20

Darryn,
this is about Adam Goodes and why some people are booing him, yet not his brother
who al.so plays in the AFL.
In case you are not aware of it the High Court of Australia in Monis v The Queen, Droudis v The
Queen, [2013] HCA 4, 27 February 2013, S172/2012 & S179/2012 made clear
Applicable principles

25

102

The Constitution provides for a system of representative and responsible government. Sections 7 and 24 of
the Constitution provide that the two Houses of the Parliament must be "directly chosen by the people".
Section 64 requires that no Minister of State hold office "for a longer period than three months unless he is
or becomes a senator or a member of the House of Representatives". Those who are elected as members of
the Parliament and those who are appointed as Ministers of State are necessarily accountable to "the
people" referred to in ss 7 and 24. Additionally, s 128 provides that the Constitution shall not be altered
except in the manner provided in that section; in particular, only "if in a majority of the States a majority of
the electors voting approve the proposed law, and if a majority of all the electors voting also approve the
proposed law". As the whole Court said in Lange1, it follows from these and other provisions that
"[f]reedom of communication on matters of government and politics is an indispensable incident of
that system of representative government which the Constitution creates".

103

Because freedom of communication on matters of government and politics is an indispensable

incident of the constitutionally prescribed system of government, that freedom cannot be curtailed by
the exercise of legislative or executive power2 and the common law cannot be inconsistent with it. But
the freedom is not absolute and it follows that the limit on legislative power is also not absolute.

Adam Goodes is not just a football player but the pin up boy of a political campaign to amend

40

As the AFL was advertising for the Recognise campaign, but since my 31-5-2015
complaint stopped doing so, and I understand the Federal Government also withdrew its
support recently, then it was clear that Adam Goodes was using his football to promote
Recognise a political issue.
It is therefore permissible for spectators opposed to this racism campaign to booing Adam
Goodes for this and other statements he made.
As long as he promotes his political campaign I view it would be unlawful for you to claim
you will not allow spectators their constitutional rights to oppose this campaign by expressing
their opposition by booing.
Surely you have enough intelligence to know that as a political figure you too cop at times
criticism. Well, Adam Goodes chose to get involved as a poster boy for the politicians to
promote the Recognise campaign which divides even Aboriginals and so he just have to
cop the flake resulting from this.

our country, have raped, killed and stolen from your people for their own benefit.

Now imagine how it feels when the people who benefited most from those rapes, those killings
and that theft the people in whose name the oppression was done turn away in disgust

The wording the people in whose name the oppression was done turn away in disgust
when someone seeks to expose it. In my view relates to past alleged crimes of about 225 years
ago to the present people alive! Afgter all it is now exposed not 225 yeaqrs ago.
5

.
And well one only has to check the internet posting how many are upset about this all.
.

10

Then he made this what I view threat against paying spectators, including children, where if it
had been a Islamic activist he would be in prison already. So you really support him making
threats towards children?
I taught my children not to resort to violence and now may find my grandchildren to risk being
the target of a pretended spear throwing. And you support this?
.
To me Adam Goodes is not the victim but the villain and playing the race card should not work.

15

20

There are Aboriginals who promote to get rid of all n on-Aboriginals from Australia and well are
you going to support their conduct? After all what Adam Goodes did was to use some kiddies
recent created war dance as I understand it to pretend it was a traditional Ab original war
dance. Well I understand from Aboriginals Elders they are very upset that Adam Goodes
somehow dictates what a traditional war dance is!
Then is the argument that the Haka is performed as a ceremonial war dance. As I understand it
this is done prior to the game against the opponent team and not during the game against paying
spectators, let alone children.
Did you consider that some of the spectators may also have been of Aboriginal descent?

25

So they are racist to boo against Adam Goodes?

.
To me what Adam Goodes did should have been dealt with under terrorism legal provisions no
different than that is with those supporting terrorism of ISIS or otherwise.

30

What is someone was to enter the stadium in Geelong and pretend to cut someones head or have
some noose made from a belt as to express their kind of religious or traditional conduct how to
deal with a person, are you then going to justify this or is it that if the person is not of Aboriginal
descent than it is deemed to be an offence?

The colonial powers were also casting eyes on New Guinea; Russian and Italian warships
paid visits in 1870s, but the 'Great Game' in this part of the world was really being played
by Britain, who acquired Fiji by cession in 1875, and Germany, who had commercial
interests, but did not yet rule, in Samoa.
5
Decisions were made far away from the Torres Strait about the future of the region and
although Queensland made repeated moves to annex the islands of the Torres Strait,
actually the final decision always rested with London.
10

In 1872, Letters Patent were sent from the Colonial Secretary in Britain and Queensland
annexed the islands up to sixty miles from the coast of Cape York.
The administrative centre was moved from Somerset (established in 1864), on Cape York,
to Thursday Island, although not until 1877.

15
In 1879, the majority of the remaining islands in Torres Strait were annexed to Queensland,
by Letters Patent from London again, and by an Act in the Legislative Assembly in
Brisbane. Torres Strait had become part of Queensland.

Why recognise Torres Strait Islanders in the constitution but not the Dutch or other nations
that settled long before Torres Strait Islands were part of Australia?

10

15

20

Anyhow I will await the response from Alan Joyce now poster boy Adam Goodes was as I
view it threatening spectators, if this is what Qantas support also?
END QUOTE
What we need is not politicians and others to support a grown adult threatening spectators in
particular children but rather to denounce such a conduct.
Muslims have been part of Australian society for well before federation and yet because of a few
hot heads (so to say) then we find many peaceful law abiding Muslims given hell on earth. Yet,
here we have Adam Goodes doing something that the AFL failed to address appropriately and
now other players have been doing the same and well it seems because they are Aboriginals they
can get away with it. This is precisely how pedophilia was escalating because those in charge so
to say by their silence condoned it.
So, if someone pretends to have a knife and rob a store then you will argue that the person really
is the victim for being blamed for something when all he may claim is to do a traditional dance?
Come on your intelligence surely isnt that low that you cannot grasp the seriousness of what
Adam Goodes did?
I have already posted on the police website my disapproval that it failed to my knowledge so far
to act. I view also that the AFL failure to act appropriately has resulted to escalation of this
kiddies war dance to threaten spectators.

25

It is not relevant if he had or didnt have a spear or other weapon, as the mere fact he pretended
to do so in itself in my view likely could have severely traumatized spectators, in particular
children who have witnesses real violence in the past.
Those spectators paid to see a game and booing is part of it. And not all spectators engaged in
booing and yet still were the subject of an alleged spear throwing.

30

35

It appears to me you are a b it colour full in your ordinary doing and well to me that is your right
and I have no issue with that provided you do not engage in threatening people. To me what you
appear to me to have done is to support this threatening of paying spectators and deny any of
them their constitutional political liberty merely because you seem to me to lack the
understanding what it is all about.
Adam Goodes, as I only recently ( in the last few days) read in his Australian of the Year speech,
referred to equality and yet it appears to me he is dealing with disadvantage children of
Aboriginal descent but not those disadvantaged children who are not of Aboriginal descent. And
that is equality?
.
And we seem to get much of the same from the AFL.

40

.
And then you wonder why racism is flourishing?

7
Before you have words falling from your lips as to issues wouldnt it be better you first consider
all relevant issues and details?

Now you are seemingly supporting Adam Goodes and by it seeking to deny paying
spectators/patrons to cast their disapproval against Adam Goodes merely because he plays the
race card, whereas it has been eventuating against numerous other players who were or were not
of Aboriginal descent.
This Recognise campaign in my view is something Adam Goodes doesnt understand the true
constitutional issues about and he should in my view not campaign for something he doesnt
understand. I would not tell a footballer how to play football!

10

It is ridiculous players are supporting Adam Goodes as if he is the victim when they by this turn
against the very paying patrons who are in the end paying their huge salaries.
In my view Adam Goodes committed serious criminal offences in the purported Aboriginal war
dance against paying patrons and should be charged for this and let the courts then decide if he
is guilty or not. And so every other player who did so should in my view be charged.

15

Failing to do so promotes this kind of conduct and then violence will soon be part of the game.
One only needs one spectator to become so traumatized by this conduct to ac t against the player
doing so and we can end up in bloodshed. Is that what you as mayor of Geelong like to see
eventuating?

20

25

30

Let us be clear about it this is not some pick on Adam Goodes because he is of Aboriginal
descent, but because he is poster boy of a political campaign that even is dividing Aboriginals
and acts in a threatening manner towards paying patrons and those paying patrons do not deserve
to threatened in such a manner. If you as a mayor fail to understand this then I suggest you better
resign. After all the last thing people in Geelong need is the have violence as part of normal
acceptable conduct.
I felt it very traumatic to see Adam Goodes to do as he did with his kiddies war dance when I
saw children in that area.
The display of violence should never be a part of the game but the AFL appears to me to be
incompetent to deal appropriately with it. So, they are all about dealing with spectators who may
use racial abuse, even when a child refers to him as an ape, but he and since that others are
permitted to use a form of violent conduct during the game.
Then again I have at times been referred to as an ape, monkey, etc, but never used a race card as
to med that simply was an expression by people and I view darn silly to take it serious.
.

35

If paying patrons (spectators) desire to express their grievances with booing Adam Goodes as a
political figurehead then well Adam Goodes did br4ing it upon himself as such.
If others are him because they are displeased about how he plays football then why should Adam
Goodes get special privileges but not for other players.

40

If you want to kill the game to deny spectators to get verbally as such involved in the game then
well you and the AFL seems to me doing a good job for it. Perhaps you rather have that instead
of booing spectators use the same threatening conduct as Adam Goodes used towards them?

Well we will see if this so called solidarity by other players using jumpers, etc, and even black,
red and yellow bands around their arms will be ongoing support for Adam Goodes.

10

15

In case you dont know it the person who designed the Aboriginal flag made known it is his flag
that can be used by Aboriginals as well as environmental purposes, As such it is not an
Aboriginal flag at all but a privately owned flag. Nor are the colours true Aboriginal, because the
Dutch flag was part of Aboriginal tribes in what is now known as Western Australia, where you
find the copper coloured mixture of Aboriginal-Dutch descent, and many have blond hair.
Dont forget that by directly and/or indirectly condoning display of violence during a game you
will so to say create that children watching this will then adopt the violence to their lifestyle.
Dont we have already enough domestic violence issues at hand that we do not need to create an
expansion of this?
I made my initial complaint on 31-5-2015 and yet still have not had any descent response from
the AFL about my complaint. And by this the threatening display has been now performed by
others also. In my view the AFL itself should have reported this matter to the Victorian Police as
to stamp out any such conduct, whereas (again) it now seems to condone it. Neither do I accept
the Premier of Victoria Daniel Andrews somehow getting behind Adam Goodes as surely he
should fight against display of violence where he pretend to do so against domestic violence.

20

Well we will see if the Swans plying Geelong will be another outpouring of support for
Adam Goodes, and so against the paying patrons or the Geelong players and others will
accept that Adam Goodes did bring it upon himself and should accept the consequences.

25

In my view a support for Adam Goodes is to support violence. The argument that it has gone
on for too long is nonsense, as he has placed himself in a political campaign that remains
ongoing and so well let him cop the disgruntled spectators booing, or have you rather they
resort to violence?

30

35

Equality includes equality within legal provisions and well we will see if the AFL finally
report the matter to the Victorian Police and stop the repeat playing of the offensive conduct
if will go on to permit more of the same, to show to children violence is deemed alright.
I do view Geelong council should address your comments to deal with people booing as I
view this is well beyond your rights to do so where spectators express their peaceful
disapproval of Adam Goodes.
This document is not intended and neither must be perceived to refer to all
details/issues.
Disclosure: I have relatives of Aboriginal descent.
