VERIFIED EXPLANATION
I, CHITO A. LACERAS, Head of Traffic Operations, TOMECO, Tacloban
City, in compliance with the Memorandum No. 11-08-022 dated 5 August 2011 of
HRMO of Tacloban City, HON. TEOFILA H. BROSAS, about an attached
anonymous letter protest to the City Mayor, under oath respectfully submits this
Explanation, to wit:
1. Purportedly, sixty five (65) signatories of the protest alleged in the letter
protest the following trumped-up charges against Chito Laceras, to wit:
a) From what they learned, Laceras was notorious
as a Kotong cop and involved in drugs when he was in
active duty as a policeman;
b) When he was still assigned in the issuance of
police clearance, he asked P200 from applicants;
c) One signatory claims that he personally knows
that undersigned, who is now assigned in TOMECO, is a
protector of Taiwanese businessmen who owned
Superstar, 578 Emporium;
d) That he is also protector of vans traveling to
Samar with Plate Nos. HVL-212, HVL 282, HVL 970,
HVM151, HVS 508, HUB 886, HVP 672, HVL 972, HUH 575,
among others;
e) They hear stories from TOMECO riders that he
would partake of their gasoline allowances, and he would
threaten those who would not give him a share; and
f) They also heard that he maltreated a TOMECO
member and threatened him with a gun; that he also
threw a chair to another.
2. The Memorandum directs the undersigned to shed light on the matter
and why no administrative charges will be filed against him for violation of Civil
Service and other appropriate laws, rules and regulations.
3. It is respectfully submitted that such matters above stated in par. 1(a) to
1(f) are and should not be considered as legitimate charges, since they are really
libelous and baseless statements made by one or two individuals only who
wish/es to besmirch the reputation of the undersigned, for the following reasons:
a) All these purported charges in par. 1(a) and (b) above are hearsay;
there is clear showing that about 65 unidentified persons do not have personal
knowledge about the facts averred; moreover, if the same were allegedly
committed during his tenure as a policeman, the same is now moot and
academic since he has retired from the service already without any pending
criminal or administrative charges;

b) The allegation in par. 1 (c) above is self-serving and without legal or
factual basis; the lowly job of the undersigned is being an administrative head of
traffic operations in the streets of Tacloban City, which job description is not
related to administering business establishments; there is no proof to the
contrary of his being an alleged protector of Taiwanese businessmen or stores;
c) the allegation in par. 1(d) above is likewise hearsay and self-serving;
if such allegation is true, any of the owners/drivers of those mentioned vans
should have come out to protest and file charges against him, if any; anyway, it is
very easy to note down the plate numbers, considering that the anonymous
complainant is apparently a jealous competitor inside the TOMECO, who is out to
discredit the undersigned; as a matter of fact, the purported signatures would
clearly reveal that they are of the same strokes and written by one and the same
person; and
d) the allegations in par. 1 (e) and (f) above are likewise hearsay and
self-serving; the TOMECO riders are willing to testify on the falsity of such
allegation that undersigned partakes of their gasoline allowances; likewise, if any
TOMECO enforcer was maltreated or threatened by the undersigned with a gun
or a chair thrown to him, such person should or would have the reason and
personal interest to file such charges against the undersigned; on the contrary,
this protest is not even substantiated by any proof of such allegation such as the
name of the person threatened or maltreated.
It is respectfully submitted that this verified explanation finds merit and
kind consideration of this Office in order to dismiss outright the unwarranted and
malicious charges against the undersigned.
