Arrest 15-19439

On Monday, September 14, 2015, at approximately 3:50 p.m., I was sitting at my desk and
someone (not certain who) brought in a parent (specifically a father) to sit and wait for his
son, who had been arrested. A little while after the parent was brought in Officer Howman
came to talk to him. Officer Howman proceeded to tell the father that his son had been
arrested for a hoax bomb, and that he was being fingerprinted and then he would be
released to him. Before she could complete the rest of what she was saying the father
asked her if he could see his son. She told him no, that his son was being fingerprinted and
processed. Officer Howman also told him that his tablet and flash drive had been
confiscated. He then asked her what a hoax bomb was and she tried to explain it to him.

The father started speaking over her and told her that his son was just very smart and he
was just trying to impress his teachers. He stated that his son had been in a robotics club at
his middle school and he used to make things like this. She again tried to explain to him the
incident that happened at school and why he was arrested and that he was being
fingerprinted and would be released to go with him afterwards. He once again started
talking over her and at this point she told him that since he was not going to allow her to
speak that she was done talking. I saw that he was not going to allow her to finish talking
and I felt that a supervisor was needed, so I called Sgt. Jeff Mitchell to come and help her
out.

Sgt. Mitchell came and Officer Howman was still trying to explain things to the parent. The
father was still talking over Officer Howman, so after Sgt. Mitchell listened to her trying to
explain and the father still not listening he intervened. He introduced himself and
proceeded to explain to the father the same as Officer Howman had. He told him his son
had been arrested for hoax bomb at school and he was being processed and then he
would be released to him. Sgt. Mitchell repeated this information a couple of times. The
fathers phone then rang and he told Sgt. Mitchell that it was his wife that she was on her
way in. Right after that his wife and daughter walked by the CSD window going into the
building. They were allowed into the Community Services Office. Once the mother and

daughter came in, they sat down alongside the father. Sgt. Mitchell proceeded to tell them
the circumstances. As he was telling them, the daughter started talking in their native
language and the father explained that the mother did not speak English so she was
translating for her. After Sgt. Mitchell told them the circumstances that daughter began to
ask why was he arrested and not just talked to and let go and she started making comments
that it was racism. Sgt. Mitchell was telling them that it was not a matter of race and that if
it had been a white, brown, or black person, they would have been handled the same way.
He told them it was just a matter of him having a hoax bomb at the school and that was
not allowed. Sgt. Mitchell then told all of them the same thing he had told the father
earlier that the son was being processed and that afterwards he would be released to them
to go home.

The father then asked if he could talk to his son, to which Sgt. Mitchell told him once he is
released that he could take him with him. The father then said no, that he wanted to talk to
him before he was released to see what his story was. Sgt. Mitchell once again told him
that he would be free to take him with him once they brought him from being processed.
To this the father said no, leave him, I dont want to take him. (Sometime during this
conversation the father, mother, and daughter had all gotten out of their seats and were
standing). Sgt. Mitchell then replied to the father, if you dont take him we are going to
take him to Juvenile Detention. The daughter then spoke to her father. Sgt. Mitchell said to
the father, so let me see if I have this right you dont want to take him, because if you dont
we are going to take him to Juvenile Detention. At that point Officer Taylor walked in with
the son handcuffed. The son walked over to where the father was standing and the father
started to question his son about what happened. More talking went on, but I am not
certain what was said. Then Officer Taylor took the defendants handcuffs off and he was
released to his parents. They were all escorted out the main door to the Community
Services Division.

A few minutes later Records Clerk Christina Anguiano came over and told Sgt. Mitchell that
they had come back in and the boy was demanding to get his tablet and flash drive back.
Sgt. Mitchell told her that they could not have them that they were in being held as
evidence. She went back into Records to tell them what Sgt. Mitchell said about the items.
Maria Gonzalez then came over and told Sgt. Mitchell that he was upset so Sgt. Mitchell and
Officer Taylor went into the area in front of Records to talk to the family. I walked over to
the door to listen. Sgt. Mitchell told them that they could not get the items back because
they were being held as evidence and when they are done with them then they will release
them back to him. The daughter started saying that this was all just racist, it was because
they are Muslim. The conversation went back and forth, and Im not certain what else was
said. I then walked back to my desk.
