PREMBULO
El mundo actual es incomprensible sin las aportaciones de la ciencia; tampoco es posible la vida cotidiana sin la utilizacin de productos tecnolgicos
que forman ya parte de nuestra existencia. Todas las disciplinas cientficas,
tanto las relativas a las ciencias naturales como a las sociales o a las humanidades, han contribuido al avance en el conocimiento y al progreso de la vida
material. No hay que olvidar, sin embargo, que la ciencia, como cualquier otra
actividad del ser humano, debe estar sometida a principios ticos, merced a
los cuales alcanza su dignidad de accin especficamente humana. Estos principios inspiran el presente Cdigo de Buenas Prcticas, a fin de que la actividad cientfica en el CSIC propicie la comprensin del mundo y la mejora de la
calidad de vida de la humanidad.
El primero de estos principios es el reconocimiento del ser humano como
sujeto libre y autnomo de la investigacin. Esto significa que los intereses de
la ciencia no deben primar sobre los del ser humano, es decir, que la ciencia
est al servicio del bien comn y no al revs; tambin, que los cientficos y
quienes disean las polticas cientficas estn obligados a justificar moralmente sus objetivos y prioridades.
El segundo es el respeto a la dignidad del ser humano, en particular cuando es objeto de experimentacin. Siempre que estn en juego su salud y sus
derechos, habr que contar con su consentimiento, que ser libremente concedido, previa informacin sobre los riesgos y posibles consecuencias que
puedan acarrear un mal uso o un uso equivocado de la ciencia sobre su persona.
El tercero es la asuncin de responsabilidades en el ejercicio de la actividad
cientfica. El cientfico es responsable ante el ser humano, cuyos derechos son
siempre inviolables. Es responsable, tambin, hacia los organismos vivos y
frente al medio ambiente; se debe evitar el sufrimiento innecesario de los primeros y velar por la integridad y funcionamiento idneo del sistema Tierra.
Las generaciones presentes son responsables ante las generaciones futuras
del mundo que dejaremos, de ah que los cientficos tengan que fomentar de
manera especial la reflexin tica para que las extraordinarias posibilidades
derivadas de la investigacin cientfica contribuyan a mejorar las condiciones
de vida en el futuro, y no a su deterioro.

conjunto de pautas, principios, compromisos, declaraciones o recomendaciones aplicables a cualquier tipo de investigacin. El Cdigo invoca principios
morales que trascienden el mbito de la legalidad, contribuyendo, sin embargo, a su desarrollo y perfeccionamiento. El Cdigo de Buenas Prcticas Cientficas debiera ser un instrumento capaz de promover y garantizar la integridad
y la calidad de la investigacin cientfica que se desarrolla en el CSIC.

Este tipo de desviaciones, constituyen el mayor atentado al buen desarrollo de la prctica cientfica, y son responsabilidad ltima del cientfico que las
practica. stas pueden ser:
Interpretacin abusiva de datos.
Falsificacin de datos o pruebas para que cuadren con la hiptesis de
partida.
Fabulacin de datos y descubrimientos.
Plagio de trabajos ajenos.
Los mecanismos para combatirlas eficazmente son, entre otros:
La obligacin de los investigadores de someter a crtica mediante la
revisin por pares, cualquier nueva aportacin, as como la posibilidad
de que otros investigadores, de forma independiente, contrasten los
resultados obtenidos.
El compromiso de la comunidad cientfica, tanto nacional como internacional, de denunciar y combatir el fraude.
La coordinacin de todos los agentes, tanto nacionales como internacionales, que participan en la investigacin cientfica, en las tareas de
vigilancia del fraude y en su persecucin sistemtica.

Participar en actividades cientficas, foros de discusin, seminarios, etc. relacionadas con el desarrollo de su trabajo.

La posibilidad de que exista conflicto de intereses tanto por la proximidad del evaluador con el sujeto de la evaluacin, como por
razones de competitividad, casos estos en los cuales la evaluacin
debe desestimarse.

La informacin facilitada al efecto al evaluador, no debe ser compartida sin autorizacin previa y expresa de la persona titular de la
misma.
2.4. Divulgacin
Una sociedad libre necesita tener un alto nivel de conocimiento y disponer
de elementos crticos para la toma de decisiones, por tanto, los cientficos
deben:
Divulgar y comunicar a la sociedad los resultados de su investigacin
para contribuir al avance cultural del pblico en general y la difusin del
conocimiento, y para justificar ante la sociedad los recursos dedicados
a la investigacin.
Hacer un esfuerzo para proporcionar a la audiencia no especializada,
un nivel adecuado de conocimientos, y evitar la presentacin ante los
medios de resultados prematuros y no suficientemente contrastados.
Sern de aplicacin los mismos criterios que se asignan al resto de las actividades de difusin, tales como la veracidad y una suficiente evidencia cientfica.

4. ENTORNO INSTITUCIONAL
4.1. Informacin de las condiciones de la investigacin
La Institucin promover el valor de la colaboracin, la calidad de la investigacin y propondr modelos para la organizacin de la investigacin
misma. Trasladar su importancia a la sociedad fomentando el dilogo
entre los agentes econmicos y sociales, en particular, ofreciendo su asesoramiento y su experiencia en actividades de investigacin.
La Institucin velar para que todos los investigadores tengan acceso al
Cdigo de buenas Prcticas Cientficas del CSIC y a la legislacin vigente en relacin con los distintos mbitos de la ciencia. Se editarn los
oportunos documentos que se recogern en un apartado especfico
(ad hoc) en la web del CSIC. Adems, la Institucin promover la sensibilizacin de los investigadores y tcnicos hacia las buenas prcticas
en la investigacin, mediante una adecuada informacin en cursos
especficos, distribucin de folletos y dems medios. A tal fin, y en virtud de lo estipulado en el Estatuto, la Presidencia dispone de un Comit de tica.
El investigador debe hacer compatible el principio de libertad intelectual con el compromiso y la lealtad a la Institucin que le proporciona
el marco de trabajo en el que desarrollar eficazmente sus investigaciones. Por ello, el investigador debe integrarse completamente en el CSIC
y conocer bien todas las actividades que la Institucin realiza, as como
el papel que desempea al servicio de la sociedad.

La legislacin aplicable y normas de referencia arriba relacionadas no constituyen
una lista definida y cerrada, resultando de aplicacin cualquier otro precepto legal o
reglamentario que de forma significativa o tangencial pudiera afectar a lo dispuesto en
el presente Cdigo de Buenas Prcticas Cientficas.
No se ha considerado la inclusin de aquellos textos legales cuyo mbito de aplicacin queda circunscrito al territorio de una determinada comunidad autnoma, por
resultar excesivamente prolija su enumeracin.

PREAMBLE
It would be difficult to imagine the actual world without the current levels
that have been achieved in science and technology, as our life is now highly
dependent on technological products. All scientific areas, both the natural
and social sciences have contributed greatly to the advancement of
knowledge and to improve the quality of life. However, we should not forget
that science, as any other activity, must be based on sound ethical principles.
These principles inspire the following Code of Good Scientific Practices,
designed to provide an ethical basis for all scientific activity of CSIC.
The first of these principles is to consider freedom and autonomy of
research. Science will be always under a particular human interest and always
serve the welfare of mankind; the scientist and the science policy
administrators are obliged to morally justify aims and priorities.
The second principle is respect to human dignity, particularly when
human beings are the targets of the research. Whenever their health and
rights are involved, it will be necessary to have a voluntary informed consent,
with clear information about the risk and possible consequences of a wrong
use of science.
The third one is the acceptance of responsibilities towards society, during
scientific activity. Furthermore, the scientist is also responsible of his/her
actions in relation to any living organism and the environment, avoiding any
unnecessary damage and being aware of the integrity and correct function of
our Earth System. This generation is responsible to the next ones, about the
situation of the world, taking especially care to promote ethics, and allow that
what derives from scientific research will contribute to improve life conditions
in the near future.
The fourth principle is that research against human health or dignity
including racism, holocaust denial or terrorism apology should not be
supported, either in natural science or humanities. Although scientists or
their institutions will not be directly responsible of the use that could be made
of the knowledge they generate, they should reject to participate in projects
and in the spreading of information to be used with awkward ends.
The fifth is that research must be transparent. The scientist should
always be ready to answer about his/her work, understanding the

protocols and the original data must be kept by the researcher, the research
team and the institution for at least five years.
The data remains the property of the Institution in which the scientific
work has been carried out, so its source should be clearly cited.
In orden to allow any expert in a certain field to understand and reproduce
an experiment, the Institution must provide researchers and trainees with
suitable equipment to store the information.

Respect and value the work of management, and make good and
careful use of materials and facilities.

2.4. Disclosure
A free society is one that has a high level of knowledge and a critical mind
for making decisions, therefore the scientists have to:

can be clearly stated. Furthermore, all adopted agreements entered into by the
entity soliciting the work and the representatives in charge of the execution of
the research shall be included in the abovementioned agreements.
Conflicts of interest must always be avoided whilst negotiating the
agreements and/or during the publication and exploitation of the work done
in collaboration with private entities.

4. INSTITUTIONAL FRAMEWORK
4.1. Information on research conditions
Institutions must stimulate scientific collaboration and the quality of
the research. Likewise it must recommend models for the organization
of research and encourage the relationships between the economic
and social agents, and in particular offer its advise and experience in
those research activities.
The Institution must guarantee that all researchers have access to the
Code of Good Scientific Practices of CSIC as well as to the updated
legislation applicable to the different fields of science. Documents
gathered in a specific document ("ad hoc") will be edited at CSICs
web. In addition, the Institution will endeavour to make researchers
aware of good research practice by means of giving adequate
information through specific courses, leaflets and others. To this end
and by virtue of what is stipulated in the statute, the Presidency set up
an Ethics Committee.
Researchers must make compatible the intellectual freedom with
engagement and loyalty to the Institution that provides them with
framework to develop their research efficiently. Researchers must
involved with the CSIC and know well all the activities that
Institution carries out as well as its role of service to society.
