Specifically, your request stated: 1am requesting documents relating to investigation O-JS-14-0155-S "Alleged Theft of ‘Two NASA Spacesuits." I am requesting any and all memos and correspondence sent within the office of the inspector general regarding this investigation, as well as any correspondence sent between the office of the inspector general, subjects of the investigation, and other Federal agencies. [ am also requesting the Office of General Counsel report about the suits' possible ownership. Documents fitting the description of your request are attached. Certain names and other identifying information have been redacted from the document pursuant to FOIA exemption (b)(6), which protects from disclosure information which would constitute a clearly unwarranted invasion of personal privacy, and FOIA exemption (b\(7)(C), which relates to records compiled for law enforcement purposes which could reasonably be expected to constitute ‘an unwarranted invasion of personal privacy. We also invoke exemption (b)(7)(D), which protects the identities of confidential sources of information. For your information, Congress excluded three discrete categories of law enforcement and national security records from the requirements of the FOIA. See 5 U.S.C. § 552(c) (2006 & Supp. IV (2010). This response is limited to those records that are subject to the requirements of the FOIA. ‘This is a standard notification that is given to all our requesters and should not be taken as an indication that excluded records do, or do not, exist. You have the right to appeal this initial determination to the Inspector General. Under 14 CFR §1206.605(b), the appeal must (1) be in writing; (2) be addressed to the Deputy Inspector General, NASA Headquarters, Washington, DC 20546; (3) be identified clearly on the envelope and in the letter as an “Appeal under the Freedom of Information Act”; (4) include a copy of the request for the Agency record and a copy of the adverse initial determination; (5) to the extent possible, state the reasons why the requester believes the adverse initial determination should be reversed; and (6) be sent to the Inspector General within 30 calendar days of the date of receipt of the initial determination. Upon review of Bonhams’ catalog “The Space History Sale” scheduled for April 8, 2014, in New York, information surrounding the Mercury spacesuit was under Item 56 “Mercury Era Spacesuit” (Attachment 2). Also identified was an additional spacesuit in the catalog, detailed under Item 57 “NASA AGL Prototype Spacesuit,” as possibly being NASA property (Attachment 3), Investigation will determine if the spacesuits in question are U.S. Government property.
