DEMAND LETTER
I, LOTUZ M. ESCANDOR ET AL, am the legal owner of a two-storey house located
at 132 Martinez St., Maypajo, Caloocan City, under tax declaration 04-028-0038910-R, where your children is currently occupying, without my knowledge and
consent; particularly the room at the ground floor, which is part and parcel of the said
building and/or improvement.
You claim right over the subject property being collateral used as security for the
payment of debt amounting to thirty thousand pesos (P30,000.00) which was
contracted on 24 August 2015 between you and my cousin, Mr. Leo F. Bucao,
before the Barangay Council of Barangay 27, Caloocan City.
Please be advised, that my cousin, Mr. Leo F. Bucao is not the legal owner of the
subject property and does not possess any legal right or any authority whatsoever, to
convey, sell, lease, encumber or mortgage the same, but was only allowed to
temporarily reside therein out of compassion. Hence, the contracted loan agreement
subjecting my property as security is void, inexistent and/or not legally binding.
Repeated demands were made for you to vacate the premises but you failed and
refused and still fails and refuses to vacate the same to my damage and prejudice. I
even made an attempt to settle the matter amicably by filing a complaint before the
Barangay Council of Barangay 27 for unlawfully depriving me of the peaceful
possession and enjoyment of my house. However, no amicable settlement was
reached since you disregarded the initial notice sent by the Barangay and even
ignored the scheduled meetings/dialogues before the Lupon. Needless to say, that
earnest efforts were done to settle this matter amicably, but the same have been
futile.
Pursuant to law, your continued occupation is unlawful and I hereby formally
DEMANDS THAT YOU VACATE the premises immediately. If you do not leave, your
continued occupancy will be construed as willful and in bad faith; and I will be
constrained to initiate eviction action with damages against you without further
notice.
This is a serious matter that needs your utmost preferential attention and
consideration so that availment of other avenues or legal forums for relief would no
longer be a necessity.
