JUDGMENT
The appeal from the judgment of the Federal
Court of Appeal, Number A-208-09, 2009
FCA 246, dated August 14, 2009, heard on
November 13, 2009, is allowed in part with
costs to the respondent. The application for
judicial review of the government's decision
and policy not to seek the repatriation of the
respondent is allowed in part. This Court
declares that through the conduct of Canadian
officials in the course of interrogations in
2003 and 2004, as established on the
evidence, Canada actively participated in a
process contrary to its international human
rights obligations and contributed to the
respondent's ongoing detention so as to
deprive him of his right to liberty and security
of the person guaranteed by s. 7 of the
Canadian Charter of Rights and Freedoms,
contrary to the principles of fundamental

JUGEMENT
L'appel interjete contre l'arret de la Cour
d'appel federale, numero A-208-09, 2009
CAF 246, en date du 14 aout 2009, entendu Ie
13 novembre 2009, est accueilli en partie avec
depens en faveur de l'intime. La demande de
contr6le judiciaire de la decision du
gouvernement et de sa politi que de ne pas
demander Ie rapatriement de l'intime est
accueillie en partie. La Cour declare que,
compte tenu de la conduite de responsables
canadiens lors d'interrogatoires menes en
2003 et 2004, telle qu'elle est etablie par la
preuve, Ie Canada a activement participe 11 un
processus contraire aux obligations
internationales qui lui incombent en matiere
de droits de la personne et a contribue 11 la
detention continue de l'intime, de telle sorte
qu'il a porte atteinte 11 son droit 11 la liberte et
11 la securite de Ia personne que lui garantit
I'art. 7 de la Charte canadienne des droits et
libertes, et ce, de maniere incompatible avec
de justice fondamenlale.
