COMPLAINT AFFIDAVIT
I, GENEVIEVE G. PASTOR, 20 years of age, Filipino and a resident of Purok
3, Nagassican, Santiago City, after being duly sworn to in accordance with
law, hereby depose and say that:
1. On June 10, 2015 at around 7:00 oclock in the evening, after I came out
from work at Mabini Massage Parlor, Mabini, Santiago City, I and my
workmate June Rudini Tomas were in front of our workplace waiting for
a ride to get home. I was able to hail a red tricycle driven by Kennison
Niones with plate number XYZ 2341. I bade goodbye to June told her I
shall go ahead. I boarded the said tricycle as its lone passenger and
instructed the driver to take me home to Purok 3, Nagassican, Santiago
City;
2. When we reached past the Nagassican Bridge which is an uninhabited
place, I noticed that the tricycle was slowing down and pulling over to
the right to a grassy area. I felt nervous and ask the driver why we
were coming to a halt. He said he was going to urinate;
3. Before he alighted, he opened the small attached steel-seat of the
tricycle to my left and drew a pointed tool. Before I could say a word,
he pointed the said tool right to my face and said huwag kang
sisigaw, kundi papatayin kita. I could barely shout because of shock
and feeling of helplessness because the place was so dark and
uninhabited;
4. While pointing the tool at me, he passed through the inside of the tricycle
instead of alighting to his left and later poked the tool at my lower back
and led me to the grassy area;
5. While leading me away from the tricycle, I was crying and begging him to
let me go but every time I did the same, he would poke the tool harder;
6. When we reached the riverbank he pushed and told me to undress by
removing everything. But I refused to do it, instead I appeal to his
sentiments. Then, he grabbed me, slapped my face and hit me on my
stomach twice, because of that I lost my strength and balance. But,
before I fell on the ground, he catches me and laid me to the ground.
Thereafter, he removed his T-shirt, lowered his shorts and underpants.
Then, he removed my clothes and underwear, while doing it; I am
struggling, crying and begging him to have pity on me. However,
instead of giving me grace, he went on top of me, slapped my face
many times, grabs his tool again, pointed it to me, and said huwag ka
nang manlaban, kung ayaw mo pang mamatay;
7. After that, he holds my hands over my head, again I beg him not to rape
me while struggling, but he is so determined and so powerful. He
inserted his penis into my vagina and did the push and pull motion. At
that point, I cant do anything to help myself than to cry;

8. When he was finished satisfying his lust, he stood up, stepped his one
foot on my stomach and pressed it so hard that I could not breathe.
While pulling up his shorts and underpants, he threatened me by these
words huwag na huwag kang magsusumbong kung ayaw mong
mamatay.
9. After wearing his clothes, he ran towards the road where he parked his
tricycle and escaped. I cried so hard and shout for help wishing
someone could hear and help me. I was so scared, shocked and
devastated of what was done to me. I was trembling getting dressed
and was hurrying to leave that I even left my slippers;
10. While I was running barefoot towards the road, I saw someone named
Melody Joy Valdez. I told her I was raped and she brought me to the
Barangay Hall;
11. While I am in the Barangay Hall, Brgy. Capt. Gideon Butch Calliguiran took
my statement and caused it to be recorded in the Barangay Blotter;
12. Thereafter, Brgy. Capt. Gideon Butch Calliguiran accompanied me to the
Santiago City Police Station and there I narrated the incident. Senior
Police Officer IV Judith Delos Santos of Womens Desk PNP, Santiago
City Police Station 1 took my statement and had it recorded to the
Police Blotter;
13. Thereafter, Senior Police Officer IV Judith Delos Santos brought me to Dr.
Reonel Cabanilla, MD of Municipal Health Office, Santiago City and had
me physically examined.
14. That I am executing this affidavit to attest the truthfulness of the
foregoing and to file a complaint for Rape against Kennison Niones;
IN WITNESS WHEREOF, I have hereunto affixed my signature this 10 th day
of June, 2015 at Santiago City, Philippines.
