In the present case, accused is facing trial for the offences
U/s. 279/338 IPC.
I have explained to both the parties that offence U/s. 338
IPC can be legally compounded by them through judicial settlement and
I have explained to the parties about the benefits of settlement /
compounding the present case through the judicial settlement. I have
also explained to the injured that he is under no obligation / compulsion
to settle the case with the accused and in case, he does not want to
settle the case, then case will be proceeded on merits.
After having a meeting, it is submitted by both the parties
that they have voluntarily, without any fear, force, coercion or
inducement have arrived at a judicial settlement of the present case and
now they want to compound the present case as accused has agreed to
pay a sum of Rs. 30,000/- to the injured.
Injured has shown his Driving License in proof of his
identification. Photocopy of the same is taken on record.

I am the injured in the present case. I have compromised
the matter with the accused as accused has given Rs. 30,000/- to me in
the court today towards compensation. I do not want to pursue further
against the accused. My case may kindly be allowed to be compounded
and disposed of as settled.

Order:
Statement of injured recorded. In view of the same, offence
under Section 338 IPC is allowed to be compounded and accused is
acquitted for the same.
As far as Sections 279 IPC is concerned, accused submits
that he wants to plead guilty. Accused has been warned that his
pleading guilty for the offence U/s. 279 IPC can invite conviction and can
also invite maximum provided punishment for offence. The accused still
submits that he wants to plead guilty. He prays for a lenient view.
In view of

his plead of guilt, I convict the accused for

offence U/s. 279 IPC.

Convict states that he has his family to be maintained by
him and he is sole bread earner in his family and prays for a lenient
view.
Keeping in view the facts and circumstances of the case
and submissions made above, convict is sentenced for the offence under

--3-Section 279 IPC with a fine of Rs. 1,000/-.


Fine paid.
His bail bond is cancelled and surety is discharged.
Documents, if any, be returned to convict / surety after cancellation of
endorsement.
Superdarinama furnished by the superdar, if any, is hereby
cancelled.
Copy of order be given dasti to both the parties, as prayed
for.

suggest that having read the contents in Dwarka City, I got
publishedtheallegednewsarticleinDwarkaMetro.Itiswrongto
suggest that the alleged news article in Dwarka Metro was the
counterblast/retaliationofthenewsitempublishedinDwarka
City.TheDwarkadheeshMandirisbeingmanagedandcontrolled
bymyelderbrothernamelyVishnuSharmasinceabout200001.
Vol.Foracoupleofyearsduringtheinterregnum,themandirwas
beingmanagedbysomerelatives.Itiswrongtosuggestthatmy
motherwasalsoinvolvedinthemanagementofthesaidmandir.
However,myfatherwasthepartofthemanagement.Themandir
isbuiltuponDDALand.IknowapersonknownasDhananjaywho
was associated with the said mandir. It is wrong to suggest that
therewasanyillicitrelationbetweenthesaidDhananjayandthe
pujaranofmandir(Objectedtobytheld.counselforcomplainant).

ItiswrongtosuggestthattheIOinthecaseFIRNo.396/2007used
tovisit my residence often.It is correct that the then ACP Bhag
Singh was also supervising and investigating the said case. It is
correctthatIhaveallegedthatsomemoneywasgiventoACPBhag
Singh.IhavemetwithACPBhagSingh.Itiscorrectthatthemoney
giventoACPBhagSinghwaslaterreturnedtomebythesaidACP
BhagSingh.ItiswrongtosuggestthatIamdeposingfalselyatthe
instanceofaccused.ItisfurtherwrongtosuggestthatIhavebeen
dictatedandadvisedbytheaccusedtodeposeinthecourt.Itis
furtherwrongtosuggestthatIandaccusedareincollusionwith
eachother.
