RESOLUTION STRONGLY ENDORSING TO CONGRESS


THE PROPOSED CREATION OF SITIO TUDOG INTO A
DISTINCT AND SEPARATE INDIGENOUS BARANGAY IN
THE MUNICIPALITY OF SENATOR NINOY AQUINO,
SULTAN KUDARAT TO BE KNOWN AS TRIBAL
BARANGAY OF DATU TUDOG.

WHEREAS, the petition of the majority of the indigenous people of Sitio Tudog,
Senator Ninoy Aquino, Sultan Kudarat for the creation of their community into an independent
Indigenous Barangay was referred to the Sangguniang Panlalawigan for indorsement pursuant to
Article 14 (e) of the Rules and Regulations Implementing RA 7160;
WHEREAS, Article 14 (c) of the Rules and Regulation Implementing the Local
Government Code of 1991, which states that a barangay may be created in the indigenous
cultural communities by Act of Congress upon recommendation of the local government unit
where the cultural community is located;
WHEREAS, Sitio Tudog in the municipality of Senator Ninoy Aquino, Sultan Kudarat
were inhabited by indigenous people belonging to the Manobo Dulangan Tribes;
WHEREAS, the passage of a law by Congress creating the Tribal Barangay of Datu
Tudog will not only spur development in the countryside but expressly giving our indigenous
people their individual identity, sense of dignity from their own cultures and the right to exercise
their own affairs in accordance with their customary laws and traditions;

WHEREFORE, finding the petition in order, on motion of Hon. Joaquin D. Lim, duly
seconded by Hon. Nonie L. Latog, it was
RESOLVED, as it is hereby resolved, to strongly endorse to Congress the proposed
creation of Sitio Tudog into a distinct and separate Indigenous Barangay in the municipality of
Senator Ninoy Aquino, Sultan Kudarat to be known as Tribal Barangay of Datu Tudog.
RESOLVED FURTHER, to furnish copies of this resolution to the Honorable Datu
Suharto T. Mangudadatu, Al Haj, House of Representatives, Quezon City, for his information
and Bill sponsorship.

WHEREAS, the people and officials of the province took cognizant of the visit of
various Ambassadors from the European Community headed by the Honorable Ambassador Jan
de Kok and the Philippine Government represented by Secretaries Jesus Dureza of MEDCo and
Nasser Pangandaman of the Department of Agriculture in the province of Sultan Kudarat last
January 18-20, 2006;

Agricultural Production & Enterprise Development (SIAPED) under the European Commission
assisted Support to Agrarian Reform Communities in Central Mindanao (STAR-CM) projects;
WHEREAS, the province of Sultan Kudarat is a recipient of various income generating
enterprises funded by the European Union under the STAR-CM that increases the per capita
income of its beneficiaries;
WHEREAS, the people and officials of Sultan Kudarat warmly welcomed the visit of
Ambassadors of the different European countries
WHEREFORE, on joint sponsorship of all the members present, upon motion of Hon.
Leonidas L. dela Cerna, it wasRESOLVED, as it is hereby resolved, to express the sincere thanks and gratitude of the
people and officials to the different Ambassadors from the European Commission who visited
the province of Sultan Kudarat in line with the implementation of the EU-assisted STAR-CM
projects;
RESOLVED FURTHER, to furnish copies of this resolution to His Excellency and
Head of European Commission delegation Ambassador Jan de Kok and other ambassadors

RESOLUTION ENACTING ORDINANCE No. ______ KNOWN


AS AVIAN PREVENTION AND CONTROL ORDINANCE OF
THE PROVINCE OF SULTAN KUDARAT
WHEREAS, presented for consideration in accordance with Article 468 (4) (v) of the
Rules and Regulation Implementing the Local Government Code of 1991 is the passage of an
ordinance known as Avian Prevention and Control Ordinance of the Province of Sultan
Kudarat
WHEREAS, the passage of the said ordinance will prevent the spread of bird flu virus
within the territorial jurisdiction of Sultan Kudarat;
WHEREFORE, on motion of Hon. Eilen May A. Velasco, duly seconded by
Hon. Benigno N. Garcia and Hon. Eliseo F. Castro, it was
RESOLVED, as it is hereby resolved, to enact the following ordinance, to wit:
ORDINANCE NO. _____

AVIAN INFLUENZA (AI) PREVENTION AND CONTROL


ORDINANCE OF THE PROVINCE OF SULTAN KUDARAT
Be it ordained by the Sangguniang Panlalawigan of the province of Sultan Kudarat, that:
- page two (2) follows Section 1. This Ordinance shall be known as the The Avian Influenza Prevention and Control
Ordinance.
Section 2. This ordinance is enacted for the purpose of preventing and controlling possible
entry/outbreak of Avian Influenza in the country, and specifically to wit:
a. To prevent the entry of Avian Influenza, thus ensuring public safety;
b. To protect the local livestock industry and other related industries; and
c. To promote and protect the health, safety, and general welfare of the residents.
Section 3. Definitions - For the purpose of this Ordinance, the following terms and phrases
shall apply:
a.
Avian Influenza an infectious disease in chickens, ducks, and other birds caused
by different subtypes of the influenza A virus.
b.
Fowl/Poultry includes marketable broilers, culls, day old chicks, pullets, game
fowls, native chicken, ducks, hatching eggs, hobby birds, or birds of any kind
c.
Exotic birds any bird species or sub species which do not naturally occur in the
Philippines.
d.
Poultry holding facilities includes commercial farms, backyard units, hatcheries,
processing plants, slaughterhouses, aviaries, feed mills, cockpits, and public
markets.
Section 4. The Local Avian Influenza Taskforce The AI Prevention and Control Taskforce is
hereby created and composed of the following:

Provincial Health Officer
Municipal Health Officers of Different Municipalities in the Province
City Health Officer of Tacurong
Municipal/City Agriculturist of different Municipalities and lone city in the
Province
Municipal PNP Chief of Police of Different Municipalities and lone City in the
Province
President Association of Barangay Chairmen
Two (2) NGO Representatives
Municipal Action Officer of Different Municipalities in the Province and the City
Action Officer of Tacurong
Information Officer of Different Municipalities in the Province and the City
Information Officer of Tacurong
Poultry Raisers Association
President, Federation of Homeowners Association
The Taskforce shall be the main authority to oversee the implementation of the provisions of this
Ordinance and other related activities as may be provided by rules and regulations and guidelines
promulgated by higher authority or mandated by the national laws.
Section 5. Census The LGU shall conduct a census of all livestock and poultry holding
facilities in their premises. The data shall include the type of poultry holding facility, poultry species,
poultry population density, facility owner/operator, location, poultry disease profile, biosecurity
practices, vaccination programs, and veterinarian in charge.
Section 6. Prohibition of Offer for sale and/or Sale It shall be prohibited for any person to offer
for commerce, engage in trade or have in possession any exotic species of poultry wildlife. It shall be

accordingly penalized as stipulated in Chapter IV (Illegal Acts) of RA 9147. This activity shall be
enforced in coordination with the authorities of the DILG-LGU Bureaus or the local PNP Station.
Section 7. Prohibition of Possession It shall be unlawful for any person to possess/own or keep
unregistered exotic birds for whatever purpose or intent.
- page three (3) follows Section 8. Other Prohibitions The LGU shall assist in the implementation of the following
additional prohibitions to safeguard against Avian Influenza, to wit:

Prohibition on offer for sale and sale of live chickens in the market while there is a
threat of bird flu;
Prohibition on placing chickens, ducks and pigs together in the same area, cages or
pens, and
Prohibition on chickens to roam freely. It is understood that these chickens, ducks
or pigs shall be kept in a cage or furrowing/pig pens.

Section 9. Coastal Monitoring of Smuggling of Fowl Smuggling of fowl shall be reported to


the Philippine Coast Guard or Local PNP.
Section 10. Negative Reporting The Local Veterinary/Agricultural Officer shall submit
monthly a Negative Monitoring Report to the Provincial Veterinarian or DA-RFU.
Section 11. Assist in Surveillance The LGU shall assist the Provincial Surveillance Group
formed by the Provincial Local Avian Influenza Taskforce in the conduct of sero-surveillance in their
locality. They shall help in the identification of poultry holding facilities and encourage participation of
the facility owners/operators in surveillance and reporting. Surveillance reports shall be recorded and
submitted to the National AI Task Force Center at the BAI. Sero-surveillance must be conducted twice a
year in the backyard/commercial farms and other susceptible fowls.
The LGU shall likewise assist BAI in enforcing requirements covering the local transport of
animals, including poultry and poultry by products as covered by BAI Memorandum dated July 13,
2004. This activity shall be enforced in coordination with the local PNP Station.
Section 12. Information Dissemination The Local Veterinary/Agricultural Officer shall conduct
regular information campaigns. These campaigns shall include recommended biosecurity and other AI
preventive measures. They shall be trained by the National/Regional Task Force.
Section 13. Suspected AI Cases
a.

Reporting. The farm veterinarian or farm worker shall immediately report to the
BAI, DA-RFU or city/municipal/provincial veterinarian any occurrence or
mortality of 3% (based on house population) in just a day in commercial farms or
any unexplained mortality or poultry in two or more households within a barangay
or purok in a span of 2 days in the case of backyard farms. Investigation/blood
collection shall be conducted by the city/municipal/provincial veterinarian and
RADDL technician within 24 hours.

b.

Movement Control. The local PNP, upon notice from the Local Chief, shall
enforce movement control. Farm personnel are not allowed to leave the suspected
premises unless with approval from the head of AI taskforce. Likewise, poultry,
poultry products, and by-products, farm equipment and feeds shall not be allowed
to leave the suspected premises and instead shall be quarantined within 24 hours.

c.

Vaccination. The local health workers shall assist in immunizing veterinarians,


local veterinary/agricultural officers/technician shall assist in the conduct of poultry
vaccination in areas identified by the AI Task Force.

Section 14. Mobilization of Barangay Health Emergency Response Teams (BHERTs). To


maximize efforts at the grassroots level, the organized BHERTs, pursuant to DILG Memorandum

Circular No. 2003-95 dated May 7, 2003, shall be mobilized to provide assistance to LGUs in the
implementation of the Local Avian Influenza Program.
Section 15. Penalty Any violation of this Ordinance by any person, firm, poultry traders, farm
owner shall be liable to prosecution and upon conviction, shall be subject to a fine of not less
than One Thousand Pesos (P1,000.00) but not more than Ten Thousand Pesos or both, upon

ordinance, its officers will be held liable. If alien, he will be subjected for deportation
proceedings after payment of fines/imprisonment.)
Section 16. This ordinance shall take effect immediately.
RESOLVED FURTHER, to furnish copies of this resolution to agencies concerned for
their information.
