JUDICIAL AFFIDAVIT
OF NELZON D. HUMIWAT

I, NELZON D. HUMIWAT, of legal age, single and resident of

Solano, Nueva Vizcaya, after having been duly sworn to in
accordance with law do hereby depose and state that :
The lawyer who conducted my examination as a witness is
Atty. NELZA MAE D. HUMIWAT of Solano, Nueva Vizcaya, and
that the examination is done in her office located at Quirino St.,
Bayombong Nueva Vizcaya. I answered her questions fully
conscious that I did so under oath and that I may face criminal
liability for false testimony or perjury.
Atty. H: Please state your name, age, and other personal
circumstances.
A I am NELZON D. HUMIWAT, Filipino citizen of legal age,
single and a resident of Solano,Nueva Vizcaya.
Q What is your occupation or profession, if any?
A I am a resident physician at the Veterans Regional Hospital.
Q Please state your educational background leading to your
current profession.
A I graduated at Saint Louis University with the Degree of
Bachelor of Science in Biology in the year 1980. A year after, I

entered medical school in the same university, finished the course

in the year 1984 and passed the board examination in 1985.
Q What was your rating when you took up the medical board
exam?
A I got a rating of 80%.
Q After passing the board exam did you immediately look for
employment?
A After taking my oath as a physician, I joined as volunteer
doctor for medical missions at Veterans Regional Hospital in
Bayombong, Nueva Vizcaya.
A-For how long did you serve as volunteer physician in that
hospital?
Q- 2 years and 7 months.
Q After those years as a volunteer, did you seek for employment
in that hospital?
A Yes, after two years I serve as a resident physician for eight
(8) years.
Q Thereafter, what did you do?
A I specialized as a surgeon.
Q And for how long did you train as a surgeon?
A For four (4) years.
Q After your training as a surgeon, what did you do?
A I served at the hospital as a surgeon continuously up to the
present.
Q Did you receive a subpoena to testify in this case?
A Yes.
Q Do you have a copy of that subpoena you received?
A Yes. I have here a copy of the subpoena.
Atty. H: With this judicial affidavit as Exhibit A for the
prosecution the copy of the subpoena is marked as Exhibit B for
the prosecution.
Q- Do you know Alvin Obedoza?
A-Yes.
Q-How did you know him?

A-I was the one who examined the victim.

Q I have a copy of the post mortem examination of the cadaver
of the deceased and it shows that this report with the report no.
A-090-2011 signed by one doctor Humiwat. Are you the same
doctor Humiwat who operated the victim?
A Yes, I was the one who operated the hacking wound of the
victim.
Q-How can you tell that it was a hacking wound?
A-By physical examination.
Q- What does this particular report reveal?
A-The findings shows that the cadaver is in advance state of
decomposition. The whole body is bloated; the skin is slipping off,
with dead maggots seen on the surface of the body. The multiple
hacking injuries found on the different parts of the victims body
together with the amputation of his right thumb and 2 nd finger
shows the violent manner causing his death.
Q-So, what does this imply?
A-That it is a violent manner of death.
Q You indicated in this certificate your finding that the deceased
died due to multiple hacking injuries. What could have caused the
hacking wound on the cadaver of the victim?
A It could have been caused by a sharp pointed double-bladed
object.
Q Why do you say that the stab wound was caused by a sharp
pointed object?
A Because of the depth and the width of stab wound that could
have cause the death.
Q How many cases of the same nature have you attended to
while in the practice of your profession?
A I attended more than hundreds of cases.
Q Kindly go over the contents of this judicial affidavit dated
October 17, 2015. Do you confirm and affirm the authenticity and
due execution as well as the truthfulness of the contents of your
affidavit?
A Yes. I am executing this Judicial Affidavit to attest to the truth
of the foregoing facts and to serve as my direct testimony in
connection with this case. I likewise warrant that the copies and

reproduction attached to my Judicial Affidavit are faithful copies or

reproductions of the originals.

2. I faithfully recorded or caused to be recorded the
questions I asked of him and his corresponding answers to the
questions; that I or any other person or persons then present or
assisting him did not coach him of his answers.
