AFFIDAVIT OF DESISTANCE
I, LEONISA LONASCO-MARGALLO of legal age, Filipino,
married, with residence and postal address at Brgy. Milagrosa, municipality
of Sta. Fe, Leyte after having been sworn to in accordance with law hereby
depose and state the following:
1. I am a complainant against P/CINSP. DELFIN D. SABANAL which complaint was filed
and docketed with the Office of the Ombudsman (for the Military and other Law
Enforcement Offices) as OMB-P-C-14-0253 for Article 282 Revised Penal Code (Grave
Threats) and OMB-P-A-14-0328 for Oppression and Misconduct Prejudicial to the Best
Interest of Service. The respondent has submitted his counter-affidavit and after having
understood the situation and the explanation of the same respondent, I HEREIN
DECIDED TO VOLUNTARILY AND KNOWINGLY EXECUTE THIS AFFIDAVIT OF
DESISTANCE.
2. Truly, I have no cause of action against P/CINSP. DELFIN D. SABANAL as he was at
that time nothing to do with the distribution of any relief. Also, I came to know that the
assistance, specifically, the tarpaulin (tarps) locally known as luna or trapal being
used to cover the damaged roofings of the houses were only very limited and were given
to those who volunteered in the clearing and other urgent works to be done in the
barangay. Aside from me, there were many other more that were not able to avail of the
limited number of tarps. I was just so much insistent at that time considering that the
respondent was a relative of my husband.
3. It was inadvertent mistake and an error on my part to have submitted immediately a
complaint for the very reason that I was not able to avail of the tarp considering that the
husband of the Brgy. Chair is a relative. It was just an immediate reaction but was not
truly thought of and at this time having known the actual situation, it is my intention to
desist from further continuing my complaint. In fact, I was not very much sure of what
was really uttered by the respondent and whether he actually intended to struck me. I just
so resented that I was not given priority again considering that my husband is just a
relative of the respondent.
4. Now I am executing this affidavit of desistance to stop and/ or to discontinue
whatever proceedings or investigation being conducted by reason of erroneous and
inaccurate complaint. By this, it is my intention to forego with the case much so that
the case has caused estranged relation to otherwise good relations with the
respondent. I am executing this affidavit of desistance knowingly and voluntarily.
No favors or amounts were ever given to me for the purpose of executing this
desistance. I am very well aware of the legal consequences to this desistance.
5. I am executing this affidavit to attest the truth of the foregoing.

AFFIDAVIT OF DESISTANCE
I, BABY JOY ABIT BATO of legal age, Filipino, married, with
residence and postal address at Brgy. Milagrosa, municipality of Sta. Fe,
Leyte after having been sworn to in accordance with law hereby depose and
state the following:
1. I executed an affidavit corroborating the complaint of LEONISA L. MARGALLO
against P/CINSP. DELFIN D. SABANAL. I also admit that the complaint filed was
erroneous and was not thought of. It was inadvertently filed as the factual matters stated
on my affidavit were not accurate. I was unsure what was uttered by the respondent and
similarly the statement that respondent struck the complainant. I was just prodded to
testify that such was the incident as I was living on same house with the complainant.
2. Now that I was able to verify and confirm what actually happened, it is my intention
to desist and withdraw the erroneous affidavit and erroneous statements that I have
mentioned therein. I have no intention to malign or to cause any other prejudice to
the respondent as the execution of the affidavit was caused of misinformation and
ill-advice of other persons interested in ruining the good relations.
3. I came to know that not all were able to avail of the tarps known in the local dialect as
trapal or luna as they were very limited. I was just expecting that we will be
prioritized. I accept that priority should be given to those who volunteered to work for the
barangay on the emergency and urgent works. Nonetheless, we were also assisted by the
barangay eventually.
4. My execution of the previous affidavit was imprudent such that I am herein
desisting and withdrawing it. It might otherwise prejudice other persons who have
nothing to do with the matter.
5. I am executing this affidavit to attest the truth of the foregoing.
