Suit was received by way of assignment on 08.10.2008. Service was completed on 22.01.2009. Issues were framed on 05.06.2009. After recording evidence of plaintiffs witness Des Raj and Deepak Aggarwal, evidence on behalf of plaintiff was closed vide order dated 06.06.2012. Evidence of defendants were not concluded till 16.11.2013 Thereafter, the case was transferred in this court. Subsequently, an application for issuing notice to plaintiff to produce agreement dated 18.04.1991 was filedand said application was disposed of. Subsequently, another application for allowing the defendant to lead secondary evidence was filed. Reply to that very application was filed on 14.05.2014. Thereafter, the present suit remained pending for consideration on the application for allowing the defendant to lead secondary evidence, and the same was put up before me first time on 08.07.2014.
