police officers
rushed to our place and helped in effecting the arrest of both suspects.
P02 Rihanna Chokongwei managed to hold the female suspects hands in

which left hand has still the possession of the buy bust money. Moreover,
during frisking of the male suspect, SPO3 Santi Nobanes was able to
recover another two (2) medium transparent heat sealed plastic sachet
from his right front pocket containing white crystalline substance believed
to be shabu;
5. That the pieces of evidence were photographed and marked at COMPAC
4/BCPO by concern operatives as indicated; I marked EXH-A JCT with
signature, 14 Feb.2015 and SP03 Santi Nobanes marked EXH-B RTF
with signature, 14 Feb. 2015 and EXH-C RTF with signature, 14 Feb.
2015 and P02 Rihanna Chokongwei informed the suspects the nature of
their arrest for violating Art II, Section 5 (sale) and 11 (possession) of R.A.
9165 and also read their Constitutional Rights in Tagalog which they
understood and that same pieces of evidence confiscated from the
suspects were inventoried with the presence of Elected Barangay Official
(Barangay Kagawad Ferlen Lackias), DOJ Representative (Prosecutor
Esther Sagsago) and Media Representative (Ms. Vanessa Palangchao)
and also in the presence of the suspects who were later identified as Mr.
JUAN PONCE, 52 years old, married, businessman, native of Marawi city
and a resident of Urbistondo, Pangasinan and Mrs. MIRIAM TIAGO, 41
years old, single, housewife, native of Marawi City and a resident of
Itogon, Benguet. After which we returned in our office (RAIDSOTG)
located at Camp Bado Dangwa, La Trinidad, Benguet for Documentation
of the Case and that the pieces of evidence were properly turned over to
PNP Crime Laboratory for Qualitative Examination. Likewise, the suspects
were subjected to Medico Legal Examination;
6. That I am executing this affidavit to attest to the truthfulness of the
foregoing facts and to support the PNP/RAIDSOTG complaint against the
suspect in Violation of Article II Sec. 5 of R.A. 9165 and other if there be
any.
IN WITNESS WHEREOF, I have here unto set my hand this 16 th day of
November 2015 in the City of Baguio, Philippines.
