Statue Cruises Incident RePort

Date of lncident: FebruarY 6,20L6


Time of lncident: 1:30 pm

Location: North side of Castle Clinton within Battery Park

lncident Details: As one of our Guest Service Managers was returning from lunch he saw a small crowd
gathering by the generator on the northern side of the Castle Clinton walkway. Rene Pagan approached
to assist as he was concerned it was one of our passengers in need of assistance. The scene was chaotic

Michael Monaghan, 71 years old employee of Statue Cruises, LLC. Employed with Statue Cruises,
since 2008 and worked for Circleline prior since 1962.

Statement by Mike Monaghan below:
On my way to work, walking around the path by the carousel and food court

Saw a gentleman trying to sell tickets to the Statue of Liberty to an Asian couple. He was and African
American gentleman with an lD lanyard around his neck and possibly a scanner around hip. He also was

holding brochures in his hand. I went up to them and told the Asian couple not to buy tickets from that
gentleman. I told them our company (Statue Cruises) is the only company with the right to sell tickets to
the Statue of Liberty and if you buy tickets from him you won't get to Liberty lsland since only our
company can take you there and our ticket booth is just over here. I then turned to the guy trying to
sell the tickets and told him you know you're not supposed to sell tickets here in the park.
The guy trying to sell tickets then said to me "Shut up. lf you keep talking l'll punch you in the head." As
I started to walk away the guy pushed me from behind and I fell forward on my right side. I fell on my
whole right side, injuring my right hand in the fall, it was bleeding, and now my right shoulder is sore.

After the push, the guy left and the Asian couple came back to make sure I was ok.

named Marvin) and a K9 officer walked around the park with me but we could not find the guy who
pushed me. We walked all the way to the front of the Sl Ferry building. Officers had me write out a
statement and said they would fill out a report.
