Palayam(PO), Perundurai (Tk), Erode, Tamilnadu 638052, India. Represented by Mr.
Swami Adian Jose J, Franchisee of DTDC Courier & Cargo Ltd., (hereinafter referred
as the Service Provider)
And:
MCR Fabrics, Whose registered office at 24-26, Venkatachalam Street, Erode,
Tamilnadu 638001,Inia. Represented by Mr. Eswaramoorthy S, Manager
(hereinafter referred as the Client)

Declare That:

The service providers main activity is to provide directly or indirectly all

kind of delivery services related to transportation and distribution in India
based on the mentioned terms & Conditions. The service provider has the

sufficient and necessary knowledge, experience, Personnel and equipment

as to comply with the obligation contained herein.
The client is a company whose core activity is the manufacture,

comply with the obligation agreed herein.
Both parties undertake to observe the following clauses:

2. Terms and Conditions

2.1. The quote is valid for a period of 1 year from date of acceptance &
renewable on mutual agreement.
2.2. Services are limited to the list of serviceable pin codes list declared by
DTDC on our website and subject to revision based on external / internal
factors, civic disturbance, etc.,
2.3. Bills will be raised on a monthly basis & payments in favor of M/s JJ
EXPRESS to be remitted within 15 days of submission of bills.
2.4. code COD / To pay services are available for a minimum value of Rs.250 at
charges of Rs.150/waybill or 5% of to pay / COD value, whichever is higher.
To pay / COD services are available to select destinations and not to all
locations declared as serviceable in the DTDC pin code list
2.5. Consignments of Volumetric nature will be charged on volumetric or actual
weight, whichever is higher, as per IATA regulations @ l x b x h/5000 = No. of
kgs for Courier Mode
2.6. Shipper will ensure

providing

statutory

documents

required

for

dispatch/transit of shipments.
2.7. All taxes & statutory dues payable on shipments will be borne by the
shipper. The courier shall not be liable for payment of any taxes, duties,
penalties, levied by regulatory authorities.
2.8. Proof of delivery will be by way of MIS or Electronic delivery confirmation for
the shipments booked vides our network. Hardcopy of Pods or photocopies of
DRS will be submitted in case of any dispute
2.9. The shipper may choose to insure the goods against all risks and loss. All
consignments are booked at shippers risk. A Certificate of facts will be
provided in case of any incidents requiring claims.
2.10. FOC Rs 0.2% will be charged on the invoice value if it is insured by shipper
2.11. It is agreed that the rates quoted by the Company in the contract for
customers is subject to a minimum average business of Rs. 50,000/- (Rupees
Fifty Thousand) per month, in case of the average business per month comes
below the above figure, the company reserves the right to charge customer
at a higher rate subject to a maximum of its prevailing tariff.
2.12. Carriers risk is undertaken at charges of 1% on value of shipment up to a
maximum of Rs.1Lakh. all shipments above 1-Lakh are booked on shippers
risk

2.13. Liquids, Cash, Currency, Shares, Gold, Precious Stones, Fragile Items, Gas,
Radioactive materials, Chemicals & Explosives are banned.
2.14. Any Dispute / Claim arising out of this contract shall be referred to
Arbitration of a Sole Arbitrator to be appointed by DTDC.

The Arbitration

proceedings shall be governed by the provisions of the Arbitration &

Conciliation Act, 1996 and the Venue of Arbitration shall be at Chennai."
