Dear Judge Vitaliano:

The government respectfully submits this letter in response to Anthony
Christians motion for purported Brady material (Docket Entry No 443). As explained
below, the motion should be denied because the purported Brady material was provided to
the defense in advance of trial, and, in any event, that material is not exculpatory.
Relevant Background
As the Court is aware, on October 27, 2014, at the conclusion of trial, Anthony
Christian was convicted of crimes including the murder of Jerome Estella, also known as
Boo Boo, in aid of racketeering, in violation of 18 U.S.C. 1959(a). (Docket Entry No.
393 at 8.) The conviction was based in part on the testimony of cooperating witnesses Brian
Humphreys and Paul Ford. Humphreys testified, in substance and in part, that Anthony
Christian and Ford ordered him to murder Corey Brooker, also known as Shank Bank, and
that in the course of carrying out that order, Humphreys shot and killed Brookers close
associate Estella, with the approval of Anthony Christian and using a gun provided by
Anthony Christian for that specific purpose. Ford testified, in substance and in part, that
Anthony Christian ordered Humphreys to murder Brooker, which order Ford approved.
Discussion
In his motion, Anthony Christian asserts that Humphreys was interviewed by
the FBI and quoted extensively concerning th[e] allegation that Estella was killed at the
instruction of member/s of the Wu Tang Clan, a rap group, as revenge for robberies
committed by Estella and Cor[e]y B[r]ooker, aka Shank Bank, and not, as charged, by
order of . . . Anthony Christian. (Docket Entry No 443 at 1.) The basis for this assertion is
a Federal Bureau of Investigation (FBI) response to a Freedom of Information Act request
(FOIA and the FOIA Response, respectively). (Id.) Contrary to this assertion, however,
information about the possible role of the Wu Tang Clan in the Estella murder was in fact
disclosed to the defense prior to trial. In addition, that information is not exculpatory
I.
Legal Standards
In Brady v. Maryland, 373 U.S. 83, 87 (1963), the Supreme Court held that
the suppression by the prosecution of evidence favorable to an accused . . . violates due
process where the evidence is material either to guilt or to punishment, irrespective of the
good faith or bad faith of the prosecution. A Brady claim has three elements: [1] The
evidence at issue must be favorable to the accused, . . . [2] that evidence must have been
suppressed by the State, . . . and [3] prejudice must have ensued. Strickler v. Greene, 527
U.S. 263, 281 (1999).
To be suppressed for purposes of Brady, information must be known to the
prosecution, but unknown to the defense. United States v. Agurs, 427 U.S. 97, 103 (1976);
see also United States v. Ruggiero, 472 F.2d 599, 604 (2d Cir. 1973) (any allegation of
suppression boils down to an assessment of what the State knows at trial in comparison to the
knowledge held by the defense). Evidence is not suppressed if the defendant either
knew, . . . or should have known, . . . of the essential facts permitting him to take advantage
of any exculpatory evidence. United States v. LeRoy, 687 F.2d 610, 618 (2d Cir. 1982); see
also United States v. Esposito, 834 F.2d 272, 275-76 (2d Cir. 1987) (defense counsel had
possession of transcripts containing exculpatory material before trial). Where the defense
knows the identity of a witness with exculpatory information, it is ordinarily on notice of the
substance of the witnesss potential testimony. United States v. Zagari, 111 F.3d 307, 320
(2d Cir. 1997) (no suppression of Brady information where defendant knew of witnesses who
could testify about insanity of government witness); United States v. Salerno, 868 F.2d 524,
542 (2d Cir. 1989) (government satisfied its obligations by informing defense that it might
want to interview witness); LeRoy, 687 F.2d at 618 (government satisfied its obligations by
informing defense of identity of witness who gave exculpatory testimony in grand jury).
The prosecutions disclosure obligation under Brady extends only to
information that is material. Agurs, 427 U.S. at 108; United States v. Coppa, 267 F.3d
132, 142 (2d Cir. 2001); United States v. Payne, 63 F.3d 1200, 1209 (2d Cir. 1995). Where
the undisclosed evidence does not show the falsity of evidence offered by the government,
the test for materiality is whether there is a reasonable probability that, had the evidence
been disclosed to the defense, the result of the proceeding would have been different.
United States v. Bagley, 473 U.S. 667, 682 (1985). The reasonable probability standard is
satisfied when the suppression of evidence undermines confidence in the outcome of the
trial. Id. at 678; see also Payne, 63 F.3d at 1209.
A Brady disclosure is timely if the defense has an opportunity to make
effective use of the information at trial. Coppa, 267 F.3d at 135; Leka v. Portuondo, 257
F.3d 89, 100 (2d Cir. 2001). [A] disclosure made on the eve of trial (or after trial has
begun) may be insufficient unless it is fuller and more thorough than may have been required
if the disclosure had been made at an earlier stage. Leka, 257 F.3d at 101. However,
disclosures made in advance of trial, even very shortly before trial, are generally deemed
timely. See, e.g., United States v. Douglas, 525 F.3d 225, 245-46 (2d Cir. 2008) (no
suppression where documents were turned over one business day before trial as part of 290
pages of 3500 material and documents were easily found and fathomed); United States
v. Rittweger, 524 F.3d 171, 182 (2d Cir. 2008) (although governments disclosure of
exculpatory information the week of trial was troublesome, no Brady violation occurred
where defense made effective use of information at trial). In addition, impeachment
information regarding government witnesses generally need not be disclosed before trial,
United States v. Nixon, 418 U.S. 683, 701 (1974), although pretrial disclosure can be
advantageous, United States v. Rodriguez, 496 F.3d 221, 228 n.6 (2d Cir. 2007).
II.
Application
The motion should be denied because the purported Brady information (1) was
in fact provided to the defense prior to trial, and (2) is not exculpatory.
A.
The Purported Brady Information Was Provided to the Defense
The defense has advised that it has not seen the FOIA Response that is the
basis for its motion. A copy is attached as Exhibit A. A portion of the FOIA response
includes summaries of statements made by Humphreys. However, the information in those
portions was turned over to the defense within documents produced pursuant to 18 U.S.C.
3500 (3500 Material). In other words, the FOIA response does not contain reports of
interviews of Humphreys beyond those provided to the defense prior to trial in this case.
More specifically, two reports included in the FOIA response appear relevant
to the instant motion. First, a report dated August 4, 1999, stated in part as follows:
On 6/20/99 the Staten Island Homicide Detectives arrested
[REDACTED] for the murder of JEROME ESTRELLA [sic],
aka Boo Boo. [REDACTED] confessed to this murder and in
his written confession indicated that he was an enforcer who had
shot and possibly killed 5 other individuals. During his
confession [REDACTED] indicated that [REDACTED] had
also participated in the shooting of ESTRELLA.
[REDACTED]. According to the Detectives the [REDACTED]
are members of the Bloods Gang and are involved in the drug

trafficking business in the Park Hill section of Staten Island,

New York. The [REDACTED] and the WTC are
[REDACTED] in the Park Hill area of Staten Island. It is
believed that the [REDACTED] sometimes carry out
enforcement actions for the WTC which include beatings,
shootings, and murder. [REDACTED] told the Detectives that
he wants to make a deal with the Federal authorities and is
willing to cooperate with the Feds only. It is likely that
[REDACTED] can provide valuable information about past and
current activities of the WTC as well as the [REDACTED].
(Ex. A at 6-7.) The FBI has advised and the 3500 Material produced in this case confirms
that the individual described as having been arrested on June 20, 1999, and having
confessed to the Estella murder was, in fact, Humphreys. 1
Another report, dated August 24, 1999, also in included in the FOIA response,
contained the following passage:
[REDACTED] is also the subject in the unsolved homicide of
[REDACTED]. It is believed that this homicide was ordered by
members of the WU TANG CLAN as retaliation for
[REDACTED] robbing an associate of the WU TANG CLAN.
(Ex. A at 8.) The FBI has advised that the first sentence in this passage refers to Humphreys
being the subject of the Estella homicide, and the second sentence reflects the FBIs belief
that Estella may have been murdered in retaliation for robbing an associate of the Wu Tang
Clan.
This belief was reflected in the 3500 Material produced prior to trial in this
case, including in 3500 Material for Humphreys. 2 For example, the 3500 Material for
Humphreys included the following passage:
A couple of weeks before the BOO BOO shooting, UNCLES
told HUMPHREYS about a Blood named BOO BOO who just
came home from jail. He stated that BOO BOO had robbed

RZAs little brother and had also gotten into something with the
CHRISTIAN brothers. HUMPHREYS spoke to NITTY who
said the kid pulled out a gun on him and tried to rob a worker of
the CHRISTIAN brothers. JAMES CHRISTIAN was very
upset and wanted to take care of the kid himself but UNCLES
told him to leave it alone. . . .
UNCLES was talking about BOO BOO and said that he had just
come home and robbed RZAs brother and that they would
likely come after him for that. HUMPHREYS believes
UNCLES was referring to members of WU TANG.
(3500-BH-14 (Ex. B) at 3, 6. 3) By way of background, RZA is the nickname of a
prominent member of the Wu Tang Clan. Therefore, this passage provided the defense with
notice that Estella (Boo Boo) may have been targeted for murder because of his role in
robbing a Wu Tang Clan associate, in addition to making clear that this information was
provided by Humphreys.
The 3500 Material for Humphreys also included the following passage, which
similarly provided notice of the purported Brady information:
Before HUMPHREYS was arrested, Uncles [i.e., Ford] often
talked about Shank Bank. He believed that Shank Bank was the
one who had the Bloods rob Rzas brother and he would find
himself dead soon. . . .
(3500-BH-16 (Ex. C) at 4.) In this passage, the defense was put on notice that not only
Jerome Estella but also Corey Brooker (Shank Bank) Estellas close associate, and the
original target whom Humphreys was ordered to murder may have been targeted for
murder because he had robbed a Wu Tang Clan associate, and that this information was
provided by Humphreys.
In addition, the 3500 Material for Humphreys contained the following
passage:
[Humphreys] was told by UNCLES that RZAs younger brother
had a chain stolen.
SHANK BANK owed money to the guy who sold t-shirts on
Targee Street. This guy rented cars for SHANK BANK and
others. It is also possible that he hustled for UNCLES at one

time. SHANK BANK pulled out a gun and threatened to shoot

him. The guy had his daughter with him. The CHRISTIAN
brothers were there and NITTY [i.e., Anthony Christian] said it
was a good thing that he talked SHANK BANK out of shooting
him.
UNCLES may have told HUMPHREYS that the guy was
related to RZA or someone important. The CHRISTIAN
brothers also told of problems they were having with SHANK
BANK and that he was moving in on their territory and forming
different sets in his gang. BOO BOO was a part of SHANK
BANKs group. SHANK BANK was their boss and gave
orders. This information was provided by the CHRISTIAN
brothers as well as UNCLES. HUMPHREYS talked to
UNCLES about SHANK BANK about two (2) weeks before the
BOO BOO shooting, in the beginning of June. UNCLES
specifically mentioned SHANK BANK may have been trying to
take over a building in Stapleton and one of his workers was
selling near a building where UNCLES was also making money
selling drugs. A worker for SHANK BANK was confronted.
UNCLES told HUMPHREYS that a chain was snatched from
RZAs younger brother. SHANK BANK and another Blood
member committed the robbery. RZA and UNCLES knew one
another and talked since UNCLES was a best friend of POWER.
HUMPHREYS met RZA on three (3) or four (4) occasions.
UNCLES said that there would be repercussions and suggested
they would come after SHANK BANK.
(3500-BH-20 (Ex. D) at 1.) Again, this passage provided notice of the purported Brady
information information indicating that Brooker and/or Estella had robbed Wu Tang Clan
associates, and that there would be repercussions and made clear that Humphreys
provided that information.
Similarly, the 3500 Material for Paul Ford also indicated that Brooker had
robbed associates of the Wu Tang Clan. Although the 3500 Material for Ford post-dates the
reports in the FOIA response (because Ford began proffering in 2011), it nevertheless served
to provide the defense with the purported Brady information prior to trial. For example, one
report about Fords statements contained the following passage:
At a second meeting between ANTHONY, HUMPHRIES, and
FORD, ANTHONY advised that SHANK BANK had robbed
the RZAS brother. ANTHONY stated again that SHANK
BANK was a problem. FORD recalled that this meeting
occurred at 55 Bowen Street. FORD believed that upon hearing
that SHANK BANK had robbed RZAS brother, HUMPHRIES

wanted to show what he was capable of doing. FORD further
offered that HUMPHRIES was feeding into whatever
information ANTHONY was providing him. FORD explained
that ANTHONY told him about SHANK BANK because of the
drug business implications.
(3500-PF-5 (Ex. E) at 3.) In this passage, Ford made clear that Anthony Christian had
accused Brooker of robbing a Wu Tang Clan associate (RZAs brother), and that this may
have been part of the motivation for Anthony Christian to order Humphreys to murder
Brooker and for Humphreys to agree to do so.
Another report about Ford contained the following, similar passage:
FORD, ANTHONY CHRISTIAN, and TREVOR (known to this
investigation as BRIAN HUMPHRIES) were present for a
meeting in front of 141 Park Hill. At this meeting, FORD
learned from CHRISTIAN that RAEKWONS cousin, RICO,
had been robbed by SHANK BANK. FORD, CHRISTIAN, and
HUMPHRIES were also present for at a second meeting at 55
Bowen Street, Staten Island, where FORD advised CHRISTIAN
and HUMPHRIES that there was a $30,000.00 contract out on
SHANK BANK for robbing NINE PRINCE, the brother of
RZA. FORD advised that he heard from [OLLIE] GRANT that
RZA had issued the contract and wanted SHANK BANK killed.
FORD opined that the contract was one of the reasons that
HUMPHRIES wanted to go after SHANK BANK.
(3500-PF-7 (Ex. F) at 2.) By way of background, Raekwon is, like RZA, a prominent
member of the Wu Tang Clan, and this passage indicated that Anthony Christian had accused
Brooker of robbing Raekwons cousin. In addition, this passage again indicated that
Anthony Christian had accused Brooker of robbing RZAs brother, and that this may have
been part of the motivation for Anthony Christian to order Humphreys to murder Brooker
and for Humphreys to agree to do so.
Later in that same report, Ford provided the following information about the
murder of Brooker, which, as the Court will recall, occurred after the Estella murder and was
not charged against any defendants in this case:
FORD stated that he had previously heard that SHANK BANK
was killed by PHIFE (ph). FORD believes that PHIFE collected
money from RZA for executing the hit. FORD recalled that
PHIFE met with FATIMA LNU and JIHAD NFI in Virginia
and advised them about his receipt of the money from RZA for
the killing of SHANK BANK. . . . FORD explained that even
though PHIFE was close with SHANK BANK, he held SHANK

BANK responsible for the death of BOO-BOO believing that if

it was not for the problem SHANK BANK had with RZA,
BOO-BOO would still be alive. . . .
After both the SHANK BANK and BOO-BOO homicides,
FORD advised GRANT of what had happened. GRANT related
to FORD that what happened was supposed to happen.
GRANT continued stating that it was what RZA wanted done.
(Id. at 3-4.) In this passage, Ford advised that Brooker who died after the Estella murder
was murdered by a person hired by RZA, i.e., by a Wu Tang Clan associate, and that Estella
may have been murdered as a result of a dispute between Brooker and RZA. This is
precisely the sort of purported Brady information that, in the instant motion, Anthony
Christian wrongly asserts was not provided to him.
In another report contained within the 3500 Material for Ford, Ford provided
the following information:
FORD first met with ANTHONY CHRISTIAN and TREVOR
(known to this investigation as BRIAN HUMPHRIES)
subsequent to the robbery of RICO. This meeting took place on
Targee Street. At a subsequent meeting with CHRISTIAN and
TREVOR, it was discussed that NINE-PRINCE, the brother of
RZA, was robbed. CHRISTIAN also discussed that he had a
problem with SHANK BANK and wanted him to go to which
FORD advised him to go handle his business. CHEPPE (ph)
and CONVICT were in the vicinity of this meeting. FORD
stated that he had already learned from GRANT that NINEPRINCE had been robbed and that there was a contract offered
for the life of SHANK BANK.
(3500-PF-9 (Ex.G) at 2-3.) Again, this report indicates that the conspiracy to murder
Brooker may have been related to the robberies of Rico (Raekwons cousin) and Nine-Prince
(RZAs brother), two associates of the Wu Tang Clan.
Because the purported Brady information sought in the instant motion was in
fact provided to the defense prior to trial, the motion should be denied. Douglas, 525 F.3d at
245-46; LeRoy, 687 F.2d at 618.
B.
The Purported Brady Information Is Not Exculpatory
In addition, the motion should be denied because the purported Brady

information is not even exculpatory. As noted above, the information in the FOIA response
was based on interviews of Humphreys, and similar information was also provided by Ford.
However, both of those witnesses stated in the very reports containing the purported Brady
material that Anthony Christian ordered the murder of Corey Brooker and/or described the

motive and background underlying that order. (See 3500-BH-14 (Ex. B) at 9

(HUMPHREYS talked to NITTY [i.e., Anthony Christian] and JAMES near 55 Bowen
Street. NITTY was saying, Time for BOO BOO to go.); 3500-BH-16 (Ex. C) at 3; 3500BH-20 (Ex. D) at 2; 3500-PF-5 (Ex. E) at 2-3 (Anthony Christian said that Brooker was a
problem and might have to go; in a later meeting, FORD stated that ANTHONY knew it
was ok to kill SHANK BANK because FORD did not tell ANTHONY not to do it. At the
conclusion of the meeting, FORD told ANTHONY to go handle your business.); 3500-PF7 (Ex. F) at 3 (Shortly after the BOO-BOO homicide, FORD spoke to [ANTHONY]
CHRISTIAN inside of 55 Bowen and inquired why BOO-BOO had been shot. CHRISTIAN
explained that HUMPHRIES while looking for SHANK BANK confronted BOO-BOO.);
3500-PF-9 (Ex. G) at 2([ANTHONY] CHRISTIAN also discussed that he had a problem
with SHANK BANK and wanted him to go to which FORD advised him to go handle his
business.).) Indeed, Humphreys and Ford both believed that Brookers robberies of Wu
Tang Clan associates formed part of Anthony Christians motivation for ordering that
murder. 4 The purported Brady information is therefore inculpatory, not exculpatory, and the
motion should be denied in that basis as well. Strickler, 527 U.S. at 281 (for a Brady claim
to succeed, [t]he evidence at issue must be favorable to the accused, . . . and prejudice must
have ensued); Bagley, 473 U.S. at 678, 682 (the materiality test is whether there is a
reasonable probability that, had the evidence been disclosed to the defense, the result of the
proceeding would have been different, and that standard is satisfied only when the
suppression of evidence undermines confidence in the outcome of the trial).
As noted above, Ford stated that Brooker was later killed by Phife, who was
paid by RZA, but Ford believed correctly that the Brooker murder occurred after Estella
was murdered, and, therefore, after Anthony Christian had ordered Humphreys to murder
Brooker. (3500-PF-7 (Ex. F) at 3-4.) In other words, Ford believed that Anthony Christian
and RZA had each ordered someone to murder Brooker, not that RZA had ordered that
murder to the exclusion of Anthony Christian.
Conclusion
For the foregoing reasons, the government respectfully submits that the motion
should be denied.

attempted murder and held Combs' gir!J'riend,
Bronx-born pop diva Jennifer Lopez, for ' more than
12 hours after the 2:50 a.m. shooting.
Combs, the recording star and Hamptons .socialite,

and Lopez, the actress-singer, were pulled over in a
1999 Lincoln Navigator alter they ran 11 red lights
in the minutes after the shooting at ClubNY on West
43rd Street, police said.
Police found a 9-mm. handgun under the passenger's seat of the Navigator, which was registered to
Combs' Bad .Boy Productions and Barrow. The handgun was r eported stolen in Georgia, police said.

pointing .357 or . 45 caliber grey gun in his face . JONES was
unaware o f what was happening and reacted by jumping up from the
bed . The UNKNOWN MALE(UNMl) and JONES wrestled until the UNMl
shot JONES in the a r m and back. At first JONES was not aware
that he was shot. After shooting JONES, the UNMl started to flee
from the apar tment but a second UNKNOWN MALE(UNM2) t hat was
standing by the fron t door of the apartment said to the UNMl "you

John's hospital where he was treated for the gun shot wound.

Before the robbery occurred, JONES's sister, who lives

in the projects in Brooklyn, NY heard that when "dirty" came
around he was going to be hit . JONES thinks t hat his sister,
cousin and/or his little cousin I

committed the robbery. JONES never investigated who robbed him
because he did not want to cause problems for his family who
still lives in the projects where the robbery occurred.
JONES
has not returned to the projects s ince the incident.
JONES described the UNMl as being taller than he,
wearing a black mask, and a light blue t - shirt with brown skin .
UNMl carried the gun in his right hand.
JONES could only provide
a brief description of UNM2 because he only got a momentary
glimpse of him. The UNM2 was also wearing a black ski mask.
JONES believed the UNKNOWN MALES were young in age because of the
way they behaved during the robbery .
Two(2) years ago, JONES was robbed while i n the
Kingston projects.
JONES was also shot during this robbery.
