What is probate?

robate refers to the

process of re-titling
assets from a deceased
person to his or her heirs-at-law, or
to his or her named beneficiaries.
A person who dies without a
will is considered intestate. His
assets pass to those persons set
out under the laws of the state in
which he died (or, in some cases,
in which he owned real estate.)
These laws are called intestacy
statutes. The persons who take
under these statutes are called
heirs-at-law. In Connecticut, in
the absence of a will, a share of
the estate passes to a spouse and a
share to children of the marriage
or children of a prior marriage; if
none, then to parents; then siblings; then nieces and nephews,
and so on to further degrees of
relationship.

If a person has a will, the intestacy statutes dont apply, and the
estate is considered testate. (Testate comes from the Latin word
for a writing.) Assets pass to the
persons named in the will.
A persons estate is normally
probated in the court for the state
and district in which the person
resided at the time of death. The
probate proceeding consists of
admitting, or proving, the will to
probate; appointing the executor
(in the case of a will) or administrator (in the case of an intestate
estate); preparing and filing with
the court an inventory of the assets owned by the person; paying
expenses, such as funeral expenses,
last medical expenses, any debts
or claims, taxes, and expenses of
administering the estate (such as
probate, accounting, attorneys
and executors fees) and finally,
accounting to the court for assets

received by the executor or administrator of the estate and obtaining
court approval for distribution of
the assets to the beneficiaries.
Tax proceedings are also involved in settling estates of deceased persons. Without tax
clearance from state and federal
authorities, assets are often nontransferable (or, if transferred, subject to inchoate liens for possible
taxes due.) Probating an estate,
then, is required to transfer title to
property (real estate, securities and
other assets) to the persons entitled
to receive them.
Probate also refers to those
courts that deal with and oversee
the probate of estates, administration of testamentary trusts (trusts
under wills), the interpretation
of wills and trusts, conservatorships, guardianships, commitment
proceedings and termination of
parental rights, among other mat-

ters. Probate courts are courts of

limited jurisdiction. This means
that they can only consider those
matters assigned to them by the
Legislature.
Probate courts have been part of
Connecticuts judicial system since
1698. In their 300-plus year history,
Connecticut probate courts have
been local, informal, and easily accessible. Until recently, there was a
probate court in nearly every town
in Connecticut. In 2009, financial
exigency resulted in regionalization of the probate court system.
There are now 54 probate courts in
Connecticut.
