of entries.
The energetic and wonderful gardeners, bakers, photographers and crafters of our area bring their exhibits to

Poultry and rabbits will be entered, and the public will

The youth of the area are large contributors to these exhibits and awarded prize money for their winning entries.
The fairgrounds have educational displays to explore.
There is a car show, a dog show, as well as equine events
all weekend. Local talent of the area will be performing live on stage all weekend. The youth will enjoy playing mini golf, being a farmer for a day, as well as having
fun at the Selkirk Lions Family Carnival and Fun Swing/
Bouncy House. The Dirty Diggers Weekend is equipment
and operators who will take youngsters (accompanied
by adult partners) on small equipment/machines and go
digging. Many artisans and vendors will be present with
a variety of items to sell and demonstrate. There will be
wonderful food concessions with diverse menus.
Please come out and enjoy a fun family weekend, and
make this fair the best ever by entering your exhibits,
being a vendor and taking the free MTI Bus. For more

Langham Fundraiser

A bright light has gone out in Kaslo - a phrase which

Holley Rubinsky, crusader against light pollution, and
perpetrator of dark humor, would have appreciated. Holley requested that the proceeds from her estate be gifted to

culture promotion in our area. The Langham is hosting an
estate sale on Sunday, September 27 from 10am to 2pm.
This sale will take place at Holleys house on 411 Brennand Street, Kaslo, and involve artwork, antiques, furniture and other large pieces.

Marathon of Hope
Celebrates 35 Years

Im not a dreamer, and Im

not saying this will initiate
any kind of definitive answer
or cure to cancer, but I
believe in miracles. I have to,
the words spoken by a true
Canadian hero. Terry Fox
had a single dream: a world
without cancer. He sought to
reach out to every corner of
Canada, and beyond, when
he embarked on his Marathon of Hope. Terry Fox ran
the equivalent of a marathon
a day for 143 days straight, on
one leg, to raise awareness for
the need for research funding. When his own cancer
spread he was forced to stop
running, but his dream to
find a cure for cancer lives on.
This year marks the 35th
Annual Terry Fox Run and
more than one hundred
communities in British
Columbia and the Yukon
will be running to keep the
dream of Terry Fox alive.
The Terry Fox Foundation
funds research in all kinds
of cancer, believing as Terry
did that we need to conquer
this disease once and for all,
says Donna White, Provincial Director for the Terry
Fox Foundation British
Columbia and Yukon. Since
Terry first dipped his leg in
the St. Johns Harbour, close
to $700 million has been
raised for cancer research
worldwide in Terrys name.
This years event takes place
on the National Run Day,
Sunday, September 20. The
runs are noncompetitive,
all inclusive, family oriented
activity where participants
can run, walk, blade or bike.
Registration is by donation
and there is no minimum
pledge amount. Participants
have the option to be recognized as a corporate team,
individual participants, or
even a member of Terrys
Team of cancer survivors.
To donate to the Terry
Fox Foundation, please visit

LAW OFFICE

Presents

YOU AND THE LAW

CAN YOU UNDO A CHILD ABDUCTION

BY YOUR SPOUSE?
Few things are more heart-wrenching
for a parent than to have their child
wrongfully taken by their spouse
sometimes even moved to a different
country. Theres almost always a nasty
fight afterwards. Can you get your child
returned?
Take heart. Theres help.
A recent case decided by BC's appeal
court shows that the abduction can be
undone and your child can be returned
to his or her country of residence. That
countrys courts can then deal with
custody and access issues like which
parent your child is better off living with.
Here, Carla (all names changed), a
Canadian, married Pete, an American, in
Alberta in 2010. The next year they had a
child, Josh, in Alaska, then moved to live
in Washington where Pete found work.
In 2013, the family moved to Billings,
Montana, when Pete was transferred
there by his employer.
They intended to make Billings their
permanent residence. But the house they
planned to move into wasnt fit to live in.
So after a few days stay, Carla told Pete
she wanted to take little Josh and live at
her parents place in Elko, BC, while Pete
got the house fixed. Pete was okay with
that. Carla only took along a few clothes
and toys for Josh, consistent with a short
stay away.
But a few months later, things changed.
The marriage broke down. Carla, who
now had a job as a heavy duty mechanic,
didnt want to return to Montana, and
decided shed stay in BC with Josh.

Once Pete found this out, he went to

court to get Josh returned to Montana.
After many legal twists and turns, the
case reached our BC appeal court. Carla
argued that Josh would be at serious risk
of harm if returned to Montana. Pete
disputed this. Carla also argued that a
few days stay in Billings wasnt enough to
justify having to take her 3 year old son
back to Montana. Ultimately, our appeal
court said Carla had to return Josh to
Montana within two weeks a court there
would sort out the custody and access
issues afterwards.
The law dealing with these situations
is a treaty (international agreement) on
international child abductions, called the
Hague Convention. Its signed by many
countries, including Canada and the
United States. One overriding objective of
this treaty in child abduction cases is to help
promptly return a wrongfully abducted
child detained in another country.
What mattered more here than Carlas
(and Joshs) very short stay in Montana
was that both Pete and Carla had intended
for Billings to become their permanent
residence when the family moved there
Josh of course was too young to decide
this for himself.
Legally, Joshs habitual place of residence
was the United States, not Canada. So, in
line with the treatys objectives, Josh needed
to be returned to Montana for a court there
to deal with the domestic issues.
Your family lawyer can help if your
child is wrongfully abducted to another
province or country.

Kaslo adopted an Animal Attractant Bylaw in 2008 which is intended

to help us all reduce Kaslos problems with animals, bears included,
in our streets. Bylaw enforcement is now in effect. Basics for everyone
to remember are:
Do not put garbage cans out for collection before 5 am on garbage days
All garbage must be in cans, not put out on the street in bags
Be sure garbage cans, sheds and outdoor fridges and freezers are
secure against any animal interference
No bird feeders are permitted between April 15 and December 1
Do not leave pet food outside
Keep barbecue grills clean
Compost properly, without food or smells to attract wildlife
Pick fruit when ripe, and clean up windfall within 3 days
(do not allow fallen fruit to stay on the ground)
Kaslo must stop providing easy sources of food
to wildlife, deer included, to protect both
animals and people.
Contact Village of Kaslo office to report violations.
Village of Kaslo
250-353-2311.
Copies of the bylaw are available at the

hope Interior Health will do what is necessary to restore this
essential service. Please call 250-353-2291, option 5 to get

It is with great sadness that we announce the passing of our

dear sister and aunt, Ayako Higashi (nee Atagi) at Victorian
Community Health Centre in Kaslo, BC.
She was 96 years of age. She is survived by her younger
brotherYutaka (Yute) Atagi and her nephews Gene
(Susanne) Atagi of Campbell River, BC and Dana
(Valerie) Atagi of Smithers, BC. She was preceded
in death by her husband of 58 years, Buck Higashi,
her father Kiyomatsu, her mother Kane, her older
sisters Mariko and Kimiko, and her sister-in-law
Ruth Atagi.
Born in Campbell River on Vancouver Island, Aya
grew up in Quathiaski Cove on Quadra Island. She
had many fond memories of her childhood on Quadra.
She was an excellent student who left her family to attend high school in Vancouver and she graduated from
the prestigious King Edward High School in 1938. Her future was promising as she considered attending the University
of BC to study medicine. However, everything changed for her
and her family in 1941 with the entry of Japan into the Second
World War. As for so many, the war changed her life.
In the fall of 1942, Aya and her family were moved, along with
many other Canadians of Japanese descent, to an internment
camp in the old mining town of Kaslo, BC. At 23 years of age,
this event influenced her life from this point forward. She became a teacher of the many Japanese Canadian students in Kaslo (Kootenay Lake School) and Slocan (Popoff School). In 1949
when the travel restrictions on Japanese Canadians were rescinded, Aya and the Atagi family chose to stay in the Kootenays
and make a life in the beautiful community of Kaslo. After the
war she attended the Vancouver Normal School to complete
her teacher training. She would go on to become an award winning teacher in the Kaslo high school system and in 1977 she
was awarded the Queen Elizabeth II Silver Jubilee medal for
education. She never had children of her own but considered
her students to be her children. She was always interested in
and proud of what became of her former students. In 1984
after more than 40 years of teaching in Slocan and Kaslo she
retired from J.V. Humphries Elementary and High School.
In 1949 she married Gerald Tadayoshi (Buck) Higashi. She and
Buck were active in the community and they shared a life of
travel, golf, curling, square dancing, and many other social activities. They were very proud of their 8 ender! Because she
was a teacher, they were able to travel. They enjoyed travelling
to see history and to visit family at the coast, in Ontario, and
especially her sister Kimiko and her family in Japan. She and
Buck were life-long RVers long before it was a popular way to
holiday. They enjoyed many trips to the Maritimes, all across
North America and especially to Arizona where they enjoyed
many winters in retirement. She loved Buck and was devoted
to him; she spent several years looking after him as he battled
the cancer that would eventually take him in 2007.
Aya had a great sense of service to her community. She was an
ambassador for Kaslo and was a champion for preserving and
restoring the many heritage buildings that give Kaslo its unique

Ayako Higashi,
July 9, 1919 July 21, 2015
character. She was an active member of the St. Andrews United
Church and she spent much of her retirement years volunteering for her many worthy causes. At 91, she wrote that she kept
herself busy by being involved in the Church, the Kaslo Hospital Auxiliary, the Kaslo City Hall Conservation Committee, and
with the many other charities that she supported. When in her
80s, she quipped about going to visit the old people who were
in residence up at the hospital.
She supported the redress of the Japanese Canadians in a positive way. She would continue to share her story of the internment camp years with the younger generations of Japanese
Canadians and students alike. Like her father, she loved to
keep a flower garden and she always had a home full of perennial flowers and plants. She was always well dressed and she
loved her hats! For her tireless life of service she received and
humbly accepted many awards but she was most proud of the
Queen Elizabeth II Silver Jubilee Medal (1977), BC Wisdom of
Age Mentorship Award (2007), Kaslo & District Chamber of
Commerce Lifetime Achievement Award (2008), Rick Hansen
Community Difference Maker Award (2012), and Queen Elizabeth II Diamond Jubilee Award (2012).
Because of her teaching career and community service she was
arguably one of the more influential, recognizable and colourful personalities in the village. She was certainly one of the
most colourful and celebrated personalities in the Atagi family!
Many thanks go to her many friends in Kaslo who
regularly visited her and to the staff at the Victorian Community Health Centre who cared for her and
treated her with kindness in her last years.
We will celebrate her life on Saturday, September
19, 2015 at 2 pm at St. Andrews United Church, 500
Fourth Street, Kaslo, BC. In lieu of flowers, the family
has requested that a donation in Ayas memory may
be made to the Victorian Hospital of Kaslo Auxiliary
Society (PO Box 607, Kaslo, BC V0G 1M0).

With her many swim friends from

Parkinsons Rec in Kelowna, you
could find Mom most mornings at
7:00 am poolside. Mom had a major stroke in December 2014; after
three months she fully recovered
except for speech. She stayed at
DLJ in Kelowna for two months
until moving in with her daughter
Monika in Kaslo. She still enjoyed
gardening, forever trimming the
flowers, and especially watching
the last ladies FIFA soccer matches

held in Canada. Mom and I were

glued to the TV for every game. You
could find Mom most days walking
the Schroeder Creek crescent and
beach areas with Mokie and Piko,
with Leo the cat following behind.
I want to personally thank the palliative nurses at the Victoria Hospital, they gave Mom as well as me
such wonderful care. You truly are
a special group of ladies. I was so
blessed to have my mom living with
me at Schroeder Creek for these
last three months.
A celebration of life will be held at
Grace Lutheran Church, 1162 Hudson Road, West Kelowna on Saturday, October 3rd at 10:30 am.

away on Saturday August 22 in
the Victorian Kaslo Hospital at
the age of 72 after a long struggle with cancer. She

Dearly missed by her children, John and Anita (husband Paul Davies), brothers Philip, John, Jim, Peter

We all remember Rose for her adventurous solo tour

Pixal

Orange tabby female kittens are rare, I'm told, but that's me
:). I'm Pixal, and I'd like to find a special home. I am a little
shy when I first meet new people, but when I warm up, I am
your best buddy and an awesome snuggler. I need a quiet
home, where I can live safely inside (I was born outside
and I've had enough of that). But mainly, I need a dog. My
very own snuggly dog, please. I will play with it and keep it
clean, I promise. I am 14 weeks old, spayed, tattooed, fully
vaccinated, perfectly litter trained, and wanting to get on
with my life in my own home. Please call KAAP at 250-5511053 or visit www.kaap.ca/adopt/pixal. PS: I have 3 equally
adorable siblings: Pica, Willow, and Marlee. Oh, and my
adoption fee is only $99 for the month of September!

Langham Fundraiser

A bright light has gone out in Kaslo - a phrase which

Holley Rubinsky, crusader against light pollution, and
perpetrator of dark humor, would have appreciated. Holley requested that the proceeds from her estate be gifted to
the Langham Cultural Society in furtherance of arts and
culture promotion in our area. The Langham is hosting an
estate sale on Sunday, September 27 from 10am to 2pm.
This sale will take place at Holleys house on 411 Brennand Street, Kaslo, and involve artwork, antiques, furniture and other large pieces.

Em2 Enlivens The Moyie

With Chamber Music

The violin duo Em2 is presenting a chamber music concert in the Womens Salon on board the SS Moyie on Sunday, September 20 at 2 pm. Violinists Emma Chart and
Emmi Matern will be accompanied by Muriel Tyler.
Their program is family-friendly, with melodic baroque
and classical repertoire, seasoned with folk and fiddle
tunes. Emmi Matern is from Crescent Valley and attends
Mt. Sentinel School where she is active in drama and
plans to study engineering.
Emma Chart is from Nelson and attends LVR School.
You may recognize her: she was Mary Poppins in this
summers Capitol Theatre musical. Emma sings with
Corazon and plans to study voice or drama in university.
In addition to the Kaslo concert on September 20, Em2
is presenting their program in Nelson, Friday, September
18, 7 pm, at The Blue House, 503 Fourth Street.
Admission to both concerts is by donation. Patrons
attending the Kaslo concert on Sunday will need to purchase admission to the SS Moyie. For Moyie admission
fees go to http://klhs.bc.ca/visitorinfo/
For further information, contact Stephanie Judy at

Inspired Workshops

Inspired is a series of creative workshops to discover

the topic of youth inspiration. We want to know what
inspires the youth of Kaslo and surrounding area to feel
alive and engaged with life. Youth will be supported and
encouraged to delve deep into self-exploration and selfexpression to tell their story of inspiration through art,
film, photography and song.
North Kootenay Lake Community Services Society
(NKLCSS), through an application by Youth Coordinator Shannon Isaac, received a CBT Youth Grants fund of
$10,000 to develop and deliver a variety of workshops for
youth this fall: Photography with Louis Bockner; Art with
Rielle Oswald; Film with Logan Carlstrom and Singing &
Song Writing with Sean Rodman & Jakob Simek.
Workshops will occur weekdays after school from October 1 through to November 20.
To honour the works of all the youth participants, we
will be hosting a community event, Inspired, at The Langham on December 4. Youth will have the chance to display
their art and photography, perform their songs and debut
their short films of inspiration to the community.
We could not provide this opportunity to our youth
without the support of JVH School, The Langham Cultural Society and NKLCSS. And we are hoping to have as
many youth as possible involved, therefore only one workshop option is available per youth. If you are between the
ages of 13 and 21, you are invited to sign up soon. Space
is limited! Registration deadline is September 24, at 5pm.
To register for your workshop series please contact
Shannon Isaac at 250-366-4162, or email shannonisaac@

Cello And Song Concert

To Benefit Refugees

Cello and Song, a concert showcasing local classical

musicians in aid of the Kootenay Refugee Coalition, is
scheduled for Friday, September 25 7:30 pm at St. Saviours Anglican Church, 701 Ward Street in Nelson. The
concert is a fundraiser for the coalition.
This past summer, two women from Eritrea arrived and
are now Canadian permanent residents, living and working in Nelson, learning the language and building a new
life in Canada The Nelson region is full of unique and
compassionate people and we celebrate our connections
with people around the world, says the Reverend David
Boyd, Coalition coordinator. We see this sponsorship as
a community endeavour.
Internationally acclaimed soloist Noemi Kiss (performing with cellist Jeff Faragher) and Nelson vocalist Mary
Audia will be joined by cellists Tibo Kolmel and Mia
Kraus at the concert. Voice soloists Emma Chart and
Michael Marsland will round out the concert program.
Tickets are available at Otter Books or at the door. For
further information, please call 250-352-9871.
