INTRODUCTION
This document is the First Scope of Analysis (Final Scope) for the proposed
Choma Housing Projects Environmental Impact Statement (EIS). This First
Scope has been prepared to describe the proposed project, present the proposed
framework for the EIS analysis, and discuss the procedures to be followed in the
preparation of the DEIS. This EIS will be prepared pursuant to the
Environmental Management Act No. 12 of 2011 and its implementing
regulations.

Oral submissions were received during the public hearing held by Greenfields
Consult on 24th May 2013 at Choma Civic Centre. The majority of the
comments relevant to the Scope focused on (1) the proposed projects effects on
direct and indirect displacement of businesses and residents; (2) compatibility
and connectivity of the proposed project to its surrounding neighbourhoods; and
(3) construction-related impacts.

1.1

Background
Choma District is strategically located in the heart or centre of Southern
Province and plays an important role in the economy of Southern Province.

Choma Town was recently re-established as the administrative capital of


Southern Province. This development has exacerbated the already existing
housing deficit being face in Choma, with many of the existing housing units in
deplorable condition and overcrowded. Choma municipality has tried to provide
some plots in an effort to cushion the towns housing problem, however, in
recent months, Choma town has experienced a fast growing urban population.
This has left Choma with housing shortage more serious than in the major towns
across Southern Province.

In order to help alleviate the housing shortage, Baptist Mid Mission (BMM) has
come up with a housing project which is purely a private sector driven initiative
to compliment the efforts of the Choma municipality.

Overall objective
The principal objective of this report is to undertake an environmental impact
assessment starting with a Scoping Report and Terms of Reference for the
Choma Housing Project in Choma District of the Southern Province.

1.3 Specific Objective


The specific objectives are to provide a set of housing development
environmental impact analysis scenarios for the Choma housing which can be
used for the short term, medium term and long term decisions regarding
environmental management.
1.3

Environmental Legislation
This Scoping Report is prepared in accordance with the legal framework on
Environmental Management enshrined in the Environmental Protection and
Pollution Control Act, Cap 204 of the Laws of Zambia and its subsidiary
legislation, the Environmental Impact Assessment Regulations S.I. No. 28 of
1997. Section 3 (1) of the EIA Regulations states that, a developer shall not
implement a project for which a project brief or environmental impact
statement is required under these Regulations, unless the project brief or the
environmental impact statement has been concluded in accordance with these
regulations and the Environmental Council of Zambia has issued a decision
letter.

The proposed project is outlined in the Environmental Impact Assessment


Regulations S.I. No. 28 of 1997, Second Schedule (Regulations (7)(2)) Section
1(a) under the heading: Designing of new townships which are more than 5Ha
or more or sites covering 700 dwellings and above shall require an
Environmental Impact Assessment.

The scoping exercise was conducted in line with the provisions of these EIA
Regulations.

Study Approach and Methodology


The method adopted during the scoping process involved consultative
meetings and discussions with relevant government institutions at district
level, local communities, representatives from NGOs and resident
development committee. The process also included initial environmental
survey of the project site.

Responses from the consultations and discussions provided the relevant


background information and helped identify major environmental concerns of
the communities in the project area for this Scoping report.

PROJECT DESCRIPTION

Background
Baptist Mid Mission (BMM) has acquired Farm 79A in Choma District, which is
located adjacent to Riverside residential area. The farm, measuring about 714
Hectares, is located about 2 km from the Choma Central Business District. BMM
intends to develop the farm into a prime urban residential housing complex and other
related facilities. The land when fully developed is expected to host a prime urban
residential housing estate, residential smallholdings, shopping complexes, and other
social amenities.

The development of Choma Housing Estate will involve the construction of about
3000 houses and social amenities on an area of about 714 Hectares. The table below
gives a detailed description of the project and proposed landuse:

re-established as the provincial capital of Southern Province. The project is private


sector driven from inception to implementation. The project developer proposes to
have a strong control on the quality and pace of development so as to maintain high
standards of housing.

The housing project will be located Southwest of Choma, about 2km from the Central
Business District.

This is suitably close to the town centre.

The site borders

Riverside on the eastern fringe, Nahumba Mission on the South and Macha road on
the Western side. The proposed site is an existing farm that has largely been unused
for a long period.

The Choma Housing Concept


The developer proposes to develop an underutilized and underdeveloped area by
providing residential plots, retail, hotel, publicly accessible open space, roads and
parking space. All houses would be built to international standards within the confines
of a safe, secure and exclusive community in an environmentally friendly setting.

The estimated total investment of the Choma Housing Project will be reflected in the
draft report.

2.1 PURPOSE AND NEED


The overarching goal of the proposed development is to transform an area that is
blighted and largely underutilized into a vibrant modern mixed-use community as
well as cushion Choma housing deficit. The proposed project aims to provide greatly
needed affordable and market-rate housing and first-class shopping malls. The
proposed project is intended to more specifically,

Contribute to other stakeholders effort to meet the short- and long-term


demand for affordable and market-rate housing; and

Foster and support growth of Choma through: (a) the creation of jobs and
economic activity during construction and operation of the new housing units,
commercial office, and retail development; and (b) the introduction of new
households, which will stimulate the local economy by purchasing goods and
services from local businesses;

BASELINE CONDITION OF THE PROJECT ENVIRONMENT

3.1

Geophysical Environment
3.1.1

Location

Choma District is in the heart of Southern Province making it strategically


located both as an administrative capital for the province as well as playing a
major role in the economic activities of the Southern Province.
The District lies approximately within longitudes 260 30I and 270 30I east of
Greenwich, and latitudes 160 and 170 45I south of the equator on the plateau of
southern Zambia and covers a total area of 7,296 square kilometres. It shares

boundaries with five other districts in the province namely: Namwala in the
North, Pemba on the Eastern side, Gwembe in the Southeast, Sinazongwe in
the South and Kalomo in the West. The district is predominantly rural and
agriculture forms the mainstay of its economy.
3.1.2

Climate

Most of the district lies at 1400 metres above sea level. This district is found
on high ground with typical climate of southern Zambia of temperatures
between 140c and 280c, sunshine ranging between 9 and 12 hours per day. The
highest temperatures occur between the beginning of October and the end of
December. In normal instances when the rains start, temperatures tend to fall,
partly because of the rain and partly due to the often heavy cloud cover. The
lowest temperatures are usually recorded in June and July.

The rains generally start in the middle of October and continue through up to
the beginning of April. Rainfall reaches its peak around January after which it
diminishes slightly up to the beginning of April when usually it ceases
entirely. There is an average rainfall of 800mm, of which 369mm, fall between
January and February. There are however, variations in total rainfall and
rainfall patterns from year to year and even in a particular season. These
variations can have a major impact on crop yield in the different zones in the
area. Humidity falls to about 33% until the onset of rains in October after
which it skyrockets to about 77% in February. Humidity nosedives once the
rains cease in April. The wind is predominantly from the East and SouthWest, and to a lesser degree from the North- East. The strength of the wind
from these directions can be comparatively strong.

3.1.3

Vegetation

The vegetation of the project site is principally Acacia grassland with clumps
of trees on anthills. anthills are widespread in project site. Most anthills have
large Euphorbia on top. Other common large trees are Combretum molle,
Erythrina abbysinica and Ziziphus mucronata. The bulk of the anthill
vegetation consist of small trees chiefly Azanza gackeana, Markhamia

obtusifolia, Popowa and Securidaca longependiculata with Drospyros spp and


Eudea spp locally frequent.

Grasses comprise species of Andropogon, Brachiaria, Digitalia,Cymbopogon,


Heteropogon, Hyparrhenia, Setaria, Loudetia, Eragrotis, Aristida. Weed
species seen to flourish in the project site. The following are especially
prominent towards the end of the rains Bidens spilosa, Hibiscus ssp, Sida
spp, Solanum spp.

Riparian woodland occurs in a discontinous strip along the two streams that
frank the project site. It is dominated by Syzygium spp both S. Cordatum and
S. guineense with stretches of salix, and Rhus spp both R, longipes and R.
quactiniaus. Doclonea, Phyllanthus and Sesbania sesban fill some of the gaps
Phragmites rush the rest.

Miombo woodland occurs on a variety of soils dominated by Brashystegia


boehmii, B. Spiciformis on Julbernardia globiflora, separately or in
conjunction.

3.1.4 Hydro geological Information


The Dolomitic limestone soils are predominant in the project site and carry
open woodland with scattered trees in dense fall grass. Granite sands cover the
fringes of the streams while quartz ridges and schistol soils are present favour
dominance of B, spiciformis.

The drainage of the project site is characterised by two perennial streams.


These are also embarked at different points to provide water reservoirs (i.e.
Dams) for human and animal consumption.

Socio-economic Environment
3.2.1

Population

Of the 247,860 population of Choma, 120,689 are male and 127,171 are
female. It has a total of 44,483 households of which 33,078 are male headed
and 8,502 female headed. (CSO: 2012).

The most dominant ethnic group in the district are the plateau Tonga who are
found in every part of the district. A mixture of the Ila and the Bawe, which
are the dialect of Tonga exist mainly in the eastern part of the district.
However, recent migration from other parts of the country has brought a
representation of most tribes especially in urban Choma.
3.2.2

Economic Activities

Famous for cattle ranching, Choma is also the major transit town between
Lusaka and Livingstone. The district attracts traffic of tourists and business
executives enroute to sites such as the Victoria Falls in Livingstone and also
boasts the Choma Museum as a tourist attraction.

Today, not including retail and wholesale concerns, there is a large and active
base of over 20 major privately owned companies operating in Choma District.
The area continues to attract a high number of inward investments and new
start businesses.

Choma has a total of 32 health facilities (with one a government hospital and a
mission hospital) and one hundred and sixty primary health services/ home
based care arrangements, 124 schools, 2 tertiary institutions.
3.3

Settlements around the housing Project Site


The proposed site for the housing project lies to the West of Choma town,
about 2kms from Lusaka-Livingstone Road and covers a stretch of
approximately, 714 Hectares. It forms a boundary with the Riverside
residential area and falls within the Kulundana ward of Choma central
constituency. There are no settlements within the project site.

within the proposed project area.

PUBLIC MEETINGS/ CONSULTATIONS


Approach and Methodology
The method adopted for community consultations was open discussions with
the relevant local institutions at district level, representatives from NGOs and
community based organisations and residents from communities living around
the proposed project site.

Responses from the consultations and interviews provided the relevant


background information and helped identify major environmental concerns of
the communities around the proposed project site which helped in the
preparation of the Scoping Report.
4.2

Key Presentations, Questions and Concerns from the Consultative


Meeting
During public consultative meetings with the local communities, the
environmental team gave presentations on the project and also received the
questions/concerns from the community on issues that should be considered
and investigated in the detailed EIA.

These discussions were centred on:

resources, water, etc.)

The most important features (e.g. market places, gathering sites,


schools, clinics, quarries, and access roads, etc.)

POTENTIAL ENVIRONMENTAL IMPACTS

The concerns of the public and the key potential environmental impacts will
all be carefully addressed in the EIA.

From the consultations and field survey of the proposed project, it is the
opinion of the project proponent that the focal environmental issues when
setting up the housing project are:

the houses include:

Increased incidences of HIV/AIDS, other STIs and pregnancies

Eutrophication of nearby streams

Employment for the local community

The concerns of the public and the key potential negative environmental
impacts will be carefully addressed in the detailed EIA study.

PROPOSED TERMS OF REFERENCE FOR EIA


The developer will undertake an Environmental Impact Assessment (EIA) and
the output from this will be an Environmental Impact Statement (EIS) also
containing an Environmental Management & Monitoring Plan (EMMP). The
EIS will describe the negative and positive impacts of the project during its
entire life cycle. The study will recommend measures for mitigation of
negative environmental effects and enhancement of the benefits.

Scope of EIA
The scope of the EIA shall comprise, but not necessarily be limited to:

This section will elaborate on the policy, legislative and administrative


frameworks on which the Environmental Impact Assessment has been

Description of Project Activities

Description of the project activities to be carried out at different stages of the


project. The description will include not only a description of the project but
also a description of its operation and the types and amounts of materials and
sources to be obtained from including wastes to be generated.

Baseline Environmental Information

Description of the environment, which may be affected by the proposed


project development. This includes collection, compilation and analysis of
environmental and socio-economic data in the project areas. The following
elements are covered:

Location (regional context, physical constraints, land tenure, surrounding


land uses, local infrastructure);

REPORT FORMAT
The EIA will be concise and the discussion limited to significant
environmental issues. The main text will focus on findings, conclusions and
recommended actions. The conclusions and recommendations will be
substantiated by relevant data in annexes.

The EIS will contain a non-technical summary in a style of writing


understandable for the majority of the general public. The format of the EIS

Minutes of the Community Consultative Meeting

Held in the Choma Municipal Council Conference Room on 24th


May, 2013 at 08:30

1.1

Introduction
As part of the Environmental Impact Assessment (EIA) process a meeting was
arranged at the Civic Centre on 24th May, 2013 just before consultants visit
to the project site. A total of 18 people attended the meeting.

1.2

Purpose
The Community consultation meeting was held with the affected communities
and members of the District Development Coordinating Committee and was
intended to present information on the project and to obtain the views of those
consulted in the public meeting.

1.3

Composition and Expertise of the Consultants Team


The Consultants (Greenfield) consisted of three persons (Lewis Tumbama
Socio-economic/Sustainable Development Specialist, Jones Mulomba
Natural Resources Specialist and Isaac Fwembe Agro Forestry/Meeting
Facilitator), the Consultants conducted the community consultation meeting
and delivered the presentations.

End of Meeting

The meeting was tailored to focus on key issues and concerns of the
community.

WELCOMING REMARKS
Mr. Vincent Sikanyeela, the District Administrative Officer for Choma
District called the meeting to order at 09:10hours.He welcomed all the
consultants to the district and informed them that there could have been more
participants if the meeting did not coincide with the burial of His Royal
Highness Chief Mapanza. He further informed the consultants that the District
Commissioner could not afford to reschedule this meeting because it seeks to
address the accommodation crisis that has besieged the town of Choma. He
urged the participants to contribute to this meeting effectively if they have to
meet its objectives and contribute to the accelerated development of Choma.
After the DAO gave his welcoming remarks, he asked each of the participants
to introduce themselves.

PURPOSE OF THE MEETING


Mr Isaac Fwemba, the environmental specialist outlined the purpose of the
meeting. He explained that Baptist Mid Mission had sent a team of consultants
(of which he was team leader) to carry out an Environmental Impact
Assessment for the Choma housing project. He then explained the importance
of an Environmental Impact Assessment (EIA) to such projects.

answers, which was designed to collect views from the participants. A
summary of the participants' questions/answers over the Choma housing
project is presented in the following section.

Introduction to the Consultation Meeting

The Meeting was called to order at 09:10 hours after a prayer was given by Mr
Sikanyeela. Self-introduction of both Consultants and participants was done
and the meeting commenced.

Session 2:

Presentation of the Project Activities

Facilitator:

Isaac Fwemba

He explained to the participants how consultants would handle the EIA, taking
into account all the relevant consultations. He explained the Environmental
Management Act No 12 of 20011 was the supreme Law in terms
environmental management in the country. He explained that this process is
very important in that it forms the basis for developing Terms of Reference
specialist studies. He highlighted that after scoping activities, specialist studies
are conducted, environmental impacts are determined and mitigation measures
are proposed.

Mr Fwemba informed the meeting that concerns that are expressed by the
public shall be incorporated in the draft report which shall be submitted to
ZEMA for initial review and after addressing their comments on the draft
report, the final EIA report shall be submitted for consideration. He hinted that
at this stage, ZEMA decides whether to approve the project or not. The final
outcome of the process is a Decision Letter which states whether the project is
approved or rejected. If rejected, reasons shall be given and if approved,
conditions of approval shall be given.

Session 3:

Presentation of Project background

Facilitator:

Humphrey Masumu

Mr Masumu explained that there was a crisis in terms of housing units in


Choma. He further explained that government has to partner with the private
sector in order to nurture a lasting solution to the supply deficit. Mr Masumu
informed the meeting that this project aims at closing the gap in the demand
and supply of housing units that has been created due to the change in the
status of Choma. He indicated that besides the housing units, the area has
provisions for places of worship, shopping malls, filling stations and schools

Facilitator:

The session was facilitated by Lewis Tumbama who presented the socioeconomic impacts of the project. He explained the impacts associated with the
project activities during its life cycle.

The following Questions/Concerns were raised:

Concern:

There was concern raised by the one of the participants Mr


Chikoli that Choma residents must be given first priority to
purchase the plots. Also the contractors should come and
employ the local people skilled in a number of skills.

Another, concern was raised by Mr Victor Nakasamu that they


want the contractor to give first priority to the local people
before they can even consider outsiders for employment.

Answer:

Its clear that unskilled labour is got locally but for skilled labour
its difficult to get the locals because it involves operation of
complex machines which are expensive to replace once
damaged, hence the need for skilled labour. As for unskilled
labour may be the locals can register with there area councillors
so that they employ the people you know.

Question:

Mr Mubita: How many plots are expected to be sold?

Answer:

Three thousand plots

Concern:

Mr Meckson Machilika raised a concern that the community


should be consulted on sites for material and upon the
completion of the construction of the structures, the contractor
should make sure they bury the pits from which they get sand
and also replace the trees that they will use.

Question:

Jones Mulomba: From what I have observed we have only


talked about traffic, employment and deforestation. Do you have
any other areas that may be impacted upon by the construction
of the roads and houses?

Answer:

Mr. Sandie Mukandawire: Spread of HIV/AIDS is likely to be


an area where construction of the houses will impact on the
community. He further observed that there should be some
deliberate programme to sensitise both the workers and the local
community. Due to cash flow school girls may stop school
opting for money and in the long run contracting HIV/AIDS.

Concern:

Ms Rita Syafuko: Is it possible to consider tree planting as part


of mitigation measures.

Answer:

Isaac Fwemba: Basically, there will be an Environmental


Management Plan for the project and in the plan the contractor
should work in line with government departments, local
authority and local community and ensure that if any tree is cut
then it should be replanted and we recommend that the trees
replanted are the same indigenous trees. So the local forestry
office should work in line with the contractor. Also locals
should plant nurseries so that they can sell the trees to the
contractor.

Concern:

Mr Sandie Mukandawire, there will be noise, radiation and


ground water contamination through pit latrines in the area

Concern:

Florence Beenzu: There are no graves near the project site.

Concern:

Mrs Sandra Sikaputa: Come up with the report based on the


submissions then the second stage call for submissions.

Conclusion: Isaac Fwemba: He gave concluding remarks and thanked


participants for having been active during the deliberations and
further informed the participants that further consultation will
follow in a detailed EIA after approval of this Scoping Report
and TORs by ZEMA

There being no further questions and concerns, Mr


Sikanyeela thanked the members of the meeting and
closed at 12:25 hrs.

Lewis is more of a socio-economic specialist/Social Impact Assessment for Sustainable
Development, Environmental Impact Assessment projects/Studies and has an accumulated work
experience of about 8 years in Consultancy work, particularly participating in conducting qualitative
baselines, Social and Environmental Impact Assessments,Mine Environmental Audits (Surface and
Underground),Trunk,district and Rural road socio-economic Baselines and impact assessments and
Evaluative Community-Based Social Researches in both Rural and Urban Areas of Zambia.
Currently, Lewis is the Zambian/National Resettlement Expert on the preparation of the
Resettlement Action Plan for the Lusaka Water Supply, Sanitation and Drainage Project under
TETRATECH/Millenium Challenge Account Zambia.
As a Socio-Economic,Cultural, and Environmental Consultant, Lewis has been exposed to diverse
cultural settings across all the provinces and 97% of the districts of Zambia and has so far
facilitated more than 450 different community meetings, mainly to do with social and
environmental issues/impacts that are as a result of different development activities/projects taking
place within their immediate environments. He is therefore very familiar with the use of different
Participatory Tools.
Between early 2009 and end of 2010, Lewis was involved in a Country-Wide study on Poverty and
/Socio-Economic Assessments along Feeder, Trunk and District Roads in all the provinces of
Zambia (Zambias first set of studies to ascertain the impact of rural roads on community
socio-economic wellbeing under EU /RDA funded Output and Performance Related Road
Contracts (OPRC) Programme). In this study, Lewis had been leading in Community and other
Stakeholder Consultations and had so far (on this exercise), conducted more than 70 community
and other stakeholder consultations using different participatory methodologies.
Further, Lewis has been engaged (Oct 2010- January/February 2012) as a socio-economic specialist
on an Integrated Development Plans Project for two (2) districts (Mufumbwe and Kabompo) in the

NorthWestern Province of Zambia. In light of the Town and Country Planning Act, Cap 283 of the
Laws of Zambia, this comprehensive assignment involved preparation of settlement plans that
would effectively guide the growth and development of the two small towns/districts with potential
of serious mining activities.
His work experience dates back to 2001 when Lewis started participating in social research projects
under internship arrangements whilst studying at the University of Zambia. Since 2001, Lewis has
worked with different consulting firms and individual consultants on a number of projects across
Zambia. Since graduation from the University, Lewis has never worked in full time employment for
a long time and is currently a free lance development Consultant.
