Please take notice that the Court, Second Division, issued a Resolution
dated 17 June 2015 which readsasfollows:
*G.R. No. 217872 (Alliance For The Family Foundation Philippines, Inc.
[ALFI] and Atty. Maria ConcepcionS. Noche, in her own behalf and as President
of ALFI, et al. vs.Dr. Junette L. Garin, Secretary-Designateof the Department of
Healtlt, et al.).- After deliberatingon the petition for certiorari,prohibition/mandamus
assailingthe mannerof implementationof RepublicAct No. 10354(RH Law) by the
responsibleofficers of the Departmentof Health (DOH) and Food and Drug
Administration(FDA) and all personsacting for and on their behalf,asbeing contrary
to the RH Law and the Judgmentof the SupremeCourt and carried out without
observanceof due processand with grave abuseof discretionamountingto lack or
excessof jurisdiction, with prayerfor the urgent issuanceof a temporaryrestraining
order and/or writ of preliminary prohibitory and mandatory injunction, seeking
amongothers:[1] to enjoin the respondentpublic officers,and all personsacting for
and on their behalf from procuring,selling,distributing,dispensingor administering
andlor allowing or pursuing the procurement,sale, distribution dispensationor
administrationof reproductiveproductsand supplies,including contraceptivedrugs
and devices, and L2] to cancel and withdraw any and all registrations or recertificationsmade of reproductiveproductsand supplies,including contraceptive
drugsand devices,and to prohibit the sale,distribution,administrationand useof the
same,and it appearingthat the FDA had alreadycertified two (2) types of Implanon
known to have abortifacient character,and registered andlor re-certified other
contraceptivedrugs and deviceswithout holding any hearing or consultation;with
further prayerthat this Court annul and nullify the certifications,orders,resolutions
for the registrationandlorre-certificationof contraceptivedrugs and devicesby the
FDA andthe DOH for havingbeenissuedwithout or in excessofjurisdiction or with
grave abuse of discretionamountingto lack or excessof jurisdiction, the Court
resolvesto REQUIRE respondents
to file COMMENT on the petition,not a motion
to dismiss,within ten (10) daysfrom notice,andto ISSUE, effectiveimmediatelyand
continuing until further orders from this Court a TEMPORARY RESTRAINING
ORDER enjoining the respondents,
their representatives,
agentsor other persons
acting on their behalf from: [1] granting any and all pending applicationsfor
registration andlor recertification for reproductiveproducts and supplies including
contraceptive
drugsand devices;and [2] procuring,selling,distributing,dispensingor
administering,advertisingand promotingthe hormonalcontraceptive"Implanon" and
