COUNTER-AFFIDAVIT
I, ANTHONY B. DOQUE, of legal age, Filipino, single and a resident of
Purok #2, Brgy. Espinosa, Masbate City after having duly sworn oath in
accordance with law, do hereby depose and say;
1. That I am the same person who is charged with the crimes of Alarm
and Scandal, docketed under NPS Docket No. V-04-INQ-14L00828 and Resistance and Disobedience to a Person in
Authority or the Agents of Such, docketed under NPS Docket No.
V-04-INQ-14L-00829 which is now within the jurisdiction of the
Municipal Trial Court in Cities docketed as Crim. Case No. 14815
only for Resistance and Disobedience to a Person in Authority;
2. That I am executing this Counter-Affidavit to attest and admit that I
have committed the acts and omission stated in the complaint against
me;
3. That I am taking full responsibility of what had transpired that day;
4. As a matter of fact, I voluntarily surrendered to the arresting officers
and spent five (5) days in prison as a result thereof;

5. That I am regretting the moment I have committed it for it does not

only affected me, but it is also causing much burden to my family;
6. What is more, both complainants Alexander L. Aguillon, Jr. and Ruth M.
Suicon already went to Fiscals Office to settle the issue among us
parties as the formers decided to forgive me of the ill-doing I caused
to them by putting it through an Affidavit of Desistance;
7. However, the Prosecutor refused to accept the desistance and required
me to take an Affidavit of Undertaking. (Copy of the Affidavit of
Undertaking is attached as Annex A);
In this humble circumstances, it is most humbly prayed that this
Honorable Court may be pleased to dismiss the above-titled case and pass
such further or other orders as this Honorable Court may deem fit and
proper in the facts and circumstances of the case and thus render justice.

PRAYER
WHEREFORE, premises considered, it is respectfully prayed that the
instant criminal complaint be DISMISSED for lack of merit.
Further, theaccused respectfully pray for such and other reliefs as may
be deemed just and equitable in the premises.

AFFIDAVIT OF UNDERTAKING
I, ANTHONY B. DOQUE, of legal age, Filipino, single and a resident of
Purok #2, Brgy. Espinosa, Masbate City after having duly sworn oath in
accordance with law, do hereby depose and say;
1. That I am the same person who is charged with the crimes of Alarm
and Scandal, docketed under NPS Docket No. V-04-INQ-14L00828 and Resistance and Disobedience to a Person in
Authority or the Agents of Such, docketed under NPS Docket No.
V-04-INQ-14L-00829 which is now within the jurisdiction of the
Municipal Trial Court in Cities docketed as Crim. Case No. 14815
only for Resistance and Disobedience to a Person in Authority;
2. That this not the first time a committed such crime;
3. That I was arrested before when I was fourteen (14) years old and
was kept under the care of the Department of Social Welfare and
Development, Masbate City;
4. That I am deeply regretting committing such crimes;
5. That I am reflecting on the things I done of which I am at fault; and
6. That I promise to not commit any similar crimes that will not just put
me in jeopardy but likewise, putting so much burden in my family.
