JUDICIAL AFFIDAVIT OF JAMES REYES,
HUMAN RESOURCE MANAGER OF CONVERGYS
This Judicial Affidavit of JAMES REYES, is executed to serve as his
direct testimony in the instant case. This Judicial Affidavit is offered to
prove that:
(1) The AFFIANT is Human Resources Manager of Convergys and
the supervising officer of the Defendant;
(2) The DEFENDANT is currently employed in Convergys;
(3) The DEFENDANT is with a steady source of income;
(4) The DEFENDANT has capacity to support his child.
QUESTIONS were propounded by the Counsel for the Petitioner,
Atty. Iriz B. Beleno, at the ABAD, BELENO, DUCEPEC and ROSARIO
LAW OFFICES at No. 10 Gallifrey St. Makati City, in English, which the
Affiant fully understands; while ANSWERS were given by JAMES REYES,
in English, fully conscious that he does so under oath, and that he may face
criminal liability for false testimony or perjury. The corresponding answer of
the witness is provided after each question.
QUESTIONS AND ANSWERS

Do you swear to tell the truth and nothing but the truth?
I do.

Q2: Are you aware that you may face criminal liability for false
testimony or perjury if you will not tell the truth?
A2: I am.
Q3: Please state your name and other personal circumstances.

A3:

I am James Reyes, thirty four years old, resident of #12 Privet Drive,
Makati City.

Q4: Do you have any proof of those personal circumstances?

A4: Yes, here is my Drivers License.
Witness presented his drivers license and a copy. Such document is attached
herewith as Exhibit A.
Q5: Why are you here?
A5: I am here because of a subpoena issued against me.
Q6: Do you know what the subpoena was for?
A6: Yes. It was for a case involving Robert V. David.
Q7: How do you know him?
A7: I know him because he works at Convergys. Weve become friends, as
well.
Q8: Since when have you known him?
A8: Since April 30, 2014, when I interviewed him and offered him a job
here in Convergys.
Q9: Do you have proof of his employment in Convergys?
A9: Yes, his employment contract.
Witness presented a copy of the employment contract of the Respondent with
Convergys, dated April 30, 2014. Such document is attached herewith as
Exhibit B.
Q10: What is Convergys?
A10: Convergys is a call center. Our main office is at 6796 Ayala Ave.
corner Salcedo St. Makati City.
Q11: What is your association with Convergys?
A11: I am the Human Resources Manager for the Makati Branch.
Q12: As manager, what are your duties?
A12: I am in charge of the Human Resource Department.
Q13: Can you please expound on that?
A13: I am in charge of making administrative decisions, paying salaries,
hiring employees and terminating their employment.
Q14: So you are aware of how much each employee makes?
A14: Yes.
Q15: Are you aware of the monthly salary of Robert?
A15: Yes.

Q16: How much is the monthly salary of Robert?

A16: Thirty thousand pesos.
Q17: Does the thirty thousand pesos include all of his benefits and
allowances?
A17: No.
Q18: What other benefits does Robert have?
A18: He receives four thousand pesos non-taxable allowance and health
benefits worth ten thousand pesos.
Let it be noted that the witness took his time in answering the question, and
was reminded of his oath to answer truthfully before the answer was given.
Q19: Do you have proof of the amount of Roberts salary, allowance
and benefits?
A19: Yes.
Witness presented a copy of the payslips of the Respondent for the months of
May to December, 2014 Such document is attached herewith as Exhibit
C.
Q20: Is this the normal salary of a call center agent in your company?
A20: No.
Q21: Why is that?
A21: Robert is not just a call center agent but a team leader, as well.
Q22: Is a team leader more superior than call center agents?
A22: Yes, in a way. They are still call center agents but with more
responsibilities.
Q23: What are the responsibilities of a team leader?
A23: They direct their team of call center agents. They report to their
supervising officer in behalf of the team. More complicated customer
service issues are passed on to them and they are tasked to evaluate
the members of their teams once in a while.
Q24: What is Roberts current work schedule?
Q24: From six PM to two AM, Monday to Friday.
Q25: How is Robert as an employee?
A25: He is a valued employee of the company a favorite of the bosses.
Hes very charming and hard-working.
I am executing this affidavit to attest the truth of the foregoing.
