This letter responds to the Freedom of Information Act (“FOIA”) request submitted by
Anne Weismann to the Office of Legal Counsel (“OLC”) dated August 21, 2013, seeking “all
opinions written by [OLC] that discuss, in any way, the authority of the president or any
executive branch agency or agency component to conduct domestic and/or foreign surveillance.”
Pursuant to 28 C.F.R. § 16.5(b), your request was processed in the complex track
We have completed our search of OLC files and have identified 23 documents that are
responsive to your request. We are enclosing four documents in full. We have also enclosed a
total of three documents with redactions, two with redactions made pursuant to FOIA Exemption
Five, 5 U.S.C. § 552(b)(5), because the material is protected by the deliberative process and
‘attomey-client privileges, and FOIA Exemptions One and Three, § 552(b)(1), (3), because the
redacted portions are classified and specifically exempted from disclosure by 50 U.S.C. § 402
note and 50 U.S.C. § 3024()(1), and one with redactions we have made only pursuant to FOIA
Exemptions One and Three, because the redacted portions are classified and specifically
exempted from disclosure by $0 U.S.C. § 402 note and 50 U.S.C. § 3024(i)(1)
We are withholding 16 documents in their entirety pursuant to FOIA Exemption Five
because they are protected by the deliberative process and attomey-client privileges. For your
information, 13 of the withheld documents also are classified and may also be protected from
disclosure by statute. We have determined that none of the redacted or withheld material is
appropriate for discretionary release.
For your information, Congress excluded three discrete categories of law enforcement
and national security records from the requirements of the FOIA. See 5 U.S.C. § 552(¢). This
response is limited to those records that are subject to the requirements of the FOIA. This is a
standard notification that is given to all our requesters and should not be taken as an indication
that excluded records do, or do not, exist.You have the right to an administrative appeal. You may submit an appeal by writing to
the Director, Office of Information Policy, United States Department of Justice, Suite 11050,
1425 New York Avenue, NW, Washington, DC 20530-0001, or you may submit an appeal
