AGREEMENT

Between

SPORTS, YOUTH AFFAIRS, TOURISM & ARCHAEOLOGY DEPARTMENT

PAKISTAN
And

TOURISM & ARCHAEOLOGY DEPARTMENT GOVERNMENT OF ISFAHAN


ISLAMIC REPUBLIC OF IRAN
This agreement is made on the_________day of________2012
Between
The Secretary Sports, Youth Affairs, Tourism, Archeology & Museum Department Government of the
Khyber Pakhtunkhwa and on behalf of the Provincial Chief Minister (hereinafter referred to as the Party
1) on the First Part.

And
Province of Isfahan Government of Iran is authorized to sign and execute this Agreement on
behalf of the (hereinafter referred to as Party 2) of the Second Part, and both are collectively
known as the Parties
WHEREAS the Parties are desirous of forging mutual support to achieve their goals and
objectives in promotion and institutionalization of Tourism for economic growth in respective
provinces and mutually share the existing knowledge by organizing training courses,
seminars and workshops to explore the tourism potential in both the Provinces. It is the intent
and purpose of the Parties hereto that this Agreement constitutes an implementation
framework for promotion of institutionalization of tourism sector. The programme shall be
financed as per terms parameters mentioned below:
GENERAL PARAMETERS
1.1

The programme will be called Promotion of Institutionalization Of Tourism Sector for


economic growth in their respective Provinces. The same will be executed by the PAITHOM at 1)
Peshawar 2) Swat.

1.2

The Parties will join hands for vocational training in hospitality and tourism sector in the field(s) of:
1) Front Office 2) House Keeping 3) Food & Beverage (Production) 4) Food & Beverage
(Service) 5) Tour Guides 6) Tour Operator 7) Management Workshops 8) Introductory
Seminars

1.3

The Parties will ensure maximum outreach to the prospective applicants through local and regional
publicity sponsored by the both the Provincial Governments respectively.

1.4

The parties will make efforts towards achieving gender balance in the implementation of this
programme.

1.5

In case of an encouraging response and higher demand for a particular course(s), the Parties may,
through mutual agreement, increase enrollment by adding additional sections subject to availability
of capacity
(in lieu of any other approved course/ trade having lower response) within approved
cost.

1.6

In case of low response from the applicants, not reaching the 80% of the agreed strength, in any
particular trade, the training in that particular trade will not be started without the prior
approval/authorization of both the Governments.

1.7 In granting admissions, the parties will give priority to the stated objectives of providing training to upgrade skill of public and private sector and as well as to unskilled and unemployed persons . The
both Governments shall provide the lists of applicants and merit list along with recommendations
to each other to finalize the admissions.
1.8 The PAITHOM & Iranian side Institute shall submit time table, nominal roll, course outline and detail of
faculty including their bio-data/ C.V in agreed course(s)/trade(s) as these are organized. The both

the Governments shall monitor and evaluate the programme for achievement of its objectives in
terms of quality and quantity in the manner as deemed appropriate from time to time.
1.12A copy of Agreement shall be passed on by both the Governments to the each individual training
providing institute (in case the executing agency is dealing with more than one institution) so that
they may be aware of the modalities of the training.
1.13No regular post will be created for the this funded projects. However, some visiting faculty/staff, if
required may be hired in consultation with both the Governments.

2.2

Principal/ Head of Institutes will ensure the availability of Junior Instructor(s)/ Workshop Assistant(s)
during Practical hours, whereas the Instructor for theory will be responsible for teaching of theory
as well as overall supervision and performance of practical.

2.3

The PAITHOM shall submit draft advertisement for each batch to the Government for publication
in the local dailies.

3.0
3.1

FINANCIAL PARAMETERS.
Both the Governments shall finance the training in the agreed areas of skills while adhering to
parameters of this agreement and the agreed cost to be determined by a prior mutual agreement:

1.9 As a result of Monitoring and Evaluation/Audit, the Parties may alter (drop or add) any course outline,
trade, facility or institute by mutual agreement within the approved trades/ courses in project cost.
1.10All the enrolled trainees will be registered with, examined by & certified by Concerned Board/
organization of both the Provincial Governmental Institutes.

3.3

The training providers of both the provinces sha ll maintain accounts of funds provided by
respective Governments as per Standard Operating Procedure (SOP) for Maintenance of
Accounts by both the Governments. The Accounts funds released by the Government shall be
subject to audit by the Government.

3.4

Total cost of the project after signing of Agreement, both the Governments shall release the
amounts in the following manner:
60% at the time of the inception
30% based on satisfactory performance report by the Government and after verification by
the Governments Monitoring Teams about utilization of the funds already released to the
training provider.
10% near completion of the project on final recommendation of the Government monitors.

3.5

On completion of each batch, the final calculations shall be made on the basis of agreed criteria of
costing of the training. In case of variation (+/-) in output of trainees, the variation Statement shall
be prepared and cost shall be adjusted as follows:

In case of variation (+/-) no adjustment shall be made by the Government against the
Remuneration of instructional & non instructional staff and Overheads.
In case of increase in enrolment(+ variation) but less than agreed batch size strength,
payments on agreed rates will be made against two heads only i.e. Consumables and
Registration, testing & certification.
In case of dropouts (- variation) deductions against two heads (i.e.Consumables and
Registration, testing & certification) shall be made @ 50% of the agreed rate on the basis
of per trainee per course.
If training in any agreed trade is adjourned due to low response deductions shall be made
under heads registration, remuneration of instructional, non-instructional staff, testing
& certification and consumables as per agreed costing of adjourned trade.

3.6

The amount of advance (60%) and the amounts subsequently released be transferred to a joint
account titled the Government/ training Institute to be operated by the authorized
representative(s).

3.7

After the first release, the parties shall submit two statements of expenditure/disbursement from
account: one in middle of each course and other at the end of each course.

3.8

While making payments to suppliers, service providers, instructional and non-instructional staff, the
parties shall deduct the Income Tax and Sales Tax according to the Laws and Rules enforced for
the time being in respective training areas of both the provinces.

4.0 PROCUREMENT/DISPOSAL PARAMETERS


4.1

The parties shall follow the Government Procurement rules while procuring goods, works and
services of the Project.

5.0 MISCELLANEOUS PARAMETERS


5.1

In case dispute arises during the effective period of agreement, the Committee comprising one
representative, each from both the parties headed by a joint nominee of the parties shall settle the
dispute. The decision of the Committee shall be binding on the Parties.

5.2

This Agreement shall be valid for a period of ------- or up till the completion of the project whichever
is applicable and shall enter into force from the date of signing and may be extended for further
similar period with prior written consent of the Parties.

5.3

This Agreement may be modified or amended at any time with mutual consent of the Parties.

5.4 Nothing in this Agreement shall affect the statutory responsibilities of either party and should either
party feel that this Agreement is no longer appropriate to continue, they can give three months notice of
termination in writing after which time the Agreement shall cease to exist and the next batch shall not be
launched.
