NOTICE OF ADVERSE CLAIM


I, BBBBBBBBBBBBBBBBB, , Philippines, Filipino, of legal age, married,
for and in behalf of the BBBBBBBBBBBBB BANK, under oath, do hereby
depose and say:

That the BBBBBBBBBBBBBBBBB for brevity, has legitimate


claims adverse to the registered owner(s) and/or
possessor(s) of Lot No. 5461 with an area of 9,737 Square
Meters, located at Ubujan District, Tagbilaran City, Bohol,
and which is particularly described and bounded as
follows;
Lot No. 5461, Cad-235
Beginning at a point marked 1 of Lot 5461, Cad-235; being
S. 19-43 E., 382.01 m. from BBM No. 34, Tagbilaran, Bohol; thence
N. 47-45 E., 19.66 m. to point 2; N. 17-25 W., 41.52 m. to point 3;
N. 22-56 E., 25.04 m. to point 4; N. 68-44 E., 63.20 m. to point 5;
S. 83-02 E., 11.87 m. to point 6; S. 15-52 E., 77.58 m. to point 7;
S. 22-30 W., 87.01 m. to point 8; N. 28-11 W., 43.82 m. to point 9;
N. 69-06 W., 53.31 m. to point 1; point of beginning.
Containing an area of NINE THOUSAND SEVEN HUNDRED AND THIRTY
SEVEN (9,737) SQUARE METERS.

That the banks adverse claim consists of rights and


interests in the above-described land on the ground that
the bank acquired said Lot No. 5461 through
extrajudicial foreclosure proceedings; The facts are
hereunder stated as follows
2.1. On April 27, 1979 CCCCCCCCCCC obtained an
agricultural loan from the RURAL BANK OF
BBBBBBBBBBBBBBB, INC., in the amount of THREE
THOUSAND PESOS (P3,000.00), Philippine currency,
which is secured by a Real Estate Mortgage over Lot
No. 5461 covered by Original Certificate of Title (OCT)
No. 14; A copy of OCT No. 14, of the Promissory Note
and of the Real Estate Mortgage Contract are hereto
attached and marked as Annex A, Annex B and
Annex C respectively;

2.2. Due to the failure and/or refusal of CCCCCCCCCCto


pay his loan, Lot No. 5461 covered by OCT No. 14 was
foreclosed to FCB; A copy of the Certificate of Sale
dated August 07, 1989 is hereto attached and marked
as Annex D;
2.3. CCCCCCCCCCC or his heir(s) failed to redeem the
land within the redemption period thus, BBBB
processed the transfer of ownership over the land in
its name; BBBB paid the Capital Gains Tax and other
taxes and fees for the transfer of ownership but
unfortunately, BBBBwas not able to successfully
transfer the certificate of title from the name of
CCCCCCCCCCC to its name because OCT No. 14 has 3
duplicates
which
were
subsequently
(and
erroneously) issued by the Register of Deeds-Province
of VVVVVVVVVV to wit:
2.3.1.
Transfer Certificate of Title No. 23145 covering Lot No.
5461 in the name of DDDDDDDDDDD., issued on August 21,
1981, acquired by purchase from CCCCCCCCCCCC;
2.3.2.
Transfer Certificate of Title No. 22081 covering Lot No.
5461 in the name of EEEEEEEEEEE issued on April 17, 1980,
from CCCCCCCCCC by virtue of a Deed of Donation;
2.3.3.
Transfer Certificate of Title No. 21003 covering Lot No.
5461 in the name of CCCCCCCCC issued on June 28, 1979,
coming from his OCT No. 14 which was declared missing by LRC
Team.
Copies of TCT No. 23145, TCT No. 22081 and TCT No.
21003 are all hereto attached and marked as Annex
E, Annex F and Annex G respectively.

Certain persons have possessed the land without the


knowledge and consent of BBBBBBB;
BBBBB remains to be the true and lawful owner of Lot No.
5461; It neither disposed said land nor waived its rights
and interests thereof.

WHEREFORE, premises considered it is most respectfully


prayed and we hereby petition to the Office of the Register of
Deeds-City of DDDDDDD to register our adverse claim and
annotate it on TCT No. 23145, TCT No. 22081 and TCT No.
21003 in the manner provided by law.
