Application for Architectural / Environmental Change

This form is used to request the approval of the Architectural and Environmental Review Commit-
tee (AERC) before making an architectural or environmental change to a property in the commu-
nity of Gateway Commons a.k.a. Walnut Grove. The kinds of changes for which prior approval is
required are specified in the current revision of the Gateway Commons Homeowner Association
Architectural and Environmental Review Committee Standards and Guidelines (“the Guidelines”),
available from the community’s web site, http://walnutgrovemd.blogspot.com/.
Before submitting this form to the AERC, the applicant must give notice of the changes for which
approval is requested to all homeowners whose lots share common property lines. In the event
that an applicant shares property lines with only one other homeowner (e.g., as do many of the
townhome end-units), the applicant must notify one additional homeowner who will have a view
of the proposed alteration.
In order to be considered by the AERC, an application must include:
1. This form;
2. Plans for the changes to be made, specifying the nature, kind, shape, color, height, and
materials, as appropriate;
3. A copy of a survey, plat, or location drawing that is marked to show the location of the
proposed change.
Upon receipt of a complete application, the AERC will decide whether to approve the proposed
change using the criteria specified in the Guidelines and in the Declaration of Covenants, Condi-
tions and Restrictions (“the Declaration”) on which the Guidelines are based. These include the
proposed change’s harmony of exterior design and location in relation to surrounding structures
and topography and conformity with the design concept for the property. Applications that do not
contain the required information do not constitute submittals under the Declaration and will not be
considered by the AERC.

Approval by the AERC shall in no way be construed as to pass judgment on the correctness of the location,
structural design, suitability of water flow or drainage, location of utilities, or other qualities of the item
being reviewed;
Approval by the AERC shall in no way be construed as to pass judgment on whether the proposed change
is in compliance with the applicable building and zoning codes of Montgomery County;

Approval of any particular items shall not be construed as a waiver of the right of the AERC to disapprove
such items, or any elements or features thereof, in the event such items are subsequently submitted for use
in any other instance;
No work on this proposed change shall commence until I/we have received the written approval of the
AERC, or until the AERC has failed to approve or disapprove the application within sixty (60) days of
submittal, whichever comes first;
There shall be no deviations from the plans, specifications and location approved by the AERC without prior
written consent of the AERC;
I/we authorize members of the AERC to enter upon my property to make a routine inspection(s);
Construction or alterations in accordance with the approved plans and specifications must commence within
six (6) months of approval and be substantially completed within twelve (12) months unless otherwise
specified in the application;
It is my/our responsibility and obligation to obtain all required building permits, to contact Miss Utility
at 800-257-7777, and to construct the improvements in a workmanlike manner in conformance with all
applicable building and zoning codes; and
If I/we wish to appeal the decision of the AERC to the Board of Directors, I/we must appeal within ten (10)
days of being notified of the decision.
